81	81	BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
82	82	SECTION 1. NEW LAW A new section of law to be codified
83	83	in the Oklahoma Statutes as Section 18-113.6 of Title 70, unless
84	84	there is created a duplication in numb ering, reads as follows:
85	85	A. Subject to the availability of funding, beginning with the
86	86	2023-2024 school year, if the number of students enrolled in a
87	87	single grade level in a school district exceeds the class size
88	88	limits set forth in Section 18-113.1, 18-113.2, or 18-113.3 of Title
89	89	70 of the Oklahoma Statutes, the school district shall receive a
90	90	grant to employ a teacher’s assistant in an amount equal to the

142	142	average salary of a teacher ’s assistant, as determined by the State
143	143	Department of Education. For the purposes of this section,
144	144	“teacher’s assistant” shall have the same meaning as provided for in
145	145	Section 6-127 of Title 70 of the Oklahoma S tatutes.
146	146	B. A school district that receives a grant pur suant to this
147	147	section shall not be subject to the penalties for ex ceeding the
148	148	class size limits set forth in Section 18-113.1, 18-113.2, or 18-
149	149	113.3 of Title 70 of the O klahoma Statutes.
150	150	C. Application for a grant authorized by subsection A of this
151	151	section shall be submitted to the S tate Department of Education on a
152	152	form and in a manner prescribed by the Department. If funds are
153	153	insufficient to provide grants to all eligible applicants, available
154	154	funds shall be distributed on a pro rata basis.
155	155	D. The State Board of Education shall promulgate rules to
156	156	implement the provisions of this section.
157	157	SECTION 2. This act shall become effective July 1, 2023.
158	158	SECTION 3. It being immediately necessary for the preservation
159	159	of the public peace, health, or safety, an emergency is hereby
160	160	declared to exist, by reason whereof thi s act shall take effect and
161	161	be in full force from and after its passage and app roval.
