48101 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1176, as
49102 amended by Section 4, Chapter 318, O.S.L. 2022 (21 O.S. Supp. 2022,
50103 Section 1176), is amended to read as fo llows:

52104 Section 1176. A. Whoever, with the intent to threaten,
53105 intimidate or harass, or facilitate another to threaten, intimidate
54106 or harass, uses an electronic communication device to knowingly
55107 publish, post or otherwise make publicly available personall y
56108 identifiable information of a peace officer, public official,
57109 election official, or crime victim, and as a result places that
58110 peace officer, public official, election official, or crime victim
59111 in reasonable fear o f death or serious bodily injury shall, upon
60112 conviction, be guilty of a misdemeanor punishable by imprisonment in
61113 the county jail for a term not to exceed six (6) months, or by a
62114 fine not to exceed One Thousand Dollars ($1,000.00), or by both such
63115 fine and imprisonment. Upon conviction for a second or subsequent
64116 violation, the person sha ll be punished by imprisonmen t in the
65117 county jail for a term not to exceed one (1) year, or by a fine not
66118 to exceed Two Thousand Dollars ($2,000.00), or by both such fine and
67119 imprisonment.

69120 B. As used in this section:

71121 1. “Crime victim” shall have the same meaning as that term is
72122 defined in Section 142A-1 of this title;

74123 2. “Election official” means a member or employee of the State

76152 State Election Board or a county election board, or a person serving
77153 as a precinct official or absentee voting board member appointed as

95165 which can identify an individual including, but not limited to,
96166 name, birth date, place of birth, moth er’s maiden name, biometric
97167 records, Social Security number, official state- or government-
98168 issued driver license or identification number, government passport
99169 number, employer or taxpayer identification number , or any other
100170 information that is linked or li nkable to an individual, such as
101171 medical, educational, financial or employment information;

103172 6. 7. “Public official” means any person elected or appointed
104173 to a state office in the executive, legislative, or judicial branch
105174 of state government or other poli tical subdivision of the state; and

114207 Section 4-115.2. A. 1. The Secretary of the State Election
115208 Board is authorized to promulgate rules to ke ep confidential the
116209 residence and mailing address, upon application to do so, of
117210 individual registered voters who are members of ce rtain classes as
118211 described in paragraph 2 of this subsectio n. These classes

121213 attorneys, assistant district att orneys, Uniformed Services members,
122214 law enforcement personnel and the immediate family of law

139255 a certified Address Confidentiality P rogram participant shall be
140256 released by election officials to any person for any purpose exce pt
141257 under court order.

143258 B. As used in this section, “immediate family of law
144259 enforcement personnel ” means a spouse, child by birth or adoption,
145260 stepchild or parent living at the same residence as the law
146261 enforcement personnel.

148262 SECTION 3. AMENDATORY 26 O.S. 2021, Section 16 -109, is
149263 amended to read as follows:

151264 Section 16-109. A. Any person who, by means of coercion,
152265 providing false or mislea ding information or any other method,
153266 knowingly attempts to preven t a qualified elector from becoming
154267 registered, or a registered voter from v oting, shall be deemed
155268 guilty of a felony.

157269 B. Any person who, directly or indirectly, utters or addresses
158270 any threat or intimidation to any election official with intent to
159271 improperly influence an election shall be deemed guilty of a
160272 misdemeanor punishable by a fine not to exceed One Thou sand Dollars
161273 ($1,000.00) or by imprisonment in the county jail for a term not to
162274 exceed six (6) months, or by both such fine and imprisonment .

167304 Section 16-113. A. Any person, including a lawfully appointed
168305 watcher or exit pollster, who interferes with a registered voter wh o
169306 is attempting to vote, or any person who attempts to influence the
170307 vote of another by means of force or i ntimidation, or any pers on who
171308 interferes with the orderly and lawful conduct of an election shall
172309 be deemed guilty of a misdemeanor.

190322 hardware, software, appl ication, network or any part of an election
