77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 57 O.S. 2021, Section 582, is
79	79	amended to read as follows:
80	80	Section 582. A. The provisions of the Sex Offenders
81	81	Registration Act shall apply to any perso n residing, working or
82	82	attending school within the State of Oklahoma this state who, after
83	83	November 1, 1989, has been convicted, whether upon a verdict or plea
84	84	of guilty or upon a plea of nolo contendere, o r received a suspended
85	85	sentence or any probationar y term, or is currently serving a
86	86	sentence or any form of probation or parole f or a crime or an
87	87	attempt to commit a crime provided for in Section 843.5 of Title 21
88	88	of the Oklahoma Statut es if the offense involved sexual abuse or

150	150	the offense involved child prostitution, 1040.8, if the offense
151	151	involved child porno graphy, 1040.12a, 1040.13, 1040.13a, 1087, 1088,
152	152	1111.1, 1114 or 1123 of Title 21 of the Oklahoma Statutes.
153	153	B. The provisions of the Sex Offenders Registration Act shall
154	154	apply to any person who after November 1, 1989, resides, works or
155	155	attends school within the State of Oklahoma this state and who has
156	156	been convicted or received a suspended sentence at any time in any
157	157	court of another sta te, the District of Columbia, Puerto Rico, Guam,
158	158	American Samoa, the Northern Mariana Islands and the United States
159	159	Virgin Islands, a federal court, an Indian tribal court , a military
160	160	court, or a court of a foreign country for a crime, atte mpted crime
161	161	or a conspiracy to commit a crime which, if committed or attempt ed
162	162	in this state, would be a crime, an attempt to commit a crime or a

215	215	in subsection A of this section.
216	216	C. The provisions of the Sex Offenders Registration Act shal l
217	217	apply to any person who resides, works or attends school within the
218	218	State of Oklahoma this state and who has received a deferred
219	219	judgment at any time in any court of another state, the District of
220	220	Columbia, Puerto Rico, Guam, American Samoa, the Northern Mariana
221	221	Islands and the United Sta tes Virgin Islands, a federal court, an
222	222	Indian tribal court, a military court, or a court of a forei gn
223	223	country for a crime, attempted crime or a conspiracy to commit a
224	224	crime which, if committed or attempted or conspired to be commit ted
225	225	in this state, would be a crime, an attempt to commit a crime or a
226	226	conspiracy to commit a crime provided for in Section 843.5 of Title
227	227	21 of the Oklahoma Statutes if the offense involved sexual abuse or
228	228	sexual exploitation as those terms are defined in Section 1 -1-105 of
229	229	Title 10A of the Oklahoma Statutes, Section 681, if the offense
230	230	involved sexual assault, 741, if the off ense involved sexual abuse
231	231	or sexual exploitation, Section 748, if the offense involved human
232	232	trafficking for commercial sex, Sectio n 843.1, if the offense
233	233	involved sexual abuse or sexual exploitation, Sect ion 852.1, if the
234	234	offense involved sexual abuse of a child, 856, if the offense
235	235	involved child prostitution or human trafficking for commercial sex,
236	236	865 et seq., 885, 886, 888, 891, if the offense involved sexual
237	237	abuse or sexual exploitation, 1021, 1021.2, 1021.3, 1024.2, 1029, if

289	289	the offense involved chi ld prostitution, 1040.8, if the offense
290	290	involved child pornography, 1040.12a, 1040.13, 1040.13a, 1087, 1088,
291	291	1111.1, 1114 or 1123 of Title 21 of the Oklahoma Statutes. The
292	292	provisions of the Sex Offenders R egistration Act shall not apply to
293	293	any such person while the person is incarcerated in a maximum or
294	294	medium correctional instituti on of the Department of Corrections.
295	295	D. On November 1, 2002, any person regi stered as a sex offender
296	296	pursuant to Section 741 of Title 21 of the Oklahoma Statutes shall
297	297	be summarily removed from the Sex Offender Registry sex offender
298	298	registry by the Department of Corrections and all law enforce ment
299	299	agencies of any political subdi vision of this state, unless the
300	300	offense involved sexual abuse or sexual exploitation.
301	301	E. The provisions of the Sex Offenders Registration Act shall
302	302	not apply to any such person wh o has received a crimin al history
303	303	records expungement for a conviction in another state for a crime or
304	304	attempted crime which, if committed or attempted in this state,
305	305	would be a crime or an attempt to commit a crime provided for in any
306	306	laws listed in subsection A of this section.
307	307	F. The provisions of the Sex Offenders Registrati on Act shall
308	308	apply to any person residing, working o r attending school within
309	309	this state who, after the effective date of this act November 1,
310	310	2020, has been convicted, whether upon a verdict or plea of guilty
311	311	or upon a plea of nolo contendere, or received a suspended sentence
312	312	or any probationary term, or is currently serving a sentence or any

366	366	21 of the Oklahoma Statutes.
367	367	G. The provisions of the Sex Offenders Registration Act shall
368	368	apply to any person who resides, works or a ttends school within this
369	369	state and who has received a deferred judgment at any time in any
370	370	court of another state, the District of Columbia, Puerto Rico, Guam,
371	371	American Samoa, the Northern Maria na Islands and the United States
372	372	Virgin Islands, a federal co urt, an Indian tribal court, a military
373	373	court, or a court of a foreign country for a crime, if committed in
374	374	this state, would be a crim e, as provided for in subsection F o f
375	375	Section 1040.13b of Title 21 of t he Oklahoma Statutes. The
376	376	provisions of the Sex O ffenders Registration Act shall not apply to
377	377	any such person while the person i s incarcerated in a maximum or
378	378	medium correctional institution in the custody of the Department of
379	379	Corrections.
380	380	H. Any person who has been convicted, whether upon a v erdict or
381	381	plea of guilty or upon a plea of nolo contendere, or received a
382	382	suspended sentence or any probationary term or parole for a crime
383	383	which requires him or her to register as a sex of fender pursuant to
384	384	the terms of the Sex Offenders Registration Act shall not enter into
385	385	a plea agreement whereby the offender shall be allowed to forgo
386	386	registering as a sex offender.

438	438	I. The sealing of a criminal record or other acti on that limits
439	439	the publicity or availability of conviction information shall not
440	440	remove the requirement of an individual to register as a sex
441	441	offender pursuant to the provisions of the S ex Offenders
442	442	Registration Act.
443	443	SECTION 2. NEW LAW A new section of law to be codified
444	444	in the Oklahoma Statutes as Section 590.3 of Title 57, unless there
445	445	is created a duplication in numbering, reads as follows:
446	446	A person required to register under the provisions of the Sex
447	447	Offenders Registration Act shall not be allowed to have any contact
448	448	with a person under the age of eighteen (18) years, including the
449	449	child of such offender .
450	450	SECTION 3. This act shall become effective November 1, 2024.
