AS INTRODUCED 
 
An Act relating to counties; defining term; limiting 
federal and state ownership of county land; requiring 
state agencies to sell land if over the established 
limit; providing for negotiations between state 
agencies and counties; providing for co dification; 
and providing an effective date . 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STA TE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Sectio n 945 of Title 19, unless there is 
created a duplication in number ing, reads as follows: 
A.  As used in this section , “military reservations ” means a 
military installation, armo ry, air base, or other facility owned or 
controlled by this state or the federal government for military 
purposes. 
B.  No more than fifteen percent (15%) of the total land area 
within a county of this state shall be owned by an agency or entity 
of this state or the federal government. Military reservations and 
Indian lands shall not be used to determine the p ercentage of the 
total land area within a county of this state .

C. If an agency or entity of this state or the federal 
government, or a combination thereof, owns more than fifteen percent 
(15%) of the total land area within a county of this state at the 
time of the effective date of this section, the agency or entity of 
this state shall have ten (10) years from the effective date of this 
section to sell, transfer, trade, or otherwise dispose of land in 
order to reach the fifteen-percent limit established in this 
section. 
D.  If more than one agency or entity of this state owns land 
that in total, alongside land owned by an agency or entity of the 
federal government, is more than fifteen percent (15%) of the total 
land area within a county of this state, the affected agencies or 
entities of this state shall enter into negotiations with the other 
affected agencies or e ntities, as well as the county commissioners 
of such county, to determine how to sell, transfer, trade, or 
otherwise dispose of owned land in order to achieve the fifteen-
percent limit established in this section. 
SECTION 2.  This act shall become effective November 1, 2024.
