114190 SECTION 1. AMENDATORY 63 O.S. 2021, Sec tion 420, as last
115191 amended by Section 1, Chapter 584, O.S.L. 2021 (63 O.S. Supp. 2023,
116192 Section 420), is amended to read as follows:

118193 Section 420. A. A person in possession of a state -issued
119194 medical marijuana patient license shall be able to:

121195 1. Consume marijuana legally;

123196 2. Legally possess up to three (3) ounces or eighty-four and
124197 nine-tenths (84.9) grams of marijuana on their person ;

126198 3. Legally possess six mature marijuana plants and the

139232 7. Legally possess up to eight (8) ounces or two hundred
140233 twenty-six and four-tenths (226.4) grams of marijuana in their
141234 residence; and

143235 8. Legally possess seventy-two (72) ounces of topical
144236 marijuana.

146237 B. Possession of up to one and one -half (1.5) ounces or forty-
147238 two and forty-five one-hundredths (42.45) grams of marijuana by
148239 persons who can state a medical condition, but are not in possession
149240 of a state-issued medical marijuana patient license, shall
150241 constitute a misdemeanor offense punishable by a fine not to exceed
151242 Four Hundred Dollars ($400.00) and shall not be subject to
152243 imprisonment for the offense. Any law enforcement officer who comes
153244 in contact with a person in violation of this subsection and who is
154245 satisfied as to the identity of the person, as well as any oth er
155246 pertinent information the law enforcement officer deems necessary,
156247 shall issue to the person a written citation containing a notice to
157248 answer the charge against the person in the appropriate court. Upon
158249 receiving the written promise of the alleged viol ator to answer as
159250 specified in the citation, the law enforcement officer shall release
160251 the person upon personal recognizance unless there has been a
161252 violation of another provision of law.

163253 C. A regulatory office The Oklahoma Medical Marijuana Authority
164254 shall be established under the State Department of Health which
165255 shall receive applications for medical marijuana patient and

166283 caregiver license recipients, dispensaries, growers, and packagers
167284 processors within sixty (60) days of the passage of this initiative .

169285 D. The State Department of Health Authority shall, within
170286 thirty (30) days of passage of this initiative, make available on
171287 its website, in an easy-to-find location, an application for a
172288 medical marijuana patient license. The license shall be good valid
173289 for two (2) years. The biannual application fee shall be One
174290 Hundred Dollars ($100.00), or Twenty Dollars ($20.00) for
175291 individuals on Medicaid, Medi care or SoonerCare. The methods of
176292 payment shall be provided on the website of the Department

179293 Authority. Reprints of the medical marijuana patient license shall
180294 be Twenty Dollars ($20.00).

182295 E. A short-term medical marijuana patient license application
183296 shall also be made available on the website of the State Department
184297 of Health Authority. A short-term medical marijuana patient license
185298 shall be granted to any applicant who can meet the requirements for
186299 a two-year medical marijuana patient license, but whose physician
187300 recommendation for medical marijuana is only valid for sixty (60)
188301 days. Short-term medical marijuana patient licenses shall be issued
189302 for sixty (60) days. The fee for a short -term medical marijuana
190303 patient license, reprints of the short-term medical marijuana
191304 patient license, and the procedure for extending or renewing the
192305 license shall be dete rmined by the Department Executive Director of
193306 the Authority.

195334 F. A temporary medical marijuana patient license application
196335 shall also be made availabl e on the website of the Department
197336 Authority for residents of other states . A temporary Temporary
198337 medical marijuana license patient licenses shall be granted to any
199338 medical marijuana license holder holders from other states, provided
200339 that the state has a such states have state-regulated medical
201340 marijuana program programs, and the applicant applicants can prove
202341 he or she is a member they are members of such program programs.
203342 Temporary medical marijuana patient licenses shall be issued for
204343 thirty (30) days. The cost for a temporary license shall be One
205344 Hundred Dollars ($100.00). Renewal shall be granted with
206345 resubmission of a new application. No additional criteria shall be
207346 required. Reprints of the temporary medical marijuana patient
208347 license shall be Twenty Dollars ($20.00).

210348 G. Medical marijuana patient license applicants shall submit
211349 his or her their applications to the State Department of Health
212350 Authority for approval. The applicant shall be an Oklahoma state a
213351 resident of this state and shall prove residency by a valid driver
214352 license, utility bills, or other accepted methods.

216353 H. The State Department of Health Authority shall review the
217354 medical marijuana patient license application,; approve, or reject,
218355 or deny the application,; and mail the approval, or rejection, or
219356 denial letter stating any reasons for rejection , to the applicant
220357 within fourteen (14) business days of receipt of the application.

223385 Approved applicants shall be issued a medical marijuana patient
224386 license which shall act as proof of his or her approved status.
225387 Applications may only be rejected or denied based on the applicant
226388 not meeting stated criteria or improper completion of the
227389 application.

229390 I. The State Department of Health shall only keep the following
230391 records for each approved medical marijuana license:

232392 1. A digital photograph of the license holder;

234393 2. The expiration date of the l icense;

236394 3. The county where the card was issued; and

238395 4. A unique 24-character identification number assigned to the
239396 license.

241397 J. The State Department of Health Authority shall make
242398 available, both on its website and through a telephone verification
243399 system, an easy method to validate the authenticity of the medical
244400 marijuana patient license by the unique 24-character twenty-four-
245401 character identification number.

247402 K. J. The State Department of Health Authority shall ensure
248403 that all application medical marijuana patient and caregiver records
249404 and information are sealed to protect the privacy of medical
250405 marijuana patient license applicants.

252406 L. K. A caregiver license shall be made available for qualified
253407 caregivers of a medical marijuana patient license holder who is
254408 homebound. As provided in Section 427.11 of this title, the

255436 caregiver license shall provide the caregiver the same rights as the
256437 medical marijuana patient licensee including the ability to possess
257438 marijuana, marijuana products and mature and immatur e plants or
258439 cultivated medical marijuana pursuant to the Oklahoma Medical
259440 Marijuana and Patient Protection Act, but excluding the ability to
260441 use marijuana or marijuana products unless the caregiver has a
261442 medical marijuana patient license. An applicant Applicants for a
262443 caregiver license shall submit proof of the license status and
263444 homebound status of the medical marijuana patient and p roof that the
264445 applicant is the designee of the medical marijuana patient. The

267446 applicant shall also submit proof that he or she is eighteen (18)
268447 years of age or older and proof of his or her Oklahoma state
269448 residency. This shall be the only criteria for a caregiver license.
270449 A licensed caregiver shall not cultivate medical marijuana for more
271450 than five medical marijuana patient licensees and shall not charge a
272451 medical marijuana patient licensee for cultivating medical marijuana
273452 in excess of the actual costs incurred in cultivating the medical
274453 marijuana.

276454 M. L. All applicants for a medical marijuana patient license
277455 shall be eighteen (18) years of age or older. A special exception
278456 shall be granted to an applicant under the age of eighteen (18);
279457 however, these applications shall be signed by two physicians and
280458 the parent or legal guardian of the applicant.

282486 N. M. All applications for a medical marijuana patient license
283487 shall be signed by an Oklahoma physician licensed by and in good
284488 standing with the State Board of Medical Licensure and Supervision,
285489 the State Board of Osteopathic Examiners, or the Board of Podiatric
286490 Medical Examiners. There are no qualifying conditions. A medical
287491 marijuana patient license must shall be recommended according to the
288492 accepted standards a reasonable and prudent physician would follow
289493 when recommending or approving any medication. No physician may be
290494 unduly stigmatized, penalized, subjected to discipline, sanctioned,
291495 reprimanded or harassed for signing a medical marijuana patient
292496 license application; provided, the physician acted in accordance
293497 with the provisions of this subsection and all other rules go verning
294498 the medical license of the physician in this state.

296499 O. N. Counties and cities may enact medical marijuana
297500 guidelines allowing medical marijuan a patient license holders or
298501 caregivers caregiver license holders to exceed the state limits set
299502 forth in subsection A of this section.

301503 SECTION 2. REPEALER 63 O.S. 2021, Section 420, as last
302504 amended by Section 2 , Chapter 312, O.S.L. 2019 (63 O.S. Supp. 2023,

311536 SECTION 4. AMENDATORY 63 O.S. 2021, Section 421, as last

315539 Section 421. A. The Oklahoma Medical Marijuana Au thority shall
316540 make available on its website in an easy -to-find location an
317541 application for a medical marijuana dispensary li cense. The
318542 application fee to be paid by the applicant shall be in the amounts
319543 provided for in Section 427.14 of this title. A method of payment
320544 for the application fee shall be provided on the website of the
321545 Authority. Dispensary applicants must all be residents of Oklahoma.
322546 Any entity applying for a dispensary license must be owned by an
323547 Oklahoma resident a resident of this state and must be registered to
324548 do business in Oklahoma this state. The Authority shall have ninety
325549 (90) business days to review the application; approve, reject, or
326550 deny the application; and send the approval, rejection, or denial
327551 letter stating reasons for the rejection or den ial to the applicant
328552 in the same method the application was submitted to the Authority.

330553 B. The Authority shall approve all applications which meet the
331554 following criteria:

333555 1. The applicant must be twenty -five (25) years of age or

339586 3. All applying entities must show tha t all members, managers,
340587 and board members are Oklahoma residents of this state;

342588 4. An applying entity may show ownership of non-Oklahoma
343589 nonstate residents, but that percentage ownership may not exceed
344590 twenty-five percent (25%);

346591 5. All applying individu als or entities must be registered to
347592 conduct business in this state; and

349593 6. All applicants must disclose all ownership interests i n the
350594 dispensary.

354595 Applicants with a nonviolent felony conviction in the last two
355596 (2) years, any other felony conviction in t he last five (5) years,
356597 inmates in the custody of the Department of Corrections or any
357598 person currently incarcerated shall not qualify for a medical
358599 marijuana dispensary license.

360600 C. Licensed medical marijuana dispensaries shall be required to
361601 complete a monthly sales report to the Authority. This report shall
362602 be due on the fifteenth of each month and provide reporting on the
363603 previous month. This report shall detail the weight of marijuana
364604 purchased at wholesale and the weight of marijuana sold to license d
365605 medical marijuana patients and licensed caregivers and account for
366606 any waste. The report shall show total sales in dollars, tax
367607 collected in dollars , and tax due in dollars. The Authority shall
368608 have oversight and auditing responsibilities to ensure tha t all
369609 marijuana being grown is accounted for.

371637 D. Only a licensed medical marijuana dispensary may conduct
372638 retail sales of marijuana or marijuana derivatives. Beginning on
373639 November 1, 2021, licensed medical marijuana dispensaries shall be
374640 authorized to package and sell pre-rolled marijuana to licensed
375641 medical marijuana patients and licensed caregivers. The products
376642 described in this subsection shall co ntain only the ground parts of
377643 the marijuana plant and shall not include marijuana concentrates or
378644 derivatives. The total net weight of each pre -roll packaged and
379645 sold by a medical marijuana dispensary shall not exceed one (1)
380646 gram. These products shall be tested, packaged and labeled in
381647 accordance with Oklahoma state law and rules promulgated by the
382648 Executive Director of the Oklahoma Medical Marijuana Authority.

384649 E. No medical marijuana dispensary shall offer or allow a
385650 medical marijuana patient licensee , caregiver licensee or other
386651 member of the public to handle or otherwise have physical contact
387652 with any medical marijuana not contained in a sealed or separate
388653 package. Provided, such prohibition shall not preclude an employee
389654 of the medical marijuana dispensary from handling loose or
390655 nonpackaged medical marijuana to be placed in packaging consistent
391656 with the Oklahoma Medical Marijuana and Patient Protection Act and
392657 the rules promulgated by the Authority Executive Director for the
393658 packaging of medical mar ijuana for retail sale. Provided, further,
394659 such prohibition shall not prevent a medical marijuana dispen sary
395660 from displaying samples of its medical marijuana in separate display

464794 lifts restrictions on buying and selling marijuana between states,
465795 then a licensed medical marijuana commercial grower would be allowed
466796 to sell and buy marijuana wholesale from, or to, an out -of-state
467797 wholesale provider. A licensed medical ma rijuana commercial grower
468798 shall be required to complete a monthly yield and sales report to
469799 the Authority. This report shall be due on the fifteenth o f each
470800 month and provide reporting on the previous month. This report
471801 shall detail the amount of marijua na harvested in pounds, the amount
472802 of drying or dried marijuana on hand, the amount of marijuana sold
473803 to licensed processors in poun ds, the amount of waste in pounds, and
474804 the amount of marijuana sold to licensed medical marijuana
475805 dispensaries in pounds. A dditionally, this report shall show total
476806 wholesale sales in dollars. The Authority shall have oversight and
477807 auditing responsibilities to ensure that all marijuana being grown

496848 F. Beginning November 1, 2022, all medical marijuana commerc ial
497849 grower licensees who operate an outdoor medical marijuana production
498850 facility shall be required to register with the Oklahoma Department
499851 of Agriculture, Food, and Forestry as an environmentally sensitive
500852 crop owner. Registration shall provide notice t o commercial and
501853 private pesticide applicators of the locations of medical marijuana
502854 crops and help minimize the potential for damag ing pesticide drift.
503855 Medical marijuana commercial grower licensees shall provide their
504856 business name, address, Global Posit ioning System (GPS) coordinates
505857 for all outdoor medical marijuana production facilities, and any
506858 other information required by the Department when regi stering with
507859 the Environmentally Sensitive Area Registry.

6261059 licensed processors shall constitute a need for a new council and
6271060 standards review.

8501456 certificate of compliance from the political subdivision w here the

14202415 lesser grade or salary than presently received. All employees shall
14212416 retain leave, sick, and annual time earned, and any retirement and
14222417 longevity benefits w hich have accrued during their tenure with the
14232418 Department. The transfer of personnel between the state a gencies
14242419 shall be coordinated with the Office of Management and Enterprise
14252420 Services.

14272421 6. The expenses incurred by the Authority as a result of the
14282422 transfer required by this subsection shall be paid by the Authority.

14342426 8. The Office of Managemen t and Enterprise Services shall

17352926 to knowingly hire or employ undoc umented immigrants to perform work
17362927 inside a medical marijuana commercial grow facility or anywhere on
17372928 the property of the medical marijuana commercial grow operation. A
17382929 licensed medical marijuana commercial grower that violates the
17392930 provisions of this subsection shall, upon conviction, be guilty of a
17402931 misdemeanor punishable by imprisonment in the county jail f or a term
17412932 not exceeding one (1) year, or by a fine not exceeding Five Hundred
17422933 Dollars ($500.00), or by both such fine and imprisonment. In
17432934 addition, the license of the medical marijuana commercial grower

17672981 Authority shall grant the medical marijuan a business licensee a
17682982 grace period of one hundred eighty (180) days to become operational.
17692983 Upon expiration of this grace pe riod, the Authority shall schedule a
17702984 second on-site meeting and compliance inspection of the premises to
17712985 verify whether the medical marijuana business licensee has begun
17722986 operations at the licensed premises or is continuing to work towards
17732987 operational status.

18153075 L. M. Whenever the Executive Director of the Authority finds
18163076 that an emergency exists requiring immediate action in order to
18173077 protect the health or welfare of the p ublic, the Executive Director
18183078 of the Authority may issue an order, without providing notice or
18193079 hearing, stating the existenc e of said an emergency and requiring
18203080 that action be taken as the Executive Director of the Authority
18213081 deems necessary to meet the emergency. Such actio n may include, but
18223082 is not limited to, ordering the licensee to immediately cease and
18233083 desist operations by the licensee. The order shall be effective
18243084 immediately upon issuance. Any person to whom the order is directed
18253085 shall comply immediately with the provisions of the order. The
18263086 Authority may assess a penalty not to exceed Ten Thousand Dollars
18273087 ($10,000.00) per day of noncompliance with the order. In assessing
18283088 such a penalty, the Authority shall consider the seriousness of the
18293089 violation and any efforts t o comply with applicable requirements.
18303090 Upon application to the Authority, the licensee shall be offered a
18313091 hearing within ten (10) days of the issuance of the order.

25614290 disposal facility is not physically or technically suitable, the
25624291 Authority shall deny th e license. The Authority may, upon
25634292 determining that public health or safety requires emergency action,
25644293 issue a temporary license fo r treatment or storage of medical
25654294 marijuana waste for a period not to exceed ninety (90) days. The
25664295 Authority shall not, for the first year of the licensure program
25674296 until November 1, 2021 , issue more than ten medical marijuana waste
25684297 disposal licenses. Upon the conclusion of the first year, the
25694298 Authority shall assess the need for additional medical marijuana
25704299 waste disposal licenses and shall, if demonstrated, increase
25714300 Beginning November 1, 2021, there shall be no limit to the number of
25724301 medical marijuana was te disposal licenses as deemed necessary issued

26784455 inspection of the facility of the licensee during hours of operation
26794456 and other reasonable times. Refusal to permit such entry of
26804457 inspection shall constitute grounds for the nonrenewal, suspension
26814458 or revocation of a license. The Aut hority, the Oklahoma State

26854489 facility of the licensee. If t he Authority receives a complaint
26864490 concerning noncompliance by a licensee with the provisions of the
26874491 Oklahoma Medical Marijuana Waste Management Act, the Authority, the
26884492 Oklahoma State Bureau of Narcotics and Dangerous Drugs Control, the
26894493 Oklahoma State Burea u of Investigation, and the Attorney General may
26904494 conduct additional unannounced, on -site inspections beyond the
26914495 inspections provided for in Section 427 .6 of this title. The
26924496 Authority may refer all complaints alleging criminal activity that
26934497 are made against a licensed facility to appropriate state or local
26944498 law enforcement authorities.

26964499 E. The Authority shall issue an annual permit for each medical
26974500 marijuana waste disposal facility operated by a licensee. A permit
26984501 shall be issued only upon proper applicatio n by a licensee and
26994502 determination by the Authority that the proposed site and facility
27004503 are physically and technically suitable. Upon a finding that a
27014504 proposed medical marijuana waste disposal facility is not physically
27024505 or technically suitable, the Authori ty shall deny the permit. The
27034506 Authority shall have the authority to revoke a permit upon a finding
27044507 that the site and facility are n ot physically and technically
27054508 suitable for processing. The Authority may, upon determining that

27124539 F. The cost of a medical marijuana waste disposal license shall
27134540 be Five Thousand Dollars ($5,000.00) for the initial license. The
27144541 cost of a medical marijuana waste disposal facility permit shall be
27154542 Five Hundred Dollars ($500.00). A medical marijuana waste disposal
27164543 facility permit that has been revoked shall be reinstated upon
27174544 remittance of a reinstatement fee o f Five Hundred Dollars ($500.00)
27184545 to restore the facility permit. All license and permit fees shall
27194546 be deposited into the Oklahoma Medical Marijuana Au thority Revolving
27204547 Fund as provided in Section 427.5 of this title.

27224548 G. The holder of a medical marijuana waste disposal license
27234549 shall not be required to obtain a medical marijuana transporter
27244550 license provided for in the Oklahoma Medical Marijuana and Patient
27254551 Protection Act for purposes of transporting medical marijuana waste.

27274552 H. All commercial licensees, as defined in Section 428.1 of
27284553 this title, shall utilize a licensed medical marijuana waste
27294554 disposal service to process all medical marijuana waste genera ted by
27304555 the licensee.

27324556 I. The State Commissioner of Health Executive Director of the
27334557 Authority shall promulgate rules for the implementation of the
27344558 Oklahoma Medical Marijuana Waste Management Act. Promulgated rules
