59	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	57		SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -1432.2, is
61	58		amended to read as follows:
62	59		Section 1-1432.2 As used in this act:
63	60		1. "Food" means a food, food product, food ingredient, dietary
64	61		ingredient, dietary supplement or beverage for human consumption;
65	62		2. "Kratom product" means a food product or ingredient
66	63		containing any part of the dietary supplement that consists of or
67	64		contains kratom leaf of the plant Mitragyna speciosa or kratom leaf
	65	+	extract that does not contain any synthesized kratom alkaloids,

95		-	extract that does not contain any synthesized kratom alkaloids,
96	92		other synthesized kratom constituents, or synthesized metabolites of
97	93		any kratom constituent in which the level of 7 -hydroxymitragynine,
98	94		on a percent weight basis, is not greater than one percent (1%) of
99	95		the amount of total kratom alkaloid s, as confirmed with a high -
100	96		performance liquid chromatography testing method. For purposes of
101	97		this paragraph, "synthesized" refers to substances produced using
102	98		directed synthetic or biosynthetic chemistry, as opposed to
103	99		traditional food preparation techni ques such as heating or
104	100		extracting; and
105	101		3. "Vendor" means a person that sells, prepares or maintains
106	102		kratom products or that advertises, represents or holds itself out
107	103		as selling, preparing or maintaining kratom products and includes a
108	104		manufacturer, wholesaler, store, restaurant, hotel, catering
109	105		facility, camp, bakery, delicatessen, supermarket, grocery store,
110	106		convenience store, nursing home or food or drink company.
111	107		SECTION 2. This act shall become effective November 1, 2024.
