79	79	BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A new section of law to be codified
81	81	in the Oklahoma Statutes as Section 11-101 of Title 2, unless there
82	82	is created a duplication in numbering, reads as follows:
83	83	A. No alien or any person who is not a citizen of the United
84	84	States shall lease agricultural land in this state either directly
85	85	or indirectly through a business en tity or trust, except as
86	86	hereinafter provided . Provided, however, the requirements of this
87	87	subsection shall not apply to a busin ess entity that is engaged in
88	88	regulated interstate commerce in accordance with federal law.

140	140	B. On or after the effective date of this act, any lease for
141	141	agricultural land shall include as an exhibit to the lease an
142	142	affidavit executed by the person or entity leasing the land
143	143	attesting that the person, business entity, or trust is leasing the
144	144	land in compliance with the requirement s of this section and that no
145	145	funding source is be ing used in violation of this section or any
146	146	other state or federal law. The Attorney General shall promulgate a
147	147	separate affidavit form for individuals and for business entities or
148	148	trusts to comply with the requirements of this section, with the
149	149	exception of those leases which the Attorney Gener al deems necessary
150	150	when promulgating the affidavit form.
151	151	C. Any lease found to be in violation of this section shall
152	152	immediately be null and void and all rights to the leased
153	153	agricultural land shall immediately re vert back to the lessor.
154	154	D. This section shall not apply to leases of agricult ural land
155	155	to aliens who are or shall take up bona fide residence in this
156	156	state, and any alien who is or shall become a bona fide resident of
157	157	this state shall have the right to l ease agricultural lands in this
158	158	state upon the same terms as citizens of the United States who
159	159	reside in this state during the continuance of such bona fide
160	160	residence of such alien in this state. Provided, that if such
161	161	resident alien shall cease to be a b ona fide inhabitant of th is
162	162	state, such lease for agricultural land shall be im mediately null

215	215	immediately revert back to the lessor.
216	216	E. For the purposes of this section, “agricultural land” means
217	217	any real property that is used in the production of plants, fruits,
218	218	wood, or farm or ranch animals to be sold off the premises.
219	219	SECTION 2. This act shall become effective November 1, 2024.
