BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 2 -402 of Title 43A, unless there is created a duplicat ion in numbering, reads as follows: A. As used in this section, “emergency opioid antagonist ” means a drug including but not limited to naloxone that blocks the effects of opioids and that is approved by the United States Food and Drug Administration for the treatment of an opioid overdose. The Department of Mental Health and Substance Abuse Services shall have the power and duty to coordinate and oversee the distribution of emergency opioid antagonists by state agencies. C. Any state agency that distributes emergency opioid antagonists, including but not limited to the State Department of Health, shall execute an interagency agreement with the Depa rtment of Mental Health and Substance Abuse Services to coordinate the distribution of emergency opioid a ntagonists. D. Any state agency that distributes emergency opioid antagonists, or any political subdivision that receives an opioid grant award under the Political Subdivisions Opioid Abatement Grants Act to purchase emergency opioid antagonists for distr ibution, shall submit data to the Department of Mental Health and Substance Abuse Services on the agency’s or political subdivision ’s distribution of emergency opioid antagonists including geographic data , data on the entities receiving emergency opioid an tagonists from the agency , and any other data requested by the Department of Mental Health and Substance Abuse Services . E. The Department of Mental H ealth and Substance Abuse Services shall compile an annual report summarizing and analyzing the data submitted by state agencies and political subdivisions under subsection D of this section and its own data on distribution of emergency opioid antagonists during the prior state fiscal year and shall, beginning December 1, 2025, electronically submit the report SB1806 HFLR Page 3 BOLD FACE denotes Committee Amendments. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 to the President Pro Temp ore of the Senate, the Speaker of the House of Representatives, and the Governor no later than December 1 of each year.
