5981 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
6082 SECTION 1. NEW LAW A new section of law to be codified
6183 in the Oklahoma Statutes as Section 32-118 of Title 11, unless there
6284 is created a duplication in numbering, re ads as follows:
6385 This act shall be known and may be cited as the “Municipal
6486 Parking Benefit District Act ”.
6587 SECTION 2. NEW LAW A new section of law to be codified
6688 in the Oklahoma Statutes as Section 32-119 of Title 11, unless there
6789 is created a duplication in numbering, reads as foll ows:

95-As used in this act:
96142 1. “Governing body” shall mean the city council, city
97143 commission, or board of trustees of an incorporated city or town ;
98144 2. “Mail” shall mean first-class mail;
99145 3. “Municipality” shall mean any incorporated city or town ; and
100146 4. “Parking benefit district ” shall mean a defined geographic
101147 area in which a majority of the revenue generated from on-street
102148 parking facilities within the district is used to finance
103149 improvements within such district.
104150 SECTION 3. NEW LAW A new section of law to be codified
105151 in the Oklahoma Statutes as Section 32-120 of Title 11, unless there
106152 is created a duplication in numbering, reads as follows:
107153 The governing body of any municipality in this state may create
108154 one or more parking benefit districts for the purpose of permitting
109155 advisory committees, provided for in Section 5 of this act, to
110156 provide recommendations to and bring issues to the attention of the
111157 municipality regarding the maintenance of th e municipality’s parking
112158 meter program within such districts.
113159 SECTION 4. NEW LAW A new section of law to be codified
114160 in the Oklahoma Statutes as Section 32-121 of Title 11, unless there
115161 is created a duplication in numbering, reads as follows:
116162 A. The creation of a parking benefit district shall be preceded
117163 by notice and a public hearing . Such notice shall:

145215 1. Contain the time, date, and place of the meeting where the
146216 governing body shall hold a hearing on the creation of such
147217 district;
148218 2. Describe the proposed boundaries of such district; and
149219 3. State the proposed term of authorization for such district.
150220 B. Not less than ten (10) days nor more than thirty (30) days
151221 before the day of the hearing, the municipal clerk or designee
152222 shall:
153223 1. Mail the notice of the hearing on the proposed parking
154224 benefit district to the owners of the tracts or parcels of land to
155225 be included in the district at each owner’s last-known address;
156226 2. Publish the date, time, and place of the hearing in a
157227 newspaper of general circulation in th e municipality; and
158228 3. Publish the date, time, and place of the hearing on a
159229 website if the municipal governing body maintains an I nternet
160230 website.
161231 Failure of an owner to receive such notice shall not invalidate
162232 any of the proceedings authorized in t his act.
163233 C. At the hearing of the governing body on the creation of such
164234 district, any interested resident of the municipality, or business
165235 owner or resident of the proposed parking benefit district, may file
166236 a written protest or objection questioning th e propriety and
167237 advisability of establishing the parking benefit district.
168238 D. At the hearing, the governing body may:

196290 1. Correct any mistake or irregularity i n any proceeding
197291 relating to the parking benefit district ;
198292 2. Remove any tract or parcel of land, the inclusion of which
199293 has been protested by the owner, from such district;
200294 3. Add any tract or parcel of land adjacent to the proposed
201295 boundaries of such district upon request of the owner;
202296 4. Revise the proposed term of authorization for such district ;
203297 and
204298 5. Approve or reject the establishmen t of such district.
205299 E. Approval of the establishment of a parking benefit district
206300 shall include the effective start date of the district and describe
207301 the term of authorization for such district , and may include any
208302 other terms and conditions n ot inconsistent with the laws of this
209303 state.
210304 SECTION 5. NEW LAW A new section of law to be codified
211305 in the Oklahoma Statutes as Section 32-122 of Title 11, unless there
212306 is created a duplication in numbering, reads as follows:
213307 A. For each parking benefit district establish ed, an advisory
214308 committee may be formed by resolution or ordinance to provide input
215309 and make recommendations to the municipality on issues relating to
216310 the maintenance of the parking met er program in the parking benefit
217311 district including, but not limited to, pote ntial projects to be
218312 funded with revenue generated from the parking benefit district and
219313 the timing and order of such projects. Regardless of the

247365 establishment of an advisory committee, all aspects of a
248366 municipality’s parking meter program shall be under the supervision
249367 and control of the governing body of such municipality.
250368 B. If an advisory committee is established, it shall consist of
251369 not less than three and not more than sev en people serving without
252370 compensation, to be appointed jointly by a majority of the members
253371 of the governing body of the municipality. The term of office of
254372 each of the members of the committee shall be fixed by the governing
255373 body; however, all members of the committee shall serve stag gered
256374 terms. Immediately after their appointment, the members of the
257375 committee shall meet and organize by electing one of their members
258376 as chair, and such other offices as the committee may de em
259377 necessary. The committee shall elect the chair and any other
260378 officers annually. Vacancies on the committee occurring otherwise
261379 than by expiration of term of office shall be filled by the
262380 presiding officer of the governing body of the municipality o nly for
263381 the unexpired term of the membe r whose vacancy is being filled. All
264382 members of the committee shall either reside or own a business in
265383 the area of the parking benefit district. A majority of the members
266384 of the committee shall be business owners. Should a member of the
267385 committee no longer reside or own a business in the parking benefit
268386 district, that member ’s position shall become vacant. No member of
269387 the committee shall be an emp loyee of the municipality.

297439 C. Notwithstanding the composition of an advisory committee,
298440 the municipality may include as nonvoting members of the committee
299441 such municipal officials or employees as the municipality desires.
300442 D. An advisory committee shall meet at the call of the
301443 committee chair, provided that the commit tee shall meet at least
302444 once a year during the duration of the parking benefit district.
303445 SECTION 6. NEW LAW A new section of law to be codified
304446 in the Oklahoma Statutes as Section 32-123 of Title 11, unless there
305447 is created a duplication in numbering, reads as follows:
306448 A. Starting on the effective date of a parking benefit
307449 district, the governing body of a mu nicipality may hold in a special
308450 fund all revenue received by the munici pality from the parking meter
309451 program within such district.
310452 B. Such funds may be used to pa y the cost of any improvements
311453 or repairs necessary for the maintenance of the parki ng meter
312454 program within such district.
313455 SECTION 7. NEW LAW A new section of law to be codified
314456 in the Oklahoma Statutes as Section 32-124 of Title 11, unless there
315457 is created a duplication in numbering, rea ds as follows:
316458 A. The governing bo dy of any municipality may modify or
317459 terminate any parking benefit district s within its jurisdiction,
318460 with or without cause, b y resolution or ordinance after providing
319461 notice and a public hearin g on the subject in the same manner as
320462 required for the creation of such districts in this act.

348514 B. In the event a parking benefit district is terminated, any
349515 fees and revenues generated from the use of parking meters in the
350516 district being held for the maintenance of the parking me ter program
351517 within the district that have not been expended shall be released to
352518 the municipality and no longer obligated to the terminated district.
353519 SECTION 8. NEW LAW A new section of law to be codified
354520 in the Oklahoma Statutes as Section 32-125 of Title 11, unless there
355521 is created a duplication in numbering, reads as follows:
356522 The authority granted by this act is cumulative to municipal
357523 powers and does not limit the authority of a municipality to
358524 maintain or manage a parking meter program.
359525 SECTION 9. This act shall become effective November 1, 2024.
