AS INTRODUCED 
 
An Act relating to schools; directing certain school 
districts to receive certain gran t beginning in 
certain school year subject to availability of 
funding; defining term; exempting districts that 
receive grants from certain penalties; directing 
applications for grants to b e submitted to the State 
Department of Education; providing for distribution 
of grants if funds are insuff icient to provide grants 
to all applicants; providing for prom ulgation of 
rules; providing for codification; providing an 
effective date; and declaring an emergency . 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 18-113.6 of Title 70, unless 
there is created a duplication in numb ering, reads as follows: 
A.  Subject to the availability of funding, beginning with the 
2023-2024 school year, if the number of students enrolled in a 
single grade level in a school district exceeds the class size 
limits set forth in Section 18-113.1, 18-113.2, or 18-113.3 of Title 
70 of the Oklahoma Statutes, the school district shall receive a 
grant to employ a teacher’s assistant in an amount equal to the

average salary of a teacher ’s assistant, as determined by the State 
Department of Education.  For the purposes of this section, 
“teacher’s assistant” shall have the same meaning as provided for in 
Section 6-127 of Title 70 of the Oklahoma S tatutes. 
B.  A school district that receives a grant pur suant to this 
section shall not be subject to the penalties for ex ceeding the 
class size limits set forth in Section 18-113.1, 18-113.2, or 18-
113.3 of Title 70 of the O klahoma Statutes. 
C.  Application for a grant authorized by subsection A of this 
section shall be submitted to the S tate Department of Education on a 
form and in a manner prescribed by the Department.  If funds are 
insufficient to provide grants to all eligible applicants, available 
funds shall be distributed on a pro rata basis. 
D.  The State Board of Education shall promulgate rules to 
implement the provisions of this section. 
SECTION 2.  This act shall become effective July 1, 2023. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health, or safety, an emergency is hereby 
declared to exist, by reason whereof thi s act shall take effect and 
be in full force from and after its passage and app roval.
