1353+retrievable in perceivable form ;
1354+9. “Security procedure” means a procedure to verify that an
1355+electronic signature, record, or performance is that of a specific
1356+person or to detect a cha nge or error in an e lectronic record,
1357+including a procedure that uses an algorithm, code, identifying word
1358+or number, encryption, callback, or other acknowledgment procedure;
1359+10. “Settlor” means a person, including a test ator, that
1360+creates or contributes property to a trust;
1361+11. “Sign” means, with present intent to authenticate or adopt

1364+b. attach to or logically associate with the record an

1591+in the Oklahoma Statutes as Section 909 of Title 84, unless there is
1592+created a duplication in numbering, reads as follows:
1593+If the laws of this state require a signature or record to be
1594+notarized, acknowledged, verified, or made under oat h, the
1595+requirement shall be satisfied with respect to an electronic non-
1596+testamentary estate planning document if an individual authorized t o
1597+perform the notarization, acknowledgment, verification, or oath
1598+attaches or logically associates the individual ’s electronic
1599+signature on the document together with all other information
1600+required to be included under law.
1601+SECTION 38. NEW LAW A new section of law to be codified
1602+in the Oklahoma Statutes as Section 910 of Title 84, unless there is
1603+created a duplication in numb ering, reads as follows:
1604+A. If the laws of this state base the validity of a non -
1605+testamentary estate planning document on whether it is signed,
1606+witnessed, or attested by another individual, the signature,
1607+witnessing, or attesta tion of that individual may be electronic.
1608+B. For the purposes of this subsection, “electronic presence”
1609+means that two or more individuals in different locations are able
1610+to communicate in real time to the same extent as if the individuals
1611+were physically present in the same l ocation. If the laws of this
1612+state base the validity of a non -testamentary estate planning
1613+document on whether it is signed, wi tnessed, or attested by another

1641+the presence requirement shall be satisfied if the individua ls are
1642+in each other’s electronic presence.
1643+SECTION 39. NEW LAW A new section o f law to be codified
1644+in the Oklahoma Statutes as Section 911 of Title 84, unless there is
1645+created a duplication in numbering, reads as follows:
1646+A. Except as provided in subsection B of this section, if the
1647+laws of this state require an electronic non-testamentary estate
1648+planning document to be r etained, transmitted, copied, or filed, the
1649+requirement is satisfied by retaining, transmitting, copying, or
1650+filing an electronic recor d that:
1651+1. Accurately reflects the information in the document after it
1652+was first generated in final form as an electronic record or under
1653+Section 12 of this act; and
1654+2. Remains accessible to the extent required by the other law.
1655+B. A requirement under subsection A of this section to retain a
1656+record does not apply to information th e sole purpose of which is to
1657+enable the record to be sent, communicated, or received.
1658+C. A person may satisfy the requirements of subsection A of
1659+this section by using the services of another person.
1660+D. If the laws of this state require a non-testamentary estate
1661+planning document to be presented or retained in its original form
1662+or provides consequence s if a non-testamentary estate planning
1663+document is not presented or retained in its original form, an

1691+section satisfies such requirement.
1692+E. The provisions of this section do not preclude a
1693+governmental agency from specifying requirements fo r the retention
1694+of a record subject to the agency ’s jurisdiction in addition to t he
1695+requirements provided in this section. For the purposes of this
1696+section, “governmental agency” means an executive, le gislative, or
1697+judicial agency, department, board, comm ission, authority,
1698+institution, or instrumentality of the federal government or of a
1699+state or of a county, municipality, or other politic al subdivision
1700+of a state.
1701+SECTION 40. NEW LAW A new section of law to be codified
1702+in the Oklahoma Statutes as Section 912 of Title 84, unless there is
1703+created a duplication in numb ering, reads as follows:
1704+An individual may create a certified paper copy of an electronic
1705+non-testamentary estate pla nning document by affirming under penalty
1706+of perjury that the paper copy is a complete and accurate copy of
1707+the document.

1744+In applying and construing this un iform act, a court shall
1745+consider the promotion of uni formity of the law among jurisdictions
1746+that enact it.

1748+in the Oklahoma Statutes as Section 915 of Title 84, unless there is
1749+created a duplication in numb ering, reads as follows:
1750+This act modifies, limits, or supersedes the Electronic
1751+Signatures in Global and National Commerce Act , 15 U.S.C. Section
1752+7001 et seq., as amended, but does not modify, limit, or supersede
1753+15 U.S.C. Section 7001(c), or authorize electronic delivery of any
1754+of the notices described in 15 U.S.C. Section 7003(b).
1755+SECTION 44. NEW LAW A ne w section of law to be codified
1756+in the Oklahoma Statutes as Section 916 of Title 84, unless there is
1757+created a duplication in numb ering, reads as follows:
1758+This act shall apply to an electronic non -testamentary estate
1759+planning document created, signed, gene rated, sent, communicated,
1760+received, or stored prior to, on, or after the effective date of
1761+this act.
