47 | 48 | | SECTION 1. AMENDATORY 85A O.S. 2021, Section 69, is |

---|
50 | 51 | | 1. A claim for benefits under this act, other than a n |
---|
51 | 52 | | occupational disease, shall be barred unless it is filed with the |
---|
52 | 53 | | Workers’ Compensation Commissi on within one (1) year from the date |
---|
53 | 54 | | of the injury or, if the employee ha s received benefits under this |
---|
54 | 55 | | title for the injury, six (6) months from the date of the last |
---|
55 | 56 | | issuance of such benefits. For purposes of this section, the date |

102 | 104 | | years from the date the condition is made known to an |

103 | 105 | | employee following exam ination and diagnosis by a |

144 | 147 | | B. Failure to File. Failure to file a claim within the period |
---|
145 | 148 | | prescribed in subsection A of this section shall not be a bar to the |
---|
146 | 149 | | right to benefits hereunder unless objection to the failure is made |
---|
147 | 150 | | at the first hearing on the claim in which all parties in inter est |
---|
148 | 151 | | have been given a reasonable notice and opportunity to be h eard by |
---|
149 | 152 | | the Commission. |
---|
150 | 153 | | C. Persons under Disability. |
---|
151 | 154 | | 1. Notwithstanding a ny statute of limitation provided for in |
---|
152 | 155 | | this act, when it is established that failure to file a claim by an |
---|
153 | 156 | | injured employee or his or her dependents was induced by fraud, the |
---|
154 | 157 | | claim may be filed within one (1) year from the time of the |
---|
155 | 158 | | discovery of the fraud. |
---|
156 | 159 | | 2. Subsection A of this section shall not apply to a mental |
---|
157 | 160 | | incompetent or minor so long as the person has no gu ardian or |
---|
158 | 161 | | similar legal representative. The limitations prescr ibed in |
