2857 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3058 SECTION 1. NEW LAW A new section of law to be codified
3159 in the Oklahoma Statutes as Section 6060.4b of Title 36, unless
3260 there is created a duplication in numbering, reads as follows:

3461 A. As used in this section:

3662 1. “Health benefit plan” has the same meaning as provided by
3763 Section 6060.4 of Title 36 of the Oklahoma Statutes ; and

3964 2. “Medically necessary” means services or supplies provided by
4065 a health care provider that are:

5298 d. not solely for the convenience of the insured, the
5399 insured’s family, or the provider.

55100 B. A health benefit plan shall cover the cost of medically
56101 necessary standard serological tests for syphilis required under
57102 Section 1-515 of Title 63 of the Oklahoma Statutes.

59103 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -515, is
60104 amended to read as follows:

62105 Section 1-515. A. Every physician, physician assistant, or
63106 Advanced Practice Registered Nurse attending a pregnant woman in
64107 Oklahoma this state during gestation shall, in the case of each
65108 woman so attended, take or cause to be taken a sample of blood of
66109 such woman at the time of first examination, and shall submit such
67110 sample to an approved laboratory for a standar d serological test for
68111 syphilis, when indicated by current guidance of the Centers for
69112 Disease Control and Prevention .

71113 B. Every other person permitted by law to attend upon pregnant
72114 women in the state but not permitted by law to take blood tests
73115 shall cause a sample of the bloo d of such pregnant wom an to be taken
74116 by a duly licensed physician, physician assistant, or Advanced
75117 Practice Registered Nurse, licensed to practice in the State of

76145 Oklahoma this state, and submitted to an approved laboratory fo r a
77146 standard serological test for syphilis.

79147 C. The term “approved laboratory” shall mean a laboratory
80148 approved for the purposes of this sec tion by the State Commissioner
81149 of Health. A standard serological test for syphilis shall be one
82150 recognized as such by the Commissioner. Such laboratory tests shall
83151 be made, on request, without charge by the State Department of
84152 Health.

86153 SECTION 3. This act shall become effective November 1, 2023.
