BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section o f law to be codified in the Oklahoma Statutes as Section 1-1951.2 of Title 63, unless there is created a duplication in numbering , reads as follows: A. Not later than November 1, 202 7, the State Commissioner of Health shall promulgate rules governing employer -based training programs for nurse aides including, but not limited to, rules that allow the employment of noncertified nurse aides enrolled in an employer-based training program, subject to the conditions allowed in such rules. B. 1. Until November 1, 2027, an employer-based training program for nurse aides shall consist of at least eighty -five (85) Req. Of the total required hours of training or the equivalent as specified in paragraph 1 of this su bsection, the program shall include: a. at least sixteen (16) hours of supervised practical training that is documented and signed by the nurse aide trainee, b. all of the curriculum specified in 42 C.F.R., Section 483.152(b), and c. pursuant to paragraph 3 of subsection A of Section 1- 1951 of Title 63 of the Oklahoma Statutes, a minimum of ten (10) hours of training in the care o f Alzheimer’s patients. C. 1. Until November 1, 202 7, an employer-based training program for nurse aides shall consist of at least one hundred twenty (120) hours of training or t he equivalent if the facility is not subject to regulation by the Centers for Medicare and Medicaid Services. 2. Of the total required hours of training or the e quivalent as specified in paragraph 1 of this subsection , the program shall include: Req. No. 3132 Page 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 a. at least sixteen (16) hours of supervised practical training that is documented and signed by the nurse aide trainee, b. all of the curriculum specified in 42 C .F.R., Section 483.152(b), c. pursuant to paragraph 3 of subsection A of Section 1- 1951 of Title 63 of the Oklahoma Statutes , a minimum of ten (10) hours of training in the care of Alzheimer’s patients, d. completion of a restorative nurse aide training program, and e. the following subjects: (1) ethics and ethical conduct, (2) social media behavior and priva cy, (3) organizational structure of various care provider settings, (4) trauma-informed care, (5) basic legal statuses of residents or patients including, but not limited to, guardianship, power of attorney, advance directive, and living will, (6) understanding basic cultural competency and religious preferences, (7) resident sexuality in car e settings, Req.
