5657 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5758 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1137.1, as
5859 last amended by Section 1, Chapter 262, O.S.L. 2023 (47 O.S. Supp.
5960 2023, Section 1137.1), is amended to read as follows:
6061 Section 1137.1. A. Except for vehicles, t ravel trailers, or
6162 commercial trailers which display a current Oklahoma license tag,
6263 upon the purchase or transfer of ownership of a used motor vehicle,
6364 travel trailer, or commercial trailer, includin g an out-of-state
6465 purchase or transfer of the same, to a licensed used motor vehicle
6566 dealer, wholesale used motor vehicle dealer, used travel trailer

9294 dealer, or used commercial trailer dealer, subsequently referred to
9395 in this section as “dealer”, the dealer shall affix a used de aler’s
9496 plate visible from the rea r of the vehicle, travel trailer , or
9597 commercial trailer. Such license plate shall expire on December 31
9698 of each year. When the vehicle, travel trailer , or commercial
9799 trailer is parked on the dealer ’s licensed place of business, it
98100 shall not be required to have a license plate of any kind affixed.
99101 A dealer shall obtain from Service Oklahoma at a cost of Ten Dollars
100102 ($10.00) a dealer license plate for demonstrating, transporting , or
101103 any other normal business of a dealer inc luding use by an individual
102104 holding a valid salesperson ’s license issued by the Oklahoma Used
103105 Motor Vehicle and Parts, Dismantler, and Manufactured Housing
104106 Commission. Any dealer who operates a wrecker or towing service
105107 licensed pursuant to Sections 951 through 957 of this title shall
106108 register each wrecker vehicle and display a wrecker license plate on
107109 each vehicle as required by Secti on 1134.3 of this title. A dealer
108110 may obtain as many additional license plates as may be desired up on
109111 the payment of Ten Dollars ($10.00) for each addition al license
110112 plate. Use of the used dealer license plate by a licensed dealer
111113 for other than the purposes as set forth herein shall co nstitute
112114 grounds for revocation of the dealer ’s license. Service O klahoma
113115 shall design the official used dealer license plate to include the
114116 used dealer’s license number issued to him or her each year by

142145 Dismantler, and Manufactured Housing Commission.
143146 B. Upon the purchase or transfer of ownership of an out -of-
144147 state used motor vehicle, travel trailer , or commercial trailer to a
145148 licensed dealer, the dealer shall make application for an Oklahoma
146149 certificate of title pursuant to the Oklahoma Vehicle License and
147150 Registration Act, Section 1101 et seq. of this title. Upon receipt
148151 of the Oklahoma certificate of title, the dealer shall follow the
149152 procedure as set forth in subsection A of this section. Provided,
150153 nothing in this title shall be construed as req uiring a dealer to
151154 register a used motor vehicle, travel trailer , or commercial trailer
152155 purchased in another state which will not be operated or sold in
153156 this state.
154157 C. Upon sale or transfer of ownership of the used motor vehicle
155158 or travel trailer, the dealer shal l place upon the reassignment
156159 portion of the certificate of title a tax stamp issued by the county
157160 treasurer of the county in which the dealer has his or he r primary
158161 place of business. The tax stamp shall be issued upon payment of a
159162 fee of Three Dollars and fifty cents ($3.50) and shall be in lieu of
160163 the dealer’s ad valorem tax on the inventories of used motor
161164 vehicles or travel trailers but shall not relieve any other property
162165 of the dealer from ad valorem taxation.
163166 D. Upon sale of a used motor vehicle o r travel trailer to
164167 another licensed dealer, the selling dealer shall place the tax

191195 stamp required in subsection C of this section upon the certificate
192196 of title. The used dealer license plate or wholesale dealer license
193197 plate shall be removed by t he selling dealer. The purchasing dealer
194198 shall, at time of purc hase, place his or her dealer license plate on
195199 the used motor vehicle, travel trailer , or commercial trailer as
196200 provided in subsection A of this section; provided, for vehicles,
197201 travel trailers, or commercial trailers purchased by a licensed used
198202 dealer at an auction, in lieu of such placement of the dealer
199203 license plate, the auction may provide temporar y documentation as
200204 approved by the Director of the Motor Vehicle Division of Service
201205 Oklahoma for the purpose of transporting such vehicle to the
202206 purchaser’s point of destination. Such temporary documentation
203207 shall be valid for two (2) days following the date of sale.
204208 E. The purchaser of every used motor vehicle, travel trailer ,
205209 or commercial trailer, except as otherwise provided by law, shall
206210 obtain registration and title for the vehicle or trailer within two
207211 (2) months from the date of purchase of same. It shall be the
208212 responsibility of the selling dealer to place a temporary license
209213 plate, in size similar to the permanent Oklahoma license plate but
210214 of a weatherproof plastic -impregnated substance approved by the
211215 Oklahoma Used Motor Vehicle and Parts, Dismantler, and Manufactured
212216 Housing Commission, upon a used motor vehicle, travel trailer , or
213217 commercial trailer when a transaction is completed for the sale of
214218 said such vehicle. The temporary license plate under this

241246 subsection shall be placed at the location provided for the
242247 permanent motor vehicle license plate. The temporary license plate
243248 shall show the license number which is issued to the dealer each
244249 year by Service Oklahoma or the Used Motor Vehicle and Parts
245250 Commission, the date the used motor vehicle, travel trailer , or
246251 commercial trailer was purchased and the company name of the sel ling
247252 dealer information required pursuant to Section 4 of this act . The
248253 Oklahoma Used Motor Vehicle and Parts, Dismantler, and Manufactured
249254 Housing Commission is hereby directed to develop the temporary
250255 license plate design to incorporate these such requirements in a
251256 manner that will permit law enforcement personnel to r eadily
252257 identify the dealer license number and date of the vehicle purchase .
253258 The Oklahoma Used Motor Vehicle and Parts, Dismantler, and
254259 Manufactured Housing Commission is hereby authorized to develop
255260 additional requirements and parameters as deemed appropriate to
256261 discourage or prevent illegal duplication and use of the temporary
257262 license plate. Such temporary license plate shall be valid for a
258263 period of two (2) months from the d ate of purchase. Use of the
259264 temporary license by a dealer for other than the pu rposes set forth
260265 herein shall constitute grounds for revocation of the dealer ’s
261266 license to conduct business. Purchasers of a commercial trailer
262267 shall affix the tempora ry license plate to t he rear of the
263268 commercial trailer. The purchaser shall display the temporary

290296 license plate for a period not to exceed two (2) months or until
291297 registration and title are obtained as provided in this section.
292298 The provisions of this subsection o n temporary licenses sha ll
293299 apply to nonresidents who purchase a used motor vehic le, travel
294300 trailer, or commercial trailer within this state that is to be
295301 licensed in another state. The nonresident purchaser shall be
296302 allowed to operate the vehicle or trailer within the state with a
297303 temporary license plate for a period not to exceed two (2) months
298304 from date of purchase. Any nonresident purchaser found to be
299305 operating a used motor vehicle, travel trailer , or commercial
300306 trailer within this state after two (2) months shall be subject to
301307 the registration fees of this state upon the same te rms and
302308 conditions applying to residents of this state.
303309 F. It shall be unlawf ul for any dealer to procure the
304310 registration and licensing of any used motor vehicle, tra vel
305311 trailer, or commercial trailer sold by the dealer or to act as the
306312 agent for the purchaser in the procurement of the registration and
307313 licensing of the purchaser ’s used vehicle, travel trailer , or
308314 commercial trailer. A license of any dealer violating the provi sion
309315 of this section may be revoked.
310316 G. Dealers following the procedure set for th herein shall not
311317 be required to register vehicles, travel trailers , or commercial
312318 trailers to which this section applies, nor will the registration
313319 fee otherwise required be assessed. P rovided, dealers shall not

340347 purchase or trade for a used motor vehicle, travel tra iler, or
341348 commercial trailer on which the registration therefor has been
342349 expired for a period exceeding two (2) months without obtaining
343350 current registration there for.
344351 H. A nonprofit charitable organization which is exempt from
345352 taxation pursuant to the provisions of the Internal Revenue Code, 26
346353 U.S.C., Section 501(c)(3), and which accepts donations of used motor
347354 vehicles previously titled in Oklahoma to be subsequently
348355 transferred to another owner, upon the qualifying organization
349356 providing sufficient docu mentation of its tax-exempt status, may
350357 obtain from Service Okl ahoma charitable nonprofit organization
351358 license plates for demonstrating, transporting , or test-driving
352359 donated vehicles, provided that no organization shall possess or use
353360 at any one time more than eight such plates. Service Oklahoma shall
354361 design distinctive license plates for that purpose. The cost for
355362 said such plates shall be the same as provid ed in subsection A of
356363 this section for dealer plates.
357364 I. The transfer of ownership from the vehicle donor to the
358365 qualifying nonprofit organization described in subs ection H of this
359366 section shall be made without the payment of motor vehicle excise
360367 tax levied pursuant to Section 2103 of Title 68 of the Oklahoma
361368 Statutes.

388396 SECTION 2. AMENDATORY 47 O.S. 2021, Section 1137.2, as
389397 amended by Section 171, Chapter 282, O.S.L. 2022 (47 O.S. Supp.
390398 2023, Section 1137.2), is amended to read as follows:
391399 Section 1137.2. Service Oklahoma The Oklahoma Motor Vehicle
392400 Commission and the Oklahoma Used Motor Vehicle, Dismantler, and
393401 Manufactured Housing Commission shall have the sole authority to
394402 grant the power to issue the dealer license plate specified in
395403 subsection A of Section 1137.1 of this title to authorized temporary
396404 license plate vendors, pursuant to the provisions of Section 4 of
397405 this act.
398406 SECTION 3. AMENDATORY 47 O.S. 2021, Section 1137.3, as
399407 last amended by Section 2, Chapter 262, O.S.L. 2023 (47 O.S. Supp.
400408 2023, Section 1137.3), is amended to read as follows:

402410 travel trailer, or commercial trailer shall register or license the
403411 same within two (2) months from the date of purchase. It shall be

439448 truck may place the temporary license plate under this section in
440449 the rear window. Said Such temporary license plate shall show the
441450 dealer’s license number which is issued to him or her each year by
442451 Service Oklahoma, the date the new motor vehicle, travel trailer or
443452 commercial trailer was purchased and the company name of the selling
444453 dealer information required pursuant to Section 4 of this act. The
445454 Oklahoma Motor Vehicle Commission is hereby directed to develop a
446455 temporary license plate design to incorporate these requirements in
447456 a manner that will permit law enforcement personnel to readily
448457 identify the dealer license number and date of the vehicle purchase.
449458 The Oklahoma Motor Vehicle Commission is further authorized to
450459 develop additional requirements and parameters designed to
451460 discourage or prevent illegal duplication and use of the temporary
452461 license plate. On or before two (2) months from the date of
453462 purchase of a new motor vehicle, travel trailer, or commercial
454463 trailer, said such temporary license plate shall be removed and
455464 replaced with a permanent, current Oklahoma license plate. Use of
456465 said such temporary license plate by a licensed dealer for other
457466 than the purpose of normally doing business shall constitute grounds
458467 for revocation of the dealer’s license.
459468 It shall be unlawful for any licensed dealer of new motor
460469 vehicles, travel trailers, or commercial trailers to procure the
461470 registration and licensing of any new motor vehicle, travel trailer,

488498 or commercial trailer sold by such licensed dealer or to act as the
489499 agent for such purchaser in the procurement of said such
490500 registration and licensing. The license of any licensed dealer of
491501 new motor vehicles, travel trailers, or commercial trailers
492502 violating the provisions of this section shall be revoked.
493503 SECTION 4. NEW LAW A new section o f law to be codified
494504 in the Oklahoma Statutes as Sect ion 1137.4 of Title 47, unless there
495505 is created a duplicati on in numbering, reads as follows:
496506 A. The Oklahoma Motor Vehicle Commission and the Oklahoma Used
497507 Motor Vehicle, Dismantler, and Manufactured Housing Commission shall
498508 have the power and duty to promulgate rules and procedures to
499509 designate and register authorized temporary license plate vendors in
500510 this state. Such vendors shall:
501511 1. Provide pre-printed temporary license plates to dealers
502512 licensed by the Oklahoma Motor Vehicle Commission and the Oklahoma
503513 Used Motor Vehicle, Dismantler, and Manufactured Hous ing Commission;
504514 2. Provide a method for such dealers to electronically enter
505515 required purchaser information for each vehicle purchase; and
506516 3. Electronically submit such required purchaser information to
507517 Service Oklahoma every twenty-four (24) hours in a format that is
508518 readily accessible by Service Ok lahoma.
509519 The commissions shall also be granted the power to administer
510520 fines and penalties to auth orized temporary license plate vend ors
511521 that fail to comply with the provisions of this s ection.

538549 B. Temporary license plates issued by authorized temporary
539550 license plate vendors shall be required to include :
540551 1. A sequential two-character prefix, unique to the individual
541552 authorized temporary license plate vendor, followed by a five-digit
542553 tag number;
543554 2. The name of this state;
544555 3. The name of the vehicle purchaser;
545556 4. The address of such purchaser;
546557 5. The date of sale;
547558 6. The name of the dealer and the dealer license number; and
548559 7. The year, make, model, and color of the vehicle.
549560 SECTION 5. This act shall become effective November 1, 2024.
