3963 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

4164 SECTION 1. NEW LAW A new section of law to be codified
4265 in the Oklahoma Statutes as Section 24-160 of Title 70, unless there
4366 is created a duplication in numb ering, reads as follows:

4567 A. 1. A student enrolled in a public school district, a public

5298 2. Nothing in this subsection shall limit or alter the
5399 authority of school personnel to regulate student behavior pursuant
54100 to the School Safety and Bullying Prevention Act.

56101 B. A student enrolled in an institution within The Oklahoma
57102 State System of Higher Education may wear tribal regalia during the
58103 institution’s official graduation ceremonies , whether held at a
59104 public or private lo cation.

61105 C. A school district board of education, a gover ning board of a
62106 charter school, a governing board of a technology center school , or
63107 the board of regents of an institution within The Oklahoma State
64108 System of Higher Education may adopt a policy pursuant to the
65109 provisions of this section, which may specify the characteristics of
66110 any garment, jewelry, other adorn ment, or object that the school or
67111 institution finds will endanger the s afety of a student or others or
68112 interfere with graduation ceremonies if worn by a student .

70113 D. For the purposes of this section, “tribal regalia” means
71114 traditional garments, jewelry, other adornments such as an eagle
72115 feather, an eagle plume, a beaded cap , a stole, or similar objects
73116 of cultural and religious significance worn by members of a
74117 federally recognized Indian tribe or th e tribe of another country.
75118 Tribal regalia does not include any firearm or other weapon. Tribal
76119 regalia does not include any o bject that is otherwise prohibited by

77147 federal law, except in compliance with an appropriate federal

80149 SECTION 2. This act shall become effective July 1, 2023.

82150 SECTION 3. It being immediately necessary for the preserva tion
83151 of the public peace, health , or safety, an emergency is hereby
84152 declared to exist, by r eason whereof this act shall take effect and
85153 be in full force from and after its pass age and approval.
