38	41		An Act relating to wildlife; amending 29 O.S. 2021,
39	42		Section 5-213, as amended by S ection 1, Chapter 253,
40	43		O.S.L. 2022 (29 O.S. Supp. 2022, Section 5-213),
41	44		which relates to air bows; expanding season; allowing
42	45		for a physically disabled person to use air bows
43	46		under certain conditions ; and providing exception for
44	47		certain season.

48	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
49	54		SECTION 1. AMENDATORY 29 O.S. 2021, Section 5 -213, as
50	55		amended by Section 1, Chapter 253, O.S.L. 2022 (29 O.S. Supp. 2022,
51	56		Section 5-213), is amended to read as follow s:
52	57		Section 5-213. A. The use of crossbows and convention al
53	58		longbows with a device that permits the bow to be held mechanically
54	59		at full or partial draw, shall be a legal hunting meth od during any
55	60		open season when convent ional longbows are a legal means of take.
56	61		B. The use of air bows shall be a legal hunting me thod during
57	62		any open season when rifles, archery, or primitive firearms are a
58	63		legal means of take, except as otherwise provided in subsection C of
59	64		this section. No person may hunt or take dur ing the open season
60		-	with an air bow unless the person has first obtained a stamp issued

87	93		by the Oklahoma Wildlife Cons ervation Commission for a one-time fee
88	94		of Twenty Dollars ($20.00).
89	95		C. 1. A permanently physically disabled person may use an air
90	96		bow as a legal hunting method during any open season.
91	97		2. A person using an air bow as a legal hunting method during
92	98		the archery deer season shall be limited to antlerless deer only.
93	99		3. A person may use an air bow as a legal hunting method for
94	100		nuisance wildlife or feral swine .
95	101		D. At such time as the Federal Aid in Wildlife R estoration Act
96	102		is amended to expand the excise tax on sporting arms and ammun ition
97	103		to include air bows and air guns, the stamp pursu ant to subsection B
98	104		of this section shall no longer be re quired, and authorization for
99	105		the continual use of air bows as a le gal means of take shall be
100	106		established by rules pr omulgated by the Commission .
