BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 18-113.6 of Title 70, unless there is created a duplication in numb ering, reads as follows: A. Subject to the availability of funding, beginning with the 2023-2024 school year, if the number of students enrolled in a single grade level in a school district exceeds the class size limits set forth in Section 18-113.1, 18-113.2, or 18-113.3 of Title 70 of the Oklahoma Statutes, the school district shall receive a grant to employ a teacher’s assistant in an amount equal to the Req. For the purposes of this section, “teacher’s assistant” shall have the same meaning as provided for in Section 6-127 of Title 70 of the Oklahoma S tatutes. B. A school district that receives a grant pur suant to this section shall not be subject to the penalties for ex ceeding the class size limits set forth in Section 18-113.1, 18-113.2, or 18- 113.3 of Title 70 of the O klahoma Statutes. C. Application for a grant authorized by subsection A of this section shall be submitted to the S tate Department of Education on a form and in a manner prescribed by the Department. If funds are insufficient to provide grants to all eligible applicants, available funds shall be distributed on a pro rata basis. D. The State Board of Education shall promulgate rules to implement the provisions of this section. SECTION 2. This act shall become effective July 1, 2023. SECTION 3.
