3059 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3260 SECTION 1. AMENDATORY 43A O.S. 2021, Section 1 -110, as
3361 last amended by Section 2, Chapter 28, 1st Extraordinary Session,
3462 O.S.L. 2023 (43A O.S. Supp. 2023, Section 1 -110), is amended to read
3563 as follows:

3764 Section 1-110. A. As an alternative to transport under
3865 subsection B of this section for the sole purpose of initial
3966 assessment of a person who the officer reasonably believes is a
4067 person requiring treatment, as defined in Se ction 1-103 of this

4195 title, sheriffs and peace officers may request an assessment at the
4296 point of initial contact by the Department of Mental Health and
4397 Substance Abuse Services. To conduct the assessment, the Department
4498 may utilize:

4899 1. Telemedicine, when suc h capability is available through a
49100 mobile computing device in the possession of the local law
50101 enforcement agency, to have the person assessed by a l icensed mental
51102 health professional employed by or under contract with a facility
52103 operated by, certified by, or contracted with the Department; or
53-
54104 2. An in-person assessment by a licensed mental health
55105 professional on a mobile crisis response team or who i s employed by
56106 or under contract with a facility operated by, certified by, or
57107 contracted with the Departmen t.

59108 B. 1. To serve the mental health needs of persons of their
60109 jurisdiction, peace officers shall be responsible for transporting
61110 individuals in need of:

63111 a. initial assessment, except when the individual has
64112 been assessed at the point of initial conta ct by the
65113 Department under subsection A of this section, or
66-
67114 b. emergency detention or protective custody under
68115 Section 5-207 of this title, unless the of ficer has
69116 already transported the individual to the facility for
70117 initial assessment,

72145 from the point of init ial contact to the nearest facility, as
73146 defined in Section 1 -103 of this title, that is appropriate for
74147 initial assessment or treatment of the indivi dual within a thirty -
75148 mile radius of the peace officer ’s operational headquarters.

77149 2. Transportation to the nearest appropriate facility shall be
78150 completed by either the Department of Mental Health and Substance
79151 Abuse Services or an entity contracted by th e Department for
80152 alternative transportation if:

82153 a. there is not an appropriate facility within a thirty -
83154 mile radius of the peace officer ’s operational
84155 headquarters, or
85-
86156 b. the officer has already transported the individual to
87157 an appropriate facility for ini tial assessment.

91158 3. For purposes of this section, “initial contact” is defined
92159 as contact with an indi vidual in need of assessment, emergency
93160 detention, or protective custody made by a law enforcement officer.
94161 Initial contact in this section does not inc lude an individual self -
95162 presenting at a facility as defined in Section 1 -103 of this title.

97163 4. When an individual self-presents at a facility as defined in
98164 Section 1-103 of this title or at a medical facility and is placed
99165 into protective custody under Se ction 5-207 of this title due to a
100166 determination that the individual is a person requiring treatment as
101167 defined in Section 1-103 of this title, and if transport to another
102168 facility is needed for initial assessment or treatment, the person

103196 shall be transported to the nearest appropriate facility as provided
104197 by this subsection by the Department or an entity contracted by the
105198 Department for alternative transportation .

107199 5. When an individual self -presents at a facility as defined in
108200 Section 1-103 of this title or at a medical facility and is not
109201 placed into protective custody under Section 5 -207 of this title,
110202 but consents to voluntary transport to a facility as defined in
111203 Section 1-103 of this title for treatment, transport or the
112204 arrangement of transport shall be the responsibility of the facility
113205 receiving the individual, unless the individual chooses to arrange
114206 his or her own transportation.

116207 6. The transportation requirements provided by this subsection,
117208 to the extent such requirements are applicable to peac e officers,
118209 shall be considered fulfilled once the person has been transported
119210 to the facility, the off icer has made contact with the appropriate
120211 staff of the facility, and the staff of the facility have determined
121212 that the patient does not present a clear or immediate threat to his
122213 or her own safety or to the safety of the staff of the facility.
123214 Once custody of the individual has been transferred to the
124215 appropriate facility staff, the peace officer shall not be required
125216 to remain at the facility with the individual pending initial
126217 assessment or treatment.

128218 C. A municipal law enforcement agency shall be res ponsible for
129219 transportation as provided in this section for any individual found

130247 within such municipality ’s jurisdiction. The county sheriff shall
131248 be responsible for transportation as provided in this section for

134249 any individual found outside of a municipality ’s jurisdiction, but
135250 within the county.

137251 D. Once an individual has been presented to an appropriate
138252 facility as provided in subsection B of this sect ion, the Department
139253 of Mental Health and Substance Abuse Services or an entity
140254 contracted by the Depart ment shall be responsible for any subsequent
141255 transportation of such individual.

143256 E. Sheriffs and peace officers shall be entitled to
144257 reimbursement from t he Department of Mental Health and Substance
145258 Abuse Services for transportation services associated with min ors or
146259 adults requiring initial assessment, emergency detention, protective
147260 custody, and inpatient services.

149261 F. Any transportation provided by a she riff or deputy sheriff
150262 or a peace officer on behalf of any county, city, town, or
151263 municipality of this state, to or from any facility for the purpose
152264 of initial assessment, admission, interfacility transfer, medical
153265 treatment, or court appearance shall be reimbursed in accordance
154266 with the provisions of the State Travel Reimbursement Act.

156267 G. Nothing in this sec tion shall prohibit a law enforcement
157268 agency or the Department of Mental Health and Substance Abuse
158269 Services from entering into a lawful agreement wi th any other law
159270 enforcement agency to fulfill the requirements established by this

160298 section or from contracting with a third party to provide the
161299 services established by this section, provided the third party meets
162300 minimum standards as determined by the De partment.

164301 H. A law enforcement agency shall not be liable for the actions
165302 of a peace officer commissioned by the agency when such officer is
166303 providing services as a third party pursuant to subsection G of this
167304 section outside his or her primary employment as a peace officer.

169305 I. 1. For purposes of transportation completed by the
170306 Department of Mental Healt h and Substance Abuse Services or an
171307 entity contracted by the Department as required by this section, the
172308 use of mechanical restraints shall not be appli ed to an individual
173309 being transported unless:

177310 a. the individual being transported physically assaults
178311 or attempts to physically assault the person lawfully
179312 conducting the transportation of the individual
180313 pursuant to the provisions of this section and the
181314 person lawfully conducting the transportation believes
182315 such restraints are necessary for the safety of
183316 himself or herself or the protection of others,

185317 b. the individual being transported attempts or causes
186318 serious physical injury to self and the person
187319 lawfully conducting the transportation believes such
188320 restraints are necessary for the safety of the
189321 individual being transported, or

191349 c. the individual being transported has a propensity
192350 toward violence as indicated by past transports,
193351 criminal charges, or ment al health history and as
194352 identified in the transport request form, and the
195353 person lawfully conducting t he transportation believes
196354 such restraints are necessary for the safety of
197355 himself or herself, for the safety of the individual
198356 being transported, or for the protection of others.

200357 2. The mechanical restraint shall be continued for no longer
201358 than is necessary under the circumstances described in paragraph 1
202359 of this subsection. Every use of a mechanical restraint, the
203360 reasons, and the length of time, shall be made a part of the
204361 clinical record of the consumer under the signature of the
205362 individual responsibl e for the transportation as required by this
206363 section.
