7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 22 O.S. 2021, Section 60.6, is
7777 amended to read as follows:
7878 Section 60.6. A. Except as otherwise provided by this secti on,
7979 any person who:
8080 1. Has been served with an emergency temporary, ex parte or
8181 final protective order or foreign protective order and is in
8282 violation of such protective order, upon conviction, shall be guilty
8383 of a misdemeanor and shall be punished by a fine of not more than
8484 One Thousand Dollars ($1,000.00) or by a term of imprisonment in the
8585 county jail of not more th an one (1) year, or by both such fine and
8686 imprisonment; and

138138 2. After a previous conviction of a violation of a protective
139139 order, is convicted of a second or su bsequent offense pursuant to
140140 the provisions of this section shall, upon conviction, be guilty of
141141 a felony and shall be punished by a term of imprisonment in the
142142 custody of the Department of Corrections for not less than one (1)
143143 year nor more than three (3) years, or by a fine of not less than
144144 Two Thousand Dollars ($2,000.00) nor more than Ten Thousan d Dollars
145145 ($10,000.00), or by both such fine and imprisonment .
146146 B. 1. Any person who has been served with an emergency
147147 temporary, ex parte or final protective order or foreign protective
148148 order who violates the protective order and causes physical injury
149149 or physical impairment to the plaintiff or to any other person named
150150 in said protective order shall, upon conviction, be guilty of a
151151 misdemeanor and shall be punished by a term of imprisonment in the
152152 county jail for not less than twenty (20) days nor more t han one (1)
153153 year. In addition to the term of imprisonment, t he person may be
154154 punished by a fine not to exceed Five Thousand Dollars ($5,000 .00).
155155 2. Any person who is convicted of a second or subsequent
156156 violation of a protective order which causes physical injury or
157157 physical impairment to a plaintiff or to any othe r person named in
158158 the protective order shall be guilty of a felony and shall be
159159 punished by a term of imprisonment in the custody of the Department
160160 of Corrections of not less than one (1) year no r more than five (5)
161161 years, or by a fine of not less than Thr ee Thousand Dollars

214214 both such fine and imprisonment.
215215 3. In determining the term of imprisonment required by this
216216 section, the jury or sentencing judge shall consider the degree of
217217 physical injury or physical impairment to the victim.
218218 4. The provisions of this subsection shall not affect the
219219 applicability of Sections 644, 645, 647 and 652 of Title 21 of the
220220 Oklahoma Statutes.
221221 C. The minimum sentence of imprisonment issued pursuant to the
222222 provisions of paragraph 2 of subsection A and paragraph 2 of
223223 subsection B of this section shall not be subject to statutory
224224 provisions for suspended sentences, deferred sentences or probation,
225225 provided the court may subject any remaining penalty under the
226226 jurisdiction of the court to the statutory provisio ns for suspended
227227 sentences, deferred sentences or probation.
228228 D. In addition to any other penalty specified by this section,
229229 the court shall requ ire a defendant to undergo the treatment or
230230 participate in the counseling services necessary to bring about the
231231 cessation of domestic abuse against the victim o r to bring about the
232232 cessation of stalking or harassment of the victim. For every
233233 conviction of violation of a protective order:
234234 1. The court shall specifi cally order as a condition of a
235235 suspended sentence or probation that a defendant participate in

287287 counseling or undergo treatment to bring about the cessation of
288288 domestic abuse as specified in para graph 2 of this subsection;
289289 2. a. The court shall require the defendant to participate
290290 in counseling or undergo treatment for domestic abuse
291291 by an individual licensed practitioner or a domestic
292292 abuse treatment program certified by the Attorney
293293 General. If the defendant is ordered to participate
294294 in a domestic abuse counseling or treatment program,
295295 the order shall require the defendant to attend the
296296 program for a minimum of fifty -two (52) weeks,
297297 complete the program, and be evaluated before and
298298 after attendance of the program by a program counselor
299299 or a private counselor.
300300 b. A program for anger management, couples counseling, or
301301 family and marital counseling shall not solely qualify
302302 for the counseling or treatment requirement for
303303 domestic abuse pursuant to this subsection. The
304304 counseling may be ordered in addition to counseling
305305 specifically for the treatment of domes tic abuse or
306306 per evaluation as set forth below. If, after
307307 sufficient evaluation and attendance at required
308308 counseling sessions, the domestic vio lence treatment
309309 program or licensed professional determines t hat the
310310 defendant does not evaluate as a perpetrator of

362362 domestic violence or do es evaluate as a per petrator of
363363 domestic violence and should complete other programs
364364 of treatment simultaneously or prior to domestic
365365 violence treatment, including but not limit ed to
366366 programs related to the mental health, appar ent
367367 substance or alcohol abuse or inability or refusal to
368368 manage anger, the defendant shall be ordered to
369369 complete the counseling as per the reco mmendations of
370370 the domestic violence treatment program or lic ensed
371371 professional;
372372 3. a. The court shall set a review hearing no more than one
373373 hundred twenty (120) days after the defendant is
374374 ordered to participate in a domestic abuse counseling
375375 program or undergo treatment for domestic abuse to
376376 assure the attendance and compliance of the defendant
377377 with the provisions of this subsection and the
378378 domestic abuse counseling or treatment requirements.
379379 b. The court shall set a second review hearing after the
380380 completion of the counseling or treatment to assure
381381 the attendance and compliance of the defendant with
382382 the provisions of this subsection and the domestic
383383 abuse counseling or treatment requirements. The court
384384 may suspend sentencing of the defendant until the
385385 defendant has presented proof to the court of

437437 enrollment in a program of treatment for domestic
438438 abuse by an individual licensed practitioner or a
439439 domestic abuse treatment program certified by the
440440 Attorney General and attendance at weekly sessions of
441441 such program. Such proof shall be presented to the
442442 court by the defendant no later than one hundred
443443 twenty (120) days after the defendant is ordere d to
444444 such counseling or treatment. At such time, the court
445445 may complete sentencing, beginning the period of the
446446 sentence from the date that proof of enrollment is
447447 presented to the court, and schedule reviews as
448448 required by subparagraphs a and b of this paragraph
449449 and paragraphs 4 and 5 of this subsection. The court
450450 shall retain continuing jurisdiction over the
451451 defendant during the course of ordered counseling
452452 through the final review hearing;
453453 4. The court may set subsequent or other review hearings as the
454454 court determines necessary to assure the defendant attends and fully
455455 complies with the provisions of this subsection and the domestic
456456 abuse counseling or treatment requirements ;
457457 5. At any review hearing, if the defendant is n ot
458458 satisfactorily attending individual counseling or a domestic abuse
459459 counseling or treatment program or is not in compliance with any
460460 domestic abuse counseling or treatment requirements, the court may

512512 order the defendant to further or continue counseling, treatment, or
513513 other necessary services. The cou rt may revoke all or any part of a
514514 suspended sentence, deferred sentence, or probation pursuant to
515515 Section 991b of this title and subject the defendant to an y or all
516516 remaining portions of the original senten ce;
517517 6. At the first review hearing, the court shall require the
518518 defendant to appear in court. Thereafter, for any subsequent review
519519 hearings, the court may accept a report on the progress of the
520520 defendant from individual counseling, domestic abuse counseling, or
521521 the treatment progra m. There shall be n o requirement for the victim
522522 to attend review hearings; and
523523 7. If funding is available, a referee may be appointed and
524524 assigned by the presiding judge of th e district court to hear
525525 designated cases set for review under this subsection. Reasonable
526526 compensation for the referees shall be fixed by the presiding judge.
527527 The referee shall meet the requir ements and perform all duties in
528528 the same manner and procedur e as set forth in Sections 1 -8-103 and
529529 2-2-702 of Title 10A of the Oklahoma Sta tutes pertaining to referees
530530 appointed in juvenile proceedings.
531531 E. Emergency temporary, ex parte and final protective orders
532532 shall include notice of these penalties.
533533 F. When a minor child violates the provisions of any protec tive
534534 order, the violation shall be heard in a juvenile proceeding and the
535535 court may order the child and the parent or parents of the child to

587587 participate in family counseling services necessary to bring abo ut
588588 the cessation of domestic abuse against the victim and may order
589589 community service hours to be p erformed in lieu of any fine or
590590 imprisonment authorized by this section.
591591 G. Any district court of this state and any judge thereof shall
592592 be immune from any liability or prosecution for issuing an order
593593 that requires a defendant to:
594594 1. Attend a treatment program for domestic abusers certified by
595595 the Attorney General;
596596 2. Attend counseling or treatme nt services ordered as part of
597597 any final protective order or for any violation of a protective
598598 order; and
599599 3. Attend, complete, and be evalu ated before and afte r
600600 attendance by a treatment program for domestic abusers certified by
601601 the Attorney General.
602602 H. At no time, under any proceeding, may a person protected by
603603 a protective order be held to be in violation of th at protective
604604 order. Only a defendant against whom a protective order has been
605605 issued may be held to have violated the order.
606606 I. 1. In addition to any other penalty specified by this
607607 section, the court may order a defendant to use an active, real -
608608 time, twenty-four-hour Global Positioning System (GPS) monitoring
609609 device as a condition of a sentence. The court may further order

662662 and monitoring.
663663 2. The court may order a d efendant accused of a first violation
664664 of a protective order to use a GPS monitoring device prior to trial
665665 and may order the defendant to pay costs and expenses related to the
666666 GPS device and monitoring. The court may order a de fendant accused
667667 of a second or subsequent violation of a protective order to be held
668668 in the county jail without bond until tria l.
669669 SECTION 2. This act shall become effective November 1, 2024.
