7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 70 O.S. 2021, Section 11 -107.1, is
8181 amended to read as follows:
8282 Section 11-107.1. A. Each Beginning with the 2023-2024 school
8383 year, each school district in this state may offer a shall provide
8484 remediation course courses for high school students who score below
8585 a nineteen (19) on the benchmarks on subject-area portions of the
8686 American College Testing (ACT ) exam or below an equivalent score
8787 scores on the SAT exam in the most recent year for which student
8888 performance data is available.

140140 B. Remediation required by subsection A of this section may
141141 include but is not limited to:
142142 1. Extended instructional time during the sch ool day;
143143 2. A summer academy;
144144 3. Tutoring;
145145 4. Online coursework;
146146 5. Repetition of an y course in which the student has
147147 demonstrated academic deficiency by scoring below the benchmarks on
148148 subject-area portions of the ACT or SAT; or
149149 6. Other supplementary services.
150150 C. Nothing in subsection A of this section shall be construed
151151 to require that a teacher providing instruc tion in the remediation
152152 course be certified in any subjec t matter that is tested on the ACT
153153 or SAT exam.
154154 D. The State Board of Education may promulgate rules to
155155 implement the provisions of this section.
156156 SECTION 2. This act shall become effective July 1, 2023.
157157 SECTION 3. It being immediately necessary for the pre servation
158158 of the public peace, health or safety, an emergency is hereby
159159 declared to exist, by reason whereof thi s act shall take effect and
160160 be in full force from and after its passage and approval.
