3864 SECTION 1. AMENDATORY 30 O.S. 2021, Section 1 -114, is
3965 amended to read as follows:

4166 Section 1-114. A. In all cases the court making the
4267 appointment of a guardian has exclusive jurisdiction to control such

4897 B. The court has jurisdiction over guardianship proceedings,
4998 and has the following powers, which must be exercised in the manner
5099 prescribed by statute, to:

52100 1. Appoint and remove guardians for minors and for
53101 incapacitated and partially incapacitated persons;

55102 2. Compel any applicant for guardian for a proposed ward
56103 diagnosed with a neurological condition such as Alzheimer’s disease,
57104 dementia, or other similar developmen tal disability to complete
58105 prerequisite training;
59-
60106 3. Issue and revoke letters of guardianship;
61-
62107 3. 4. Control the conduct of guardians with regard to the care
63108 and treatment provided to their wards;
64-
65109 4. 5. Control the conduct of guardians with regard to th e
66110 management of the financial resources of their wards, including but
67111 not limited to the power to:
68-
69112 a. compel guardians to submit plans, reports, invent ories
70113 and accountings to the court,

72114 b. compel payment and delivery by guardians of property
73115 belonging to their wards,

75116 c. order the payment of debts, the sale of property, and
76117 order and regulate the distribution of property which
77118 has been placed under the c ontrol or management of a

93155 entered ex parte with written notice sent to all parties directing
94156 them to appear before the court, at a time and pla ce therein
95157 specified, not more than twenty (20) days from the time of making
96158 such order, to show cause why the order should not be granted for
97159 temporary guardianship; and

99160 8. 9. Exercise all powers conferred by the Oklahoma
100161 Guardianship and Conservatorship Act, Section 1 -101 et seq. of this
101162 title, and to make such orders as may be necessary for the exercise
102163 of said such powers.

104164 C. The chief judge of each district court shall establi sh by
105165 court rule a system for:

107166 1. The filing of guardianship and conservat orship cases and
108167 records which distinguish them from probate cases; and
109-
110168 2. Monitoring the filing of annual reports and inventories
111169 required by this title for the purpose of assurin g that the court
112170 will be notified of annual reports as they fall due and whether or
113171 not said such reports are filed.

115199 SECTION 2. AMENDATORY 30 O.S. 2021, Section 3 -104, is

118201 Section 3-104. A. The followi ng priorities shall guide the
119202 selection by the court of a guardian or limit ed guardian of an
120203 incapacitated or partially incapacitated person from among those
121204 eligible:

123205 1. The individual or individuals nominated by the subject of
124206 the proceeding pursuant to Section 3-102 of this title;

126207 2. The current guardian or limited guardian appointed or
127208 recognized by the appropriate court of any other jurisdiction in
128209 which the incapacitated or partially incapacitated person resides;

130210 3. An individual nominated by the w ill or by other writing of a
131211 deceased parent, spouse, or an adult child who was serving as the
132212 guardian or limited guardian of the subject of the proceeding;

145218 of the proceeding has been living for more than six (6) months prior
146219 to the filing of the peti tion. Provided, that any owner, operator,
147220 administrator or employee of a f acility subject to the provisi ons of
148221 the Nursing Home Care Act, the Residential Home Care Act or the
149222 Group Homes for the Developmentally Disabled or Physically

150250 Handicapped Persons A ct Persons with Developmental or Physical
151251 Disabilities Act shall not be appointed guardian or limited gua rdian
152252 of a resident of such facility unless the owner, operator,
153253 administrator or employee is the spouse of the resident, or a
154254 relative of the resident within the second degree of consanguinity
155255 and is otherwise eligible for ap pointment; or
156-
157256 9. If applicable, an individual volunteer qualified for
158257 appointment as a guardian of a veteran pursuant to the Veterans
159258 Volunteer Guardianship Act.

161259 B. When the guardian or limited guardian of an incapacitated or
162260 partially incapacitated person is the guardian of property only, the
163261 court may appoint an organization which is eligible to manage the
164262 financial resources of an individual and has fiduciary powers, or
165263 its successor in interest, when:

167264 1. Such organization is nominated by the subject of the
168265 proceeding pursuant to Section 3-102 of this title;
169-
170266 2. Such organization is nominated by a person eligible to make
171267 such nomination pursuant to Section 3 -103 of this title; o r
172-
173268 3. The appointment of such organization is in the best interest
174269 of the subject of the proceeding.

176270 C. The court shall make reasonable inquiry to determine whether
177271 the person or organization proposed to serve as the guardian or

182301 duties and responsibilities of guardian or limited guardian in the
183302 best interest of the ward. For any guardianship for which the court
184303 orders completion of training pursuant to paragraph 2 of subsection
185304 B of Section 1-114 of this title, the court shall require
186305 verification or attestation of completion of prerequisite training
187306 specific to the needs of the ward to be filed in the case or
188307 submitted to the court prior to appointment of the guardian, unless
189308 waived by the court. The court shall also inquire of t he proposed
190309 guardian of the person of the ward as to how the guardian proposes
191310 to provide for the care of the ward, and of the proposed guardian of
192311 the estate of the ward as to how the guardian proposes to manage the
193312 property of the ward and to provide for the ward’s financial care.
194313 The court shall make such orders with respect thereto as the court
195314 deems to be for the best interest of the ward.

197315 D. A public agency shall not be appointed to serve as guardian
198316 for an adult except as provided in Section 1415 o f Title 10 and
199317 Section 10-108 of Title 43A of the Oklahoma Statutes.

201318 SECTION 3. AMENDATORY 30 O.S. 2021, Section 3 -111, is
202319 amended to read as follows:

204320 Section 3-111. A. At the hearing on the petition the court
205321 shall determine whether or not it is necessary to appoint a guardian
206322 of the person, property or both. If a guardian is needed, the court

209351 1. When a general or limited guardian of the person of the
210352 subject of the proceeding is requested, the essential requi rements
211353 for the health and safety of the subject of the proceeding and the
212354 skills and knowledge necessary to meet those requirements;

214355 2. When a general or limited guardian of the property of the
215356 subject of the proceeding is requested, the type and amount of the
216357 financial resources of the subject of the proceeding, the essential
217358 requirements for managing the financial resources and the skills and
218359 knowledge necessary to manage the financial resources;

220360 3. The nature and extent o f the incapacity of the subjec t of
221361 the proceeding, if any; and

225362 4. Whether by clear and convincing evidence the subject of the
226363 proceeding is an incapacitated or partially incapacita ted person.

228364 B. If after a full hearing and examination upon such petition,
229365 the court finds by clear and convincing evidence that the subject of
230366 the proceeding is an incapacitated or partially incapacitated
231367 person, the court shall determine the extent of t he incapacity and
232368 the feasibility of less restrictive alternatives to guard ianship to
233369 meet the needs of the subject of the proceeding. Upon such
234370 determination, the court may:

236371 1. Dismiss the action if the court finds that less restrictive
237372 alternatives to guardianship are feasible and adequate to meet the
238373 needs of the subject of the proceeding; or

240401 2. Appoint a guardian or limited guardian who has completed any
241402 prerequisite training specific to the needs of the ward ordered
242403 pursuant to paragraph 2 of subsec tion B of Section 1-114 of this
243404 title, unless waived by the court . An order making such an
244405 appointment shall include a specific finding that it was established
245406 by clear and convincing evidence that the identified needs of the
246407 subject of the proceeding req uire a guardianship instead of less
247408 restrictive alternatives.

249409 C. Guardianship for an incapacitated perso n shall be:

251410 1. Used only as is necessary to promote and protect the well -
252411 being of the person and his or her property;
253-
254412 2. Designed to encourage the de velopment of maximum self -
255413 reliance and independence of the person; and

257414 3. Ordered only to the extent req uired by the actual mental,
258415 physical and adaptive limitations of the person.

260416 SECTION 4. AMENDATORY 30 O.S. 2021, Section 3 -112, is
261417 amended to read as follows:

263418 Section 3-112. A. Whenever the court finds the subject of the
264419 proceeding to be an incapacitated person the court shall appoint:

273450 B. Whenever the court f inds the subject of the procee ding to be
274451 a partially incapacitated person the court shall appoint, as
275452 necessary and appropriate for said the person:

277453 1. A limited guardian of the pe rson; or

279454 2. A general or a limited guardian of the property of said the
280455 person; or
281-
282456 3. A limited guardia n of the person and a general or limited
283457 guardian of the property of said the person.

285458 C. The court may appoint the same or separate persons to serve
286459 as guardian or limited guardian of the person and guardian or
287460 limited guardian of the property of a ward.

289461 D. Unless waived by the court, any person who is to serve as a
290462 guardian or limited guardian of the person or the property of a ward
291463 whom the court finds to be an incapacitated or partially
292464 incapacitated adult due to a diagnosed neurological condition such
293465 as Alzheimer’s disease, dementia, or other similar developmental
294466 disability shall submit verification or attestation of completion of
295467 prerequisite training. Such training shall be specific to assisting
296468 persons with Alzheimer ’s disease, dementia, or simil ar neurological
297469 conditions including but not limited to understanding Alzheimer ’s
298470 disease, communication techniques, and resources available for care
299471 if the ward is over sixty (60) years of age, or earlier if the
300472 person is diagnosed with such a condition.

304502 must be submitted for approval to the Department prior to
