75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section o f law to be codified
77	77	in the Oklahoma Statutes as Section 1-1951.2 of Title 63, unless
78	78	there is created a duplication in numbering , reads as follows:
79	79	A. Not later than November 1, 202 7, the State Commissioner of
80	80	Health shall promulgate rules governing employer -based training
81	81	programs for nurse aides including, but not limited to, rules that
82	82	allow the employment of noncertified nurse aides enrolled in an
83	83	employer-based training program, subject to the conditions allowed
84	84	in such rules.
85	85	B. 1. Until November 1, 2027, an employer-based training
86	86	program for nurse aides shall consist of at least eighty -five (85)

139	139	regulation by the Centers for Medicare and Medicaid Services.
140	140	2. Of the total required hours of training or the equivalent as
141	141	specified in paragraph 1 of this su bsection, the program shall
142	142	include:
143	143	a. at least sixteen (16) hours of supervised practical
144	144	training that is documented and signed by the nurse
145	145	aide trainee,
146	146	b. all of the curriculum specified in 42 C.F.R., Section
147	147	483.152(b), and
148	148	c. pursuant to paragraph 3 of subsection A of Section 1-
149	149	1951 of Title 63 of the Oklahoma Statutes, a minimum
150	150	of ten (10) hours of training in the care o f
151	151	Alzheimer’s patients.
152	152	C. 1. Until November 1, 202 7, an employer-based training
153	153	program for nurse aides shall consist of at least one hundred twenty
154	154	(120) hours of training or t he equivalent if the facility is not
155	155	subject to regulation by the Centers for Medicare and Medicaid
156	156	Services.
157	157	2. Of the total required hours of training or the e quivalent as
158	158	specified in paragraph 1 of this subsection , the program shall

223	223	(1) ethics and ethical conduct,
224	224	(2) social media behavior and priva cy,
225	225	(3) organizational structure of various care provider
226	226	settings,
227	227	(4) trauma-informed care,
228	228	(5) basic legal statuses of residents or patients
229	229	including, but not limited to, guardianship,
230	230	power of attorney, advance directive, and living
231	231	will,
232	232	(6) understanding basic cultural competency and
233	233	religious preferences,
234	234	(7) resident sexuality in car e settings,

296	296	SECTION 2. This act shall become effective November 1, 2024.
