6565 An Act relating to agricultural land; prohibiting

7979 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 11-101 of Title 2, unless there
8282 is created a duplication in numbering, reads as follows:
8383 A. No alien or any person who is not a citizen of the United
8484 States shall lease agricultural land in this state either directly
8585 or indirectly through a business en tity or trust, except as
8686 hereinafter provided . Provided, however, the requirements of this
8787 subsection shall not apply to a busin ess entity that is engaged in
8888 regulated interstate commerce in accordance with federal law.

140140 B. On or after the effective date of this act, any lease for
141141 agricultural land shall include as an exhibit to the lease an
142142 affidavit executed by the person or entity leasing the land
143143 attesting that the person, business entity, or trust is leasing the
144144 land in compliance with the requirement s of this section and that no
145145 funding source is be ing used in violation of this section or any
146146 other state or federal law. The Attorney General shall promulgate a
147147 separate affidavit form for individuals and for business entities or
148148 trusts to comply with the requirements of this section, with the
149149 exception of those leases which the Attorney Gener al deems necessary
150150 when promulgating the affidavit form.
151151 C. Any lease found to be in violation of this section shall
152152 immediately be null and void and all rights to the leased
153153 agricultural land shall immediately re vert back to the lessor.
154154 D. This section shall not apply to leases of agricult ural land
155155 to aliens who are or shall take up bona fide residence in this
156156 state, and any alien who is or shall become a bona fide resident of
157157 this state shall have the right to l ease agricultural lands in this
158158 state upon the same terms as citizens of the United States who
159159 reside in this state during the continuance of such bona fide
160160 residence of such alien in this state. Provided, that if such
161161 resident alien shall cease to be a b ona fide inhabitant of th is
162162 state, such lease for agricultural land shall be im mediately null

216216 E. For the purposes of this section, “agricultural land” means
217217 any real property that is used in the production of plants, fruits,
218218 wood, or farm or ranch animals to be sold off the premises.
