151151 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
152152 SECTION 1. NEW LAW A new section of law to be codif ied
153153 in the Oklahoma Statutes as Section 6-190.3 of Title 70, unless
154154 there is created a duplication in numb ering, reads as follows:
155155 A. This act shall be known and may be cited as the “Interstate
156156 Teacher Mobility Compact Act ”. The purpose of the Inter state
157157 Teacher Mobility Compact shall be to facilitate the mobility of
158158 teachers through a collective regulatory framework amongst member
159159 states to expedite and enhance the ability of teachers to mov e
160160 across state lines.
161161 B. As used in this act:
162162 1. “Active military member” means any person with full-time
163163 duty status in the uniformed service of the United States including
164164 members of the National Guard and Reserve;
165165 2. “Adverse action” means any limitation or restriction imposed
166166 by a member state’s licensing authority, such as revocation,
167167 suspension, reprimand, probation, or limitation on the licensee ’s
168168 ability to work as a teacher;
169169 3. “Bylaws” means those bylaws established by the Commission;
170170 4. “Career and technical education license ” means a current,
171171 valid authorization issued by a member state’s licensing authority
172172 allowing an individual to serve as a teacher in a pre -kindergarten
173173 through twelfth grade public educational setting in a specific
174174 career and technical education area;

226226 5. “Charter member state ” means a member state that has enacted
227227 legislation to adopt the compact and enactment predates the initial
228228 meeting of the Commission after the effectiv e date of the compact ;
229229 6. “Commission” means the Interstate Teacher Mobility Compact
230230 Commission, an interstate administrative body whose membership
231231 consists of delegates of all states that have enacted the Interstate
232232 Teacher Mobility Compact;
233233 7. “Commissioner” means the delegate of a member state that has
234234 adopted the Interstate Teacher Mobility Compact;
235235 8. “Eligible license” means a license or certification to
236236 engage in the teaching pr ofession which requires at least a
237237 bachelor’s degree and the completio n of a state-approved program for
238238 teacher certification;
239239 9. “Eligible military spouse ” means the spouse of any
240240 individual in full-time duty status in the active uniformed service
241241 of the United States including members of th e National Guard and
242242 Reserve on active duty moving as a result of a military mission or
243243 military career progression requirements or moving as a result of
244244 separation or retirement. Eligib le military spouse includes
245245 surviving spouses of deceased military me mbers;
246246 10. “Executive committee” means a group of commissioners
247247 elected or appointed on behalf of and within the powers gra nted to
248248 them by the Commission as provided for herein;

300300 11. “Licensing authority” means an official agency , board, or
301301 other entity of a state that is responsible fo r the licensing or
302302 certification and regulation of teachers authorized to teach in pre -
303303 kindergarten through twe lfth grade public educational settings;
304304 12. “Member state” means any state that has ad opted the
305305 Interstate Teacher Mobility Compa ct including all agencies and
306306 officials of the state;
307307 13. “Receiving state” means any state in which a teacher has
308308 applied for certification pursuant to the Interstate T eacher
309309 Mobility Compact;
310310 14. “Rule” means any regulation promulgated by the Commission
311311 under the Interstate Teacher Mobility Compact , which shall have the
312312 force of law in each member state;
313313 15. “State practice laws” means a member state’s laws, rules,
314314 and regulations that govern the teaching prof ession, define the
315315 scope of the teaching profession, and c reate methods and grounds for
316316 imposing discipline;
317317 16. “State specific requirements ” means a requirement for
318318 teacher certification covered in coursework or exami nation that
319319 includes the content of unique interest to the state;
320320 17. “Teacher” means an individual who currently holds an
321321 authorization from a member state that forms the basis for
322322 employment in the pre -kindergarten through twelfth grade public

374374 educational settings of the state to provide instruction in a
375375 specific subject area, grade level, or st udent population; and
376376 18. “Unencumbered license” means a current, valid authorization
377377 issued by a member state ’s licensing authority allowing an
378378 individual to serve as a teacher in a pre -kindergarten through
379379 twelfth grade public educational setting. An u nencumbered license
380380 is not a restricted, probationary, provisiona l, substitute,
381381 emergency, or temporary credent ial.
382382 C. 1. Licensure pursuant to the Interstate Teacher Mobility
383383 Compact shall pertain only to the initial grant of a license or
384384 certificate by the receiving state. No thing herein shall apply to
385385 any subsequent or ongoing compliance requirements that a r eceiving
386386 state may require for teachers.
387387 2. Each member state shall, in accordance with the rules of the
388388 Commission, define, compile, and update as necessary a list of
389389 eligible licenses and career and technical education licenses that
390390 the member state is willing to consider for equivalency pu rsuant to
391391 the Interstate Teacher Mobility Compact and provide a list to the
392392 Commission. The list shall include those licenses that a receiving
393393 state is willing to grant to teachers from other member states,
394394 pending a determination of equivalency by the rec eiving state’s
395395 licensing authority.
396396 3. Upon receipt of an application for licensur e or
397397 certification by a teacher holding an unencumbered eligible license,

449449 the receiving state shall determine which of the receiving s tate’s
450450 eligible licenses the teacher is qualified to hold and shall grant
451451 the license(s) or certification(s) to the applicant. The
452452 determination shall be made in the sole discretion of the receiving
453453 state’s licensing authority and may include a determinat ion that the
454454 applicant is not eligible for any of the receiving state’s eligible
455455 licenses. For all teachers who hold an u nencumbered license, th e
456456 receiving state shall grant one or m ore unencumbered licenses that,
457457 in the receiving state’s sole discretion, are equivalent to the
458458 license(s) held by the teacher in any other member state.
459459 4. For active military members and eligi ble military spouses
460460 who hold a license or cert ification that is not unencumbered, the
461461 receiving state shall grant an equivalent licen se or licenses that,
462462 in the receiving state’s sole discretion, are equivalent to the
463463 license or licenses h eld by the teacher in any other member s tate,
464464 except where the receiving state does not have an equivalent license
465465 or certification.
466466 5. For a teacher holding an unencumbered career and tech nical
467467 education license, the receiving stat e shall grant an unencumbered
468468 license equivalent to the career and technical education license
469469 held by the applying teacher and issued by another member state, as
470470 determined by the receiving state in its sole disc retion, except
471471 where a career and technica l education teacher does not hold a
472472 bachelor’s degree and the receiving state requires a bachelor ’s

525525 receiving state may require career and technical e ducation teachers
526526 to meet state industry recognized requirements, if required by law
527527 in the receiving stat e.
528528 D. 1. Except as provided for in subsection C of this s ection,
529529 nothing in the Interstate Teacher Mobility Compact shall be
530530 construed to limit or i nhibit the authority of a member state to
531531 regulate licensure or endorsements overse en by a member state’s
532532 licensing authority.
533533 2. When a teacher is required to renew a license or
534534 certification pursuant to the Interstate Teacher Mobility Compact ,
535535 the state granting the license or certification may require the
536536 teacher to complete state specific requirements as a condition of
537537 license or certification renewal or advancement in that state.
538538 3. For the purposes of determining compensation, a receiving
539539 state may require additional information from teachers receiving a
540540 license or certification p ursuant to the provisio ns of the
541541 Interstate Teacher Mobility Compact .
542542 4. Nothing in the Interstate Teacher Mobility Compact shall be
543543 construed to limit the power of a membe r state to control and
544544 maintain ownership of its information pertaining to teachers or
545545 limit the application of a member state’s laws or regulations
546546 governing the ownership, use, or dissemination of in formation
547547 pertaining to teachers.

599599 5. Nothing in the Interstate Teacher Mobility Compact shall be
600600 construed to invalidate or alter any exi sting agreement or another
601601 cooperative arrangement of which a member state may already be a
602602 party or limit the ability of a member st ate to participate in any
603603 future agreement or other cooperative arrangement to:
604604 a. award teaching license s, certification, or other
605605 benefits based on additional professional credentials
606606 including but not limited to a National Board
607607 Certification,
608608 b. participate in the exchange of names o f teachers whose
609609 license or certification has been subject to an
610610 adverse action by a member state, or
611611 c. participate in any agreement or cooperative
612612 arrangement with a non -member state.
613613 E. 1. Except as provided for active military members or
614614 eligible military spouses in paragraph 4 of subsection C of this
615615 section, a teacher may onl y be eligible to receive a license or
616616 certification pursuant to the Interstate Teacher Mobility Compact
617617 where that teacher holds an unencumbered license or certification in
618618 a member state.
619619 2. A teacher eligible to receive a license or certification
620620 pursuant to the Interstate Teacher Mobility Compact shall, unless

673673 a. upon his or her application to receive a license or
674674 certification pursuant to the Interstate Teacher
675675 Mobility Compact, undergo a criminal background check
676676 in the receiving state in accordance with the laws and
677677 regulations of the receiving state, and
678678 b. provide the receiving state with information in
679679 addition to the information required for licensure or
680680 certification for the purposes of determining
681681 compensation, if applicable.
682682 F. 1. Nothing in the Interstate Teacher Mobility Compact shall
683683 be deemed or construed to limit the authority of a member state to
684684 investigate or impose disciplinary measures on teach ers according to
685685 the state’s practice laws.
686686 2. Member states shall be auth orized to receive and shall
687687 provide files and information regarding the investigation and
688688 discipline, if any, of teachers in other member states upon request.
689689 Any member state rece iving information or files shall protect and
690690 maintain the security and conf identiality thereof in at least the
691691 same manner that it maintains i ts own investigatory or disciplinary
692692 files and information. Pr ior to disclosing any disciplinary or
693693 investigatory information received from another member state, the
694694 disclosing state shall communicate its intention and purpose fo r
695695 disclosure to the member state which originally provided the
696696 information.

748748 SECTION 2. NEW LAW A new section of law to be codified
749749 in the Oklahoma Statutes as Section 6-190.4 of Title 70, unless

751751 A. The member states of the Interstate Teacher Mobility Compac t
752752 hereby create and establish a joint public agency known as the
753753 Interstate Teacher Mobility Compact Commission. The Commissio n
754754 shall be a joint interstate governmental agency comprised of stat es
755755 that have enacted the Interstate Teacher Mobility Compact . Nothing
756756 in the Interstate Teacher Mobility Compact shall be construed as a
757757 waiver of sovereign immunity.
758758 B. 1. Each member state shall have and be limited to one
759759 delegate to the Commission, who shall be given the title of
760760 commissioner and shall be the primary administrative officer of the
761761 state licensing authority or his or her designee.
762762 2. Any commissioner may be removed or suspended fro m office as
763763 provided by the law of the state from which the commissioner is
764764 appointed. The member state shall fill a ny vacancy occurring in the
765765 Commission within ninety (90) days.
766766 3. Each commissioner shall be entitled to one vote on the
767767 promulgation of rules and the creation of bylaws and shall otherwise
768768 have an opportunity to participate in the business and affairs o f
769769 the Commission. A commissioner shall vote in person or by other
770770 means as provided for in the byla ws. The bylaws may provide for

822822 commissioners’ participation in meetings by telephone or other means
823823 of communication.
824824 4. The Commission shall meet at leas t once during each calendar
825825 year. Additional meetings shall be held as set forth in th e bylaws.
826826 5. The Commission shall establish by rule a term of office for
827827 commissioners.
828828 C. The Commission shall have the following powers and duties:
829829 1. Establish a code of ethics for the Commission;
830830 2. Establish the fiscal year of the Commission;
831831 3. Establish bylaws for the Commission;
832832 4. Maintain its financial records in accordance with the bylaws
833833 of the Commission;
834834 5. Meet and take such actions as are consistent with the
835835 provisions of the Interstate Teacher Mobility Compact, the bylaws,
836836 and the rules of the Commission;
837837 6. Promulgate uniform rules to implement and administer the
838838 Interstate Teacher Mobility Compact. The rules shall have the force
839839 and effect of law and shall be binding on all member states. In the
840840 event the Commission e xercises its rule-making authority in a manner
841841 that is beyond the scope of the purposes of the compact or the
842842 powers thereunder, then such action by the Commission shall be
843843 invalid and shall have no force and effect of law;
844844 7. Bring and prosecute legal proceedings or actions in the name
845845 of the Commission, provided tha t the standing of any member state

897897 licensing authority to sue or be sued under applicable law shall not
898898 be affected;
899899 8. Purchase and maintain insurance bonds;
900900 9. Borrow, accept, or contract for services of personnel
901901 including but not limited to em ployees of a member state or an
902902 associated non-governmental organization that is open to membership
903903 by all states;
904904 10. Hire employees, elect or appoint officers, fix
905905 compensation, define duties, gran t individuals appropriate authority
906906 to carry out the purposes of the Interstate Teacher Mobility
907907 Compact, and establish the Commission’s personnel policies and
908908 programs relating to conflicts of interest, qualifications for
909909 personnel, and other related personnel m atters;
910910 11. Lease, purchase, accept appropriate gifts or donations, or
911911 otherwise own, hold, improve, or use any real, personal, or mixed
912912 property, provided that at all tim es the Commission shall avoid any
913913 appearance of impropriety;
914914 12. Sell, convey, mortgage, pledge, lease, e xchange, abandon,
915915 or otherwise dispose of any real, person al, or mixed property ;
916916 13. Establish a budget and make expenditures;
917917 14. Borrow money;
918918 15. Appoint committees, including standing commi ttees comprised
919919 of members and other interested persons as may be designated in the
920920 Interstate Teacher Mobility Compact or Commission rules or bylaws;

972972 16. Provide and receive information from and cooperate with law
973973 enforcement agencies;
974974 17. Establish and elect an executive committee;
975975 18. Establish and develop a charter for an executive
976976 information governance committee to advise on facilitating exchan ge
977977 of information, use of information, data privacy, and tech nical
978978 support needs and provide reports as needed;
979979 19. Perform such other functions as may be necessary or
980980 appropriate to achieve the purposes of the Interstate Teacher
981981 Mobility Compact consistent with the state regulation of teacher
982982 licensure; and
983983 20. Determine whether a state’s adopted language is materially
984984 different from the model compact language in such a way that the
985985 state would not qualify for participa tion in the Interstate Teacher
986986 Mobility Compact.
987987 D. The executive committee of the Interstate Teacher Mobility
988988 Compact shall have the power to act on behalf of the Commission
989989 according to the terms of the compact.
990990 1. The executive committee shall be comprised of eight (8)
991991 voting members including:
992992 a. the Commission chair, vice chair, and treasurer , and
993993 b. five members who are elected by the Commission from
994994 its membership including:

10611061 b. ensure Commission administration serv ices are

12061206 6. If a meeting or portion of a meeti ng is closed pursuant to
12071207 the provisions of paragraph 5 of this subsection, the Commission ’s

12101210 7. The Commission shall keep minutes of the Commission meetings
12111211 and shall provide a full and accurate summary of actions taken and
12121212 the reasons for the acti ons including a description of the views

12141214 shall be identified in the minu tes. All minutes and documents of a
12151215 closed meeting shall remain under seal, subject to rele ase by a

12691269 E. 1. The Commission shall pay or provide for the payment of
12701270 the reasonable expenses of its establishment, organization, a nd

12721272 2. The Commission may accept all appropriate donations and
12731273 grants of money, equipment , supplies, materials, and services and
12741274 receive, utilize, and dispose of the same, provided that at all
12751275 times the Commission shall avoid any appearance of impropriety or
12761276 conflict of interest.
12771277 3. The Commission may levy on and collect an annual assessment
12781278 from each member state or impose fees on other parties to cover the
12791279 cost of the operations and a ctivities of the Commission, in
12801280 accordance with Commission rules.
12811281 4. The Commission shall not incur obligations of an y kind prior
12821282 to securing the funds adequate to meet the same , nor shall the
12831283 Commission pledge the credit of any of the member states, exce pt by
12841284 and with the authority of the member state.
12851285 5. The Commission shall kee p accurate accounts of all receipts
12861286 and disbursements. The receipts and disbursements of the Commission
12871287 shall be subject to accounting procedures established under
12881288 Commission bylaws. All receipts and disbursements of funds of the
12891289 Commission shall be reviewed annually in accordance with Commiss ion
12901290 bylaws, and a report of the review shall be included in and become
12911291 part of the annual report of the Co mmission.

13431343 F. 1. The members, officers, executive director, employees,
13441344 and representatives of the Commission shall be immune from suit and
13451345 liability, either personally or in their official capacity, for any
13461346 claim for damage to or lo ss of property or perso nal injury or other
13471347 civil liability caused by or arising out of any actual or alleg ed
13481348 act, error, or omission that occurred, or that the person against
13491349 whom the claim is made had a re asonable basis for believing occurred
13501350 within the scope of Commission empl oyment, duties, or
13511351 responsibilities. Provided, however, nothing in this par agraph
13521352 shall be construed to protect any such person from suit or liabilit y
13531353 for any damage, loss, injury, or liability caused by the

14181418 3. The Commission shall indemnify and hold harmless any member,

14301430 Mobility Compact. Rules and amendments shall be come binding as of
14311431 the date specified in each rule or amendment.
14321432 2. The Commission shall promulgate reasonable rules to achieve
14331433 the intent and purpose of the Interstate Teacher Mobility Compact.
14341434 In the event the Commission exercises its rule-making authority in a
14351435 manner that is beyond the purpose and intent of the Interstate
14361436 Teacher Mobility Compact or the powers granted thereunder, such
14371437 action by the Commission shall be invalid and ha ve no force and
14381438 effect of law in the member states.
14391439 3. If a majority of the legis latures of the member states
14401440 rejects a rule by enactment of a statute or resolution in the same
14411441 manner used to adopt the Interstate Teacher Mobility Compact within

14981498 5. Upon determination that an emergency exists, the C ommission
14991499 may consider and adopt an emergency rule within forty -eight (48)
15001500 hours’ notice with opportunity to comment, provided tha t the usual
15011501 rule-making procedures shall be retroactively applied to the ru le as
15021502 soon as reasonably possible and in no event l ater than ninety (90)
15031503 days after the effectiv e date of the rule. F or purposes of this
15041504 paragraph, an emergency rule is one that must be adopted immediately
15051505 in order to:
15061506 a. meet an imminent threat to public health, safety, or
15071507 welfare,
15081508 b. prevent a loss of Commission or member state funds,
15091509 c. meet a deadline for the promulgation of an
15101510 administrative rule that is established by feder al law
15111511 or rule, or
15121512 d. protect public health and safety.
15131513 H. 1. The Commission shall provide for facilitating the
15141514 exchange of information to administ er and implement the provisions
15151515 of the Interstate Teacher Mobility Compact in accordance with

15691569 2. Nothing in the Interstate Teacher Mobility Compact shall be
15701570 deemed or construed to alter, limit, or inhibit the power of a
15711571 member state to control and maintain ownership of its licensee
15721572 information or alter, limit, or inhibit the laws or regulations
15731573 governing licensee information in the member state.
15741574 I. 1. The executive and judicial branches of state government
15751575 in each member state shall enforce the Interstate Teacher Mobility
15761576 Compact and take all actions necessar y and appropriate to effectuate
15771577 the compact’s purposes and intent. The provisions of the compact
15781578 shall have standing as statutory law.
15791579 2. Venue is proper and judicial proceedings by or against the
15801580 Commission shall be brought solely and exclusively in a c ourt of
15811581 competent jurisdiction where the princip al office of the Commission
15821582 is located. The Commis sion may waive venue and jurisdictio nal
15831583 defenses to the extent it adopts or consents to participate in
15841584 alternative dispute resolution proceedings. Nothing h erein shall
15851585 affect or limit the selection or pro priety of venue in any action
15861586 against a licensee fo r professional malpractice, misconduct, or any
15871587 similar matter.
15881588 3. All courts and administrative agencies shall take judicial
15891589 notice of the Interstate Teacher Mobility Compact, the rules of the
15901590 Commission, and any information provided to a member state pur suant

16451645 4. The Commission shall be entitled to receive service of
16461646 process in any proceeding regarding the enf orcement or
16471647 interpretation of the Interstate Teacher Mobility Compact and shall
16481648 have standing to intervene in a proceeding for all purposes.
16491649 Failure to provide the Commission service of process sh all render a
16501650 judgement or order void as to the Commission, the Interstate Teacher
16511651 Mobility Compact, or rules of the Commission.
16521652 J. 1. If the Commission determines that a member state has
16531653 defaulted in the performance of its obligations or responsibilities
16541654 under the Interstate Teacher Mobility Compact or Commission rules,
16551655 the Commission shall:
16561656 a. provide written notice to the defaulting stat e and
16571657 other member states of the nature of the default, the
16581658 proposed means of curing the default, or any other
16591659 action to be taken by the Commission, and
16601660 b. provide remedial training and specific technical
16611661 assistance regarding the default.
16621662 2. If a state in default fails to c ure the default, the
16631663 defaulting state may be terminated from the Interstate Teacher
16641664 Mobility Compact upon an affirmative vote of a majority of the
16651665 commissioners of the member states, and all rights, privileges, and

17211721 3. Termination of member ship in the Interstate Teacher Mobility
17221722 Compact shall be imposed only after all other means of securing
17231723 compliance have been ex hausted. Notice of intent to suspend or
17241724 terminate shall be gi ven by the Commission to the governor, the
17251725 majority and minority leaders of the defaulting state’s legislature,
17261726 the state licensing authority, and each of the mem ber states.
17271727 4. A state that has been terminated is responsible for all
17281728 assessments, obligatio ns, and liabilities incurred through the
17291729 effective date of termination including al l obligations that exte nd
17301730 beyond the effective date of termination.
17311731 5. The Commission shall not bear any costs related to a state
17321732 that is found to be in default or that has been terminated from the
17331733 Interstate Teacher Mobility Compact , unless agreed upon i n writing
17341734 between the Commission and the defaulting sta te.
17351735 6. The defaulting s tate may appeal the action of the Commission
17361736 by petitioning the U.S. District Court for the Di strict of Columbia
17371737 or the federal district court where the Commission has its princ ipal
17381738 offices. The prevailing party shall be awarded all costs of
17391739 litigation including reasonable attorney fees.

17921792 to resolve disputes related to the Interstate Teacher Mobility
17931793 Compact that arise among member stat es and between member states and
17941794 non-member states. The Commission shall promulgate a rule providing
17951795 for both binding and non-binding alternative dispute resolution for
17961796 disputes as appropriate.
17971797 8. The Commission, in the reasonable exercise of its
17981798 discretion, shall enforce the provisions and rules of the Interstate
17991799 Teacher Mobility Compact. By majority vote, th e Commission may
18001800 initiate legal action in the U.S. District Court for the District of
18011801 Columbia or the federal district where the Commission has its
18021802 principal offices against a member state in default to en force
18031803 compliance with the provisions of the compact and the Commission’s
18041804 promulgated rules and bylaws. The relief sought may include both
18051805 injunctive relief and damages. In t he event judicial enfor cement is
18061806 necessary, the prevailing party shall be awarded all costs of
18071807 litigation including reason able attorney fees. The remedies shall
18081808 not be exclusive of remedies of the Commission. The Commission may
18091809 pursue any other remedies available under feder al or state law.
18101810 K. The Interstate Teacher Mobility Compact shall be in effect
18111811 on the date on which the compact is enacted into law in the tenth
18121812 member state.
18131813 1. On or after the effective date of the compact, the
18141814 Commission shall convene and review the enactment of the compact by

18681868 2. A member state whose enactment is found to be materially

18711871 3. Member states enacting the compact subsequent to the
18721872 effective date shall be subject to the process set forth in
18731873 paragraph 20 of subsection C of this section to determine i f the
18741874 enactments are materially different from the mod el compact statute
18751875 and whether they qualify for participa tion in the compact.
18761876 4. If any member state is later found to be in default or is
18771877 terminated or withdraws from the compac t, the Commission shall
18781878 remain in existence and the compact shall remain in effect even if
18791879 the number of member states is fewer th an ten (10).
18801880 5. Any state that joins the compact after the Commission ’s
18811881 initial adoption of the rules and bylaws shall be su bject to the
18821882 rules and bylaws as they exist on the date on which the compact
18831883 becomes law in the state. Any rule that has been previous ly adopted
18841884 by the Commission shall hav e the full force and effect of law on the
18851885 day the compact becomes law in the state, as the rules and bylaws
18861886 may be amended as provided for in the Interstate Teacher Mobility
18871887 Compact.
18881888 6. Any member state may withdraw from the Interstate Teacher
18891889 Mobility Compact by enacting a statute repealing the compact. A

19411941 member state’s withdrawal shall not take effect unti l six (6) months
19421942 after enactment of the repealing statute. Withdrawal shall not
19431943 affect the continuing requireme nt of the withdrawing state’s
19441944 licensing authority to comply with the investigative and adverse
19451945 action reporting requirements of the compact prior to the effective
19461946 date of withdrawal.
19471947 7. The Interstate Teacher Mobility Compact may be amended by
19481948 the member states; provided, however, that no ame ndment to the
19491949 compact shall become effective and binding upon any member state
19501950 until it is enacted into law by all member states.
19511951 L. The Interstate Teacher Mobility Compact shall be liberally
19521952 construed to effectuate its purposes. The provisions of the co mpact
19531953 shall be severable, and if any phrase, clause, sentence, or
19541954 provision of the compact is declared to be contrary to the
19551955 constitution of any member state or a sta te seeking membership in
19561956 the compact or of the U. S. Constitution or the applicability ther eof
19571957 to any other government, agency, person, or circumstance is held
19581958 invalid, the validity of the remainde r of the compact and the
19591959 applicability thereof to any govern ment, agency, person, or
19601960 circumstance shall not be a ffected. If the compact is held contr ary
19611961 to the constitution of any member state, the compact shall remain in
19621962 full force and effect as to the r emaining member states and in full
19631963 force and effect as to th e member state affected as to all severable
19641964 matters.

20162016 M. Nothing in this act shall prevent or inhibit the enforcement
20172017 of any other law of a member state that is not inconsistent with the
20182018 Interstate Teacher Mobility Compact . Any laws, statutes,
20192019 regulations, or other legal requirements in a member state in
20202020 conflict with the compact are superseded to the extent of the
20212021 conflict. All permissible agreements between the Commission and the
20222022 member states are binding in accordance with their terms.
20232023 SECTION 3. This act shall become effective July 1, 2023.
20242024 SECTION 4. It being immediately necessary for the preservation
20252025 of the public peace, health , or safety, an emergency is he reby
20262026 declared to exist, by reason whereof thi s act shall take effect and
20272027 be in full force from and after its pas sage and approval.
