7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 62 of Title 22, unless there is
8080 created a duplication in numbering, reads as follows:
8181 A. Upon a motion filed by a person granted a protective order
8282 under the Protection from Domestic Abuse Act , Section 60 et seq. of
8383 Title 22 of the Oklahoma Statutes, the court may determine a
8484 plaintiff to be a vexatious litigant.
8585 B. To be considered a vexatious litigant, the plaintiff must:
8686 1. Be the subject of a protective order granted to the person
8787 filing the motion; and

139139 2. Have commenced, prosecuted, or maintained one or more civil
140140 court cases against the person protected by the protective order in
141141 any court or jurisdiction that are determined to be frivolous and
142142 caused the person protected by the order to be harassed or
143143 intimidated.
144144 C. Upon an order determining a plaintiff to be a vexatious
145145 litigant, he or she shall seek leave from the chief presiding judge
146146 of the district court for approval to file a n action against a
147147 person granted a protect ive order. The plaintiff shall show there
148148 is a reasonable probability that he or she will prevail in a claim.
149149 D. A person in violation of this section may be held in
150150 contempt and sanctioned by the court . In addition to any sanctions
151151 assessed by the court, the person shall be liable to the opposing
152152 party for court costs and reasonable attorney fees.
153153 SECTION 2. This act shall become effective November 1, 2024.
