79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 70 O.S. 2021, Section 11 -107.1, is
81	81	amended to read as follows:
82	82	Section 11-107.1. A. Each Beginning with the 2023-2024 school
83	83	year, each school district in this state may offer a shall provide
84	84	remediation course courses for high school students who score below
85	85	a nineteen (19) on the benchmarks on subject-area portions of the
86	86	American College Testing (ACT ) exam or below an equivalent score
87	87	scores on the SAT exam in the most recent year for which student
88	88	performance data is available.

140	140	B. Remediation required by subsection A of this section may
141	141	include but is not limited to:
142	142	1. Extended instructional time during the sch ool day;
143	143	2. A summer academy;
144	144	3. Tutoring;
145	145	4. Online coursework;
146	146	5. Repetition of an y course in which the student has
147	147	demonstrated academic deficiency by scoring below the benchmarks on
148	148	subject-area portions of the ACT or SAT; or
149	149	6. Other supplementary services.
150	150	C. Nothing in subsection A of this section shall be construed
151	151	to require that a teacher providing instruc tion in the remediation
152	152	course be certified in any subjec t matter that is tested on the ACT
153	153	or SAT exam.
154	154	D. The State Board of Education may promulgate rules to
155	155	implement the provisions of this section.
156	156	SECTION 2. This act shall become effective July 1, 2023.
157	157	SECTION 3. It being immediately necessary for the pre servation
158	158	of the public peace, health or safety, an emergency is hereby
159	159	declared to exist, by reason whereof thi s act shall take effect and
160	160	be in full force from and after its passage and approval.
