AS INTRODUCED 
 
An Act relating to students; amending 70 O.S. 2021, 
Section 11-107.1, which relates to remediation 
courses for high school studen ts; requiring rather 
than allowing school districts to provide remediation 
courses for students who score below c ertain 
benchmarks on certain exams; allowing certain types 
of remediation; providing for promulgation of rules; 
providing an effective date; an d declaring an 
emergency. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     70 O.S. 2021, Section 11 -107.1, is 
amended to read as follows: 
Section 11-107.1. A.  Each Beginning with the 2023-2024 school 
year, each school district in this state may offer a shall provide 
remediation course courses for high school students who score below 
a nineteen (19) on the benchmarks on subject-area portions of the 
American College Testing (ACT ) exam or below an equivalent score 
scores on the SAT exam in the most recent year for which student 
performance data is available.

B.  Remediation required by subsection A of this section may 
include but is not limited to: 
1.  Extended instructional time during the sch ool day; 
2.  A summer academy; 
3.  Tutoring; 
4.  Online coursework; 
5.  Repetition of an y course in which the student has 
demonstrated academic deficiency by scoring below the benchmarks on 
subject-area portions of the ACT or SAT; or 
6.  Other supplementary services. 
C.  Nothing in subsection A of this section shall be construed 
to require that a teacher providing instruc tion in the remediation 
course be certified in any subjec t matter that is tested on the ACT 
or SAT exam. 
D.  The State Board of Education may promulgate rules to 
implement the provisions of this section. 
SECTION 2.  This act shall become effective July 1, 2023. 
SECTION 3.  It being immediately necessary for the pre servation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof thi s act shall take effect and 
be in full force from and after its passage and approval.
