30162 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32163 SECTION 1. AMENDATORY 70 O.S. 2021, Section 2603, is
33164 amended to read as follows:

35165 Section 2603. A. Except as otherwise provided for in
36166 subsection B of this section and elsewhere in this sect ion, to be
37167 eligible to participate in the Oklahoma Higher Learning Access
38168 Program and to qualify for an award which includ es payment of an
39169 amount equivalent to resident tuition or other tuition pursuant to
40170 Section 2604 of this title for the first semester or other academic
41171 unit of postsecondary enrollment, a student shall:

43172 1. Be a resident of this state or be enrolled in a s chool

50202 2. Be a United States citizen or lawfully present in the United
51203 States. A student who is not a United States citizen or lawfully
52204 present in the United States shall not be eligible to participate in
53205 the Oklahoma Higher Learning Access Program and to qualify for an
54206 award notwithstanding the provisions of Section 3242 of this titl e.
55207 The provisions of this paragraph shall not apply to any student who
56208 was enrolled in the Oklah oma Higher Learning Access Program pr ior to
57209 the end of the 2006-2007 school year;

59210 3. Have a record of satisfactory compliance with agreements
60211 executed pursuant to Section 2605 of this title;
61-
62212 4. a. have graduated within the previous three (3) years
63213 from a high school accredited by the State B oard of
64214 Education, or the Oklahoma School of Science and
65215 Mathematics with a minimum 2.5 cumulative grade point
66216 average on a 4.0 scale for all work attempted in
67217 grades nine through twelve,

69218 b. have graduated within the pr evious three (3) years
70219 from a high school not accredited by the State Board
71220 of Education with a minimum 2.5 cumulative grade point
72221 average on a 4.0 scale for all work attempted in

74249 composite score of 22 or high er on the ACT test or a
75250 composite score of 1110 or higher on th e SAT, or

78252 three (3) years an edu cational program that was
79253 provided through a means other than a public or
80254 private school and have achieved a composite score of
81255 22 or higher on the ACT test or a composite score of
82256 1110 or higher on the SAT;

84257 5. Have completed the curricular requirements for admiss ion to
85258 an institution within The Oklahoma State System of Higher Education
86259 and one additional unit or set of competencies in a course th at
87260 meets college admission requirements; or have completed the core
88261 curriculum and is seeking admission to a technology center school
89262 overseen by the State Board of Career an d Technology Education . The
90263 curriculum requirements for admission to an institution within The

93264 Oklahoma State System of Higher Education shall include two units or
94265 sets of competencies in foreign or no n-English language or
95266 technology courses that meet the college admission requirements and
96267 one unit or set of competencies of a fine arts course. Students
97268 shall also have attained a 2.5 grade point average in the core
98269 curriculum courses. Students who attended a high school which did
99270 not offer all the core cur riculum courses or students who were
100271 educated by other means and were not offered all the core curriculum
101272 courses shall be allowed to satisfy this curriculum requirement b y

102299 participating in a program a pproved by the Oklahoma State Regents
103300 for Higher Education for remediation of high sc hool curricular
104301 deficiencies;

106302 6. Have satisfied admission standards as determined by the
107303 Oklahoma State Regents for Hi gher Education for first-time-entering
108304 students for the appropriate type of institution, or, if attending a
109305 private institution, have sat isfied admission sta ndards as
110306 determined by the private institution. No student participating in
111307 the Oklahoma Higher L earning Access Program shall be admitted into
112308 an institution of higher education by special admission standards ;

114309 7. Have secured admissi on to, and enrolled in, an institution
115310 which is a member of The Oklahoma State System of Higher Education,
116311 a postsecondary vocational-technical program offered by a technology
117312 center school that meets the requirements to be eligib le for federal
118313 student financial aid, or a pri vate institution of higher learning
119314 located within this state and accredited pursuant to Section 41 03 of
120315 this title; and

122316 8. a. have established finan cial need according to the
123317 provisions of subsection D of Sect ion 2605 of this
124318 title and standards and provisions promulgated by the
125319 Oklahoma State Regents for Higher Education,

149365 promulgated by the Oklahoma State Regents for H igher

152367 B. 1. A student shall be eligib le to participate in the
153368 Oklahoma Higher Learning Access Prog ram and to qualify for an award
154369 which includes payment of an amount equivalent to resident tuition
155370 or other tuition pursuant to Section 2604 of t his title for the
156371 first semester or other academic unit of postsecondary enrollment if
157372 the student meets all of the following criteria:

159399 a. is a child of any person killed after January 1, 2000,
160400 in the line of duty in any branch of the United States
161401 Armed Forces or who died after January 1, 2000, as a
162402 result of an injury sustained while in the line of
163403 duty in any branch of the United States Armed Forces
164404 and the person who was killed or died filed an
165405 individual or joint Oklahoma income tax return for the
166406 tax year prior to the year during which the person was
167407 killed or died,

169408 b. is a resident of this state or is enrolle d in a school
170409 district located in this state that serves students
171410 who reside in both this state and an adjacent state
172411 pursuant to a contract as a uthorized in Section 5-
173412 117.1 of this title,

175413 c. enrolls in an institution within The Oklahoma State
176414 System of Higher Education prior to re aching the age

205463 pursuant to this subsection shall not be required to meet the
206464 eligibility requirements set fo rth in subsection A of this section.

208465 C. To retain eligibility while pursuing the program of higher
209466 learning in which enrolled, the stude nt shall:

211467 1. Meet the requirements for retention and degree completion as
212468 established by the institution in which the student is enrolled;

214469 2. Maintain good academic st anding and satisfactory academic
215470 progress according to standa rds of the Oklahoma State Regents for
216471 Higher Education;

218498 3. Maintain satisfactory academic progress as required for
219499 eligibility for federal Title IV student financial aid programs.
220500 The provisions of this paragraph shall become effective for the
221501 2012-2013 school year;

225502 4. Comply with the standards related to maintenance of
226503 eligibility as promulgated by the Oklahoma State Regents for Higher
227504 Education; and

229505 5. Refrain from conduct that leads to expu lsion or suspension
230506 of more than one semester from an institu tion of higher education.
231507 A student who violates the provisions of this paragraph shall
232508 permanently lose eligibility for program benefits. The provisions
233509 of this paragraph shall become effectiv e January 1, 2008.

235510 D. The Oklahoma State Regents for Higher Education and the
236511 State Board of Career and Technology Education shall promulgate
237512 rules relating to maintenance of eligibility under the Oklahoma
238513 Higher Learning Access Act by a student.

240514 E. It is the intent of the Legislature that students in the
241515 ninth grade for the 1992-93 school year who are determined to be
242516 eligible Oklahoma Higher Learning Access students pursuant to the
243517 Oklahoma Higher Learni ng Access Act shall be the first students
244518 eligible for benefits from the Oklahoma Higher Learning Access Trust
245519 Fund.

247520 F. The Oklahoma Sta te Regents for Higher Education are
248521 authorized to study, develop, and propose criteria for determining
