75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY Section 1, Chapter 11, O.S.L . 2022
77	77	(63 O.S. Supp. 2023, Section 1 -731.4), is amended to read as
78	78	follows:
79	79	Section 1-731.4. A. As used in this section:
80	80	1. The terms “abortion” and “unborn child” shall have the same
81	81	meaning as provided by Section 1 -730 of Title 63 of the Oklahoma
82	82	Statutes this title; and
83	83	2. “Medical emergency” means a condition which cannot be
84	84	remedied by delivery of the child in which an abortion is necessary
85	85	to preserve the life of a pregnant woman w hose life is endangered by
86	86	a physical disorder, p hysical illness or physical injury including a

138	138	life-endangering physical condition caused by or arising from the
139	139	pregnancy itself.
140	140	B. 1. Notwithstanding any other provision of law, a person
141	141	shall not purposely perform or attempt to perform an abortion except
142	142	to save the life of a pregnant woman in a medical emergency. An
143	143	abortion shall not be deemed necessary to preserve the life o f the
144	144	pregnant woman if it is based on a psychological or emotional
145	145	condition or a claim, diagnosis, or determination that the woman may
146	146	engage in conduct which she intends to result in her death.
147	147	2. C. 1. A person convicted of performing or attempting to
148	148	perform an abortion shall be guilty of a felony punishable by a fine
149	149	not to exceed One Hundred Thousand Dollars ($100,000.00), or by
150	150	confinement in the custody of the D epartment of Corrections for a
151	151	term not to exceed ten (10) years, or by such fine and imprisonment.
152	152	3. 2. This section does no t:
153	153	a. authorize the charging or conviction of a wom an with
154	154	any criminal offense in the death of her own unborn
155	155	child, or
156	156	b. prohibit the sale, use, prescription or administration
157	157	of a contraceptive measure, drug or chemical if the
158	158	contraceptive measure, dr ug or chemical is
159	159	administered before the time when a pregnancy could be
160	160	determined through conventional medical testing and if
161	161	the contraceptive measure, drug or chemical is sold,

215	215	4. 3. It is an affirmative defense to prosecution under this
216	216	section if a licensed physician pro vides medical treatment to a
217	217	pregnant woman which results in the accidental or unintentional
218	218	injury or death to the unborn child.
219	219	SECTION 2. It being immediately necessary for the preservation
220	220	of the public peace, health or safety, an emergency is hereby
221	221	declared to exist, by reason wh ereof this act shall take effect and
222	222	be in full force from and after its passage and approval.
