3839 An Act relating to pesticides; amending 2 O.S. 2021,
3940 Section 3-82, as amended by Section 11, Ch apter 72,
4041 O.S.L. 2023 (2 O.S. Supp. 2023, Section 3 -82), which
4142 relates to applicato r licenses; modifying elements of
4243 aerial license; making language gender neutral; and
4344 providing an effective date.

4849 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
4950 SECTION 1. AMENDATORY 2 O.S. 2021, Section 3 -82, as
5051 amended by Section 11, Chapter 72, O.S.L. 2023 (2 O.S. Supp. 2023,
5152 Section 3-82), is amended to read as follows:
5253 Section 3-82. A. It shall be unlawful for any person to act,
5354 operate, or do business or advertise as a commercial, noncommercial,
5455 certified applicator, temporary certified applicator, service
5556 technician, or private applicator unless the person has obta ined a
5657 valid applicator’s license issued by the State Board of Agriculture
5758 for the category of pestic ide application in which the person is
5859 engaged, unless the person is applying to their his or her own
5960 property.
6061 B. A license may be issued by the Board in any category of
6162 pesticide application if the applicant qualifies and the applicant

8890 is limited to the category of pesticide application named on the
8991 license. The Board may establish categories of pesticide
9092 application as necessary. Licenses shall be issued upon application
9193 to the Board on a form prescribed by the Board. The application
9294 shall contain information regarding the applicant’s qualifications,
9395 proposed operations, and other information as specified by the
9496 Board.
9597 C. 1. An aerial license shall not be issued or be valid unl ess
9698 the applicant files with the Board a copy of a valid document issued
9799 by the Federal Aviation Administration showing that the person is
98100 qualified to operate or supervise the opera tion of an aircraft
99101 conducting agricultural operations and a copy of any other
100102 applicable certification as r equired by the Federal Aviation
101103 Administration for pesticide application . Applicants for an aerial
102104 license and pilots working under a license may be subject to a
103105 complete and thorough background examination.
104106 2. The Board shall promulgate rules regarding aerial
105107 applicators and applications consistent with federal law and shall
106108 solicit the assistance of the Federal Aviation Administration in the
107109 enforcement of this subsection.
108110 D. Each business location shall require a separate license and
109111 separate certified applica tor except that a certified applicator for
110112 a noncommercial busi ness location may also serve as the certified
111113 applicator for one commercial business location.

138141 E. A license shall not be issued for the category of pesticide
139142 application of any applicant or representative who has a temporary
140143 certification.
141144 SECTION 2. This act shall become effective November 1, 2024.
