8181 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 18-113.6 of Title 70, unless
8484 there is created a duplication in numb ering, reads as follows:
8585 A. Subject to the availability of funding, beginning with the
8686 2023-2024 school year, if the number of students enrolled in a
8787 single grade level in a school district exceeds the class size
8888 limits set forth in Section 18-113.1, 18-113.2, or 18-113.3 of Title
8989 70 of the Oklahoma Statutes, the school district shall receive a
9090 grant to employ a teacher’s assistant in an amount equal to the

142142 average salary of a teacher ’s assistant, as determined by the State
143143 Department of Education. For the purposes of this section,
144144 “teacher’s assistant” shall have the same meaning as provided for in
145145 Section 6-127 of Title 70 of the Oklahoma S tatutes.
146146 B. A school district that receives a grant pur suant to this
147147 section shall not be subject to the penalties for ex ceeding the
148148 class size limits set forth in Section 18-113.1, 18-113.2, or 18-
149149 113.3 of Title 70 of the O klahoma Statutes.
150150 C. Application for a grant authorized by subsection A of this
151151 section shall be submitted to the S tate Department of Education on a
152152 form and in a manner prescribed by the Department. If funds are
153153 insufficient to provide grants to all eligible applicants, available
154154 funds shall be distributed on a pro rata basis.
155155 D. The State Board of Education shall promulgate rules to
156156 implement the provisions of this section.
157157 SECTION 2. This act shall become effective July 1, 2023.
158158 SECTION 3. It being immediately necessary for the preservation
159159 of the public peace, health, or safety, an emergency is hereby
160160 declared to exist, by reason whereof thi s act shall take effect and
161161 be in full force from and after its passage and app roval.
