AS INTRODUCED 
 
An Act relating to the Protection from Domestic Abuse 
Act; authorizing court to make certain determination; 
establishing requirements for certain determination ; 
requiring request for approval to file certain 
action; authorizing sanctions for certain purpose; 
authorizing award of certain costs and fees; 
providing for codification; and providing an 
effective date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW    A new section of law to be codified 
in the Oklahoma Statutes as Section 62 of Title 22, unless there is 
created a duplication in numbering, reads as follows: 
A. Upon a motion filed by a person granted a protective order 
under the Protection from Domestic Abuse Act , Section 60 et seq. of 
Title 22 of the Oklahoma Statutes, the court may determine a 
plaintiff to be a vexatious litigant. 
B.  To be considered a vexatious litigant, the plaintiff must: 
1.  Be the subject of a protective order granted to the person 
filing the motion; and

2.  Have commenced, prosecuted, or maintained one or more civil 
court cases against the person protected by the protective order in 
any court or jurisdiction that are determined to be frivolous and 
caused the person protected by the order to be harassed or 
intimidated. 
C.  Upon an order determining a plaintiff to be a vexatious 
litigant, he or she shall seek leave from the chief presiding judge 
of the district court for approval to file a n action against a 
person granted a protect ive order.  The plaintiff shall show there 
is a reasonable probability that he or she will prevail in a claim. 
D.  A person in violation of this section may be held in 
contempt and sanctioned by the court .  In addition to any sanctions 
assessed by the court, the person shall be liable to the opposing 
party for court costs and reasonable attorney fees. 
SECTION 2.  This act shall become effective November 1, 2024.
