2957 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3158 SECTION 1. NEW LAW A new section of law to be codified
3259 in the Oklahoma Statutes as Section 8-105 of Title 47, unless there
3360 is created a duplication in numbering, reads as follows:

3561 A. If a motor vehicle rental company imposes ad ditional
3662 mandatory charges, the rental company shall:

3863 1. Provide a good-faith estimate of the total charges for t he
3964 entire rental, including all additional mandatory charges, whenever
4065 a quote is provided to a poten tial customer. The good-faith
4166 estimate may exclude mileage charge s and charges for opti onal items

4294 that cannot be determined prior to completing a rental reservation
4395 based on the information provided by the potential customer ; and

4596 2. Disclose in the renta l contract provided to the renter the
4697 total charges for the entire rental, including all additional

4998 mandatory charges. Total charges for the entire rental do not
5099 include any charges that cannot be determined at the time the rental
51100 commences.

53101 B. As used in this section:

55102 1. “Additional mandatory charge” means any separately stated
56103 charges that a motor vehicle rental company requires a renter to pay
57104 that specifically relate to the operation of a rental vehicle.
58105 Additional mandatory charge includes, but is not limited to, a
59106 customer facility charge, airport concession recovery fee, road
60107 safety program fee, vehicle license recovery fee, or any government
61108 imposed taxes or fees;

63109 2. “Motor vehicle” means the same as set forth in Section 562
64110 of Title 47 of the O klahoma Statutes;

66111 3. “Motor vehicle rental agreement ” means an agreement for the
67112 rental of a motor vehicle for transportation purposes, for a period
68113 no more than ninety (90) days, in return for a fee that is
69114 calculated on a daily, weekly, or monthly basis ;

71115 4. “Motor vehicle rental company” means an entity that is in
72116 the business of renting, pursuant to motor vehicle rental
73117 agreements;

75145 5. “Quote” means an estimated cost of rental provided by a
76146 motor vehicle rental company to a potential customer based on
77147 information provided by the customer, including potential dates of
78148 rental, location, or class of vehicle; and

80149 6. “Vehicle license recovery fee ” means a charge to recover
81150 costs incurred by a motor vehicle rental company to license, title,
82151 register, plate, or inspect a rental vehicle.

84152 SECTION 2. This act shall become effective November 1, 2023.
