AS INTRODUCED 
 
An Act relating to agricultural land; prohibiting 
leasing of agricultural land by certain persons; 
providing exception; r equiring certain affidavit as 
an attachment to lease; requiring promulgation of 
certain form by Attorney General; requiring reversion 
of leased land under certain circumstances; providing 
exception to certain requirements; defining term; 
providing for codification; and pr oviding an 
effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 11-101 of Title 2, unless there 
is created a duplication in numbering, reads as follows: 
A.  No alien or any person who is not a citizen of the United 
States shall lease agricultural land in this state either directly 
or indirectly through a business en tity or trust, except as 
hereinafter provided .  Provided, however, the requirements of this 
subsection shall not apply to a busin ess entity that is engaged in 
regulated interstate commerce in accordance with federal law.

B.  On or after the effective date of this act, any lease for 
agricultural land shall include as an exhibit to the lease an 
affidavit executed by the person or entity leasing the land 
attesting that the person, business entity, or trust is leasing the 
land in compliance with the requirement s of this section and that no 
funding source is be ing used in violation of this section or any 
other state or federal law. The Attorney General shall promulgate a 
separate affidavit form for individuals and for business entities or 
trusts to comply with the requirements of this section, with the 
exception of those leases which the Attorney Gener al deems necessary 
when promulgating the affidavit form. 
C.  Any lease found to be in violation of this section shall 
immediately be null and void and all rights to the leased 
agricultural land shall immediately re vert back to the lessor. 
D.  This section shall not apply to leases of agricult ural land 
to aliens who are or shall take up bona fide residence in this 
state, and any alien who is or shall become a bona fide resident of 
this state shall have the right to l ease agricultural lands in this 
state upon the same terms as citizens of the United States who 
reside in this state during the continuance of such bona fide 
residence of such alien in this state. Provided, that if such 
resident alien shall cease to be a b ona fide inhabitant of th is 
state, such lease for agricultural land shall be im mediately null

and void and all rights to the leased agricultural land shall 
immediately revert back to the lessor. 
E.  For the purposes of this section, “agricultural land” means 
any real property that is used in the production of plants, fruits, 
wood, or farm or ranch animals to be sold off the premises. 
SECTION 2.  This act shall become effective November 1, 2024.
