40	170		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

42	171		SECTION 1. AMENDATORY 11 O.S. 2021, Section 49 -101, as
43	172		amended by Section 3, Chapter 232, O.S.L. 2022 (11 O.S. Supp. 202 3,
44	173		Section 49-101), is amended to read as follows:

48	174		Section 49-101. A. All retired volunteer firefighters who
49	175		qualify for retirement shall be entitled to a monthly pension. The
50	176		monthly pension of a volunteer firefighter who retires prior to the
51	177		effective date of this act shall be in the amount retired vol unteer
52	178		firefighters are receiving at the time the volunteer firef ighter

54	206		exceed thirty (30) years. Volunteer firefighters who retire on a nd
55	207		after the effective date of this act shall receive a monthly pension
56	208		in the amount of Ten Dollars ($10.00) for e ach year of credited
57	209		service not to exceed thirty (30) years. In determining the number
58	210		of years of credited service, a fractional year of s ix (6) months or
59	211		more shall be counted as one (1) full year and a fractional year of
60	212		less than six (6) months shall not be counted in such determination.
61	213		Retired volunteer firefighters of a municipality shall receive a
62	214		pension of not less than that which retired volunteer firefighters
63	215		of such municipality were receiving on June 30, 1985.

65	216		B. A volunteer firefighter wh o terminates service after
66	217		completing ten (10) years of credited service, but less than twenty
67	218		(20) years of credited service, shall be entit led to receive a
68	219		vested benefit commencing on the date the firefighter reaches fifty
69	220		(50) years of age or the date the firefighter would have had twenty
70	221		(20) years of credited service had the firefighter ’s service
71	222		continued uninterrupted, whichever is late r. The monthly amount of
72	223		such retirement benefit shall be the amount being paid to volunteer
73	224		firefighters at the t ime the member vests multiplied by the number
74	225		of years of credited service. Credited service must be established
75	226		at the time of the voluntee r firefighter’s termination. If a
76	227		volunteer firefighter who terminated employment and elected, or was
77	228		eligible to elect, a vested benefit dies prior to being eligible to
78		-	receive benefits, the volunteer firefighter ’s beneficiary, as

84	260		SECTION 2. AMENDATORY 11 O.S. 2021, Section 49 -101.2, as
85	261		amended by Section 4, Chapter 232, O.S.L. 2022 (11 O.S. Supp. 202 3,
86	262		Section 49-101.2), is amended to read as follows:

88	263		Section 49-101.2. Any member serving as an active volunteer
89	264		firefighter who receives annual com pensation from the fire

92	265		department the firefighter is enrolled in as a member of the
93	266		Oklahoma Firefighters Pension and Retirement System for services
94	267		related to firefighting, other than reimbursement of expenses in
95	268		excess of five and one-half (5 1/2) times the annual pension benefit
96	269		paid by the System to a retired volunteer firefighter with twenty
97	270		(20) years credited s ervice Nine Thousand Nine Hundred Thirty -nine
98	271		Dollars and sixty-nine cents ($9,939.69) , shall be considered a paid
99	272		firefighter and must meet the physical and agility requirements
100	273		pursuant to Section 49 -116 of this title to continue as an active
101	274		member of the System. Credited service earned as a paid firefighter
102	275		pursuant to this section shall not be considered actual experience
103	276		as a paid firefighter for purposes of meeting the qualifications o f
104	277		a paid fire chief as provided in Section 29 -102 of this title. No

109	307		SECTION 3. AMENDATORY 62 O.S. 202 1, Section 3103, as
110	308		last amended by Section 1, Chapter 306, O.S.L. 2022 (62 O.S. Supp.
111	309		2023, Section 3103), is amended to read as follows:

113	310		Section 3103. As used in the Oklahoma Pension Legis lation
114	311		Actuarial Analysis Act:

116	312		1. “Amendment” means any amendment, including a substitute
117	313		bill, made to a retirement bill by any committee of the House of
118	314		Representatives or Senate, any conference committe e of the House or
119	315		Senate or by the House or Senate;
120		-
121	316		2. “RB number” means that number preceded by the letters “RB”
122	317		assigned to a retirement bill by the respective staffs of the
123	318		Oklahoma State Senate and the Oklahoma House of Representatives when
124	319		the respective staff office prepares a retirement bill for a member
125	320		of the Legislature;

127	321		3. “Legislative Actuary” means the firm or entity that enters
128	322		into a contract with the Legislative Service Bureau pursuant to
129	323		Section 452.15 of Title 74 of the Oklahoma Statutes to provide the
130	324		actuarial services and other duties provided for in the Oklahoma
131	325		Pension Legislation Actuarial Anal ysis Act;
	326	+	4. “Nonfiscal amendment” means an amendment to a retirement

149	362		system affected by the bill,

151	363		(2) create an actuarial accrued liability for or

153	365		retirement system affected by the bill, or

155	366		(3) increase the normal cost of the retirement system

158	368		c. which authorizes the purchase by an active member of
159	369		the retirement system, at the actuarial cost for the
160	370		purchase as computed pursuant to the statute in effect
161	371		on the effective date o f the measure allowing such
162	372		purchase, of years of service for purposes of reaching
163	373		a normal retirement date in the applicable retirement
164	374		system, but which cannot be used in order to compute
165	375		the number of years of service for purposes of
166		-	computing the retirement benefit for the member,

299	610		Oklahoma, the Oklahoma Public Employees Retirement System, the
300	611		Uniform Retirement System for Justices and Judges, the Oklahoma
301	612		Firefighters Pension and Retirement System, the Oklahoma Police
302	613		Pension and Retirement System , the Oklahoma Law Enforcement
303	614		Retirement System, or a retirement system established after January
304	615		1, 2006.

308	616		SECTION 4. Sections 1 and 2 of this act shall become effective
309	617		in accordance with the provisions of Section 58 of Article V of the
310	618		Oklahoma Constitution.

315	621		SECTION 6. It being immediately necessary for the preservation
316	622		of the public peace, health or safety, an emergency is hereby
