	65	+	An Act relating to public display of lewd ac ts;
	66	+	defining terms; prohibiting lewd acts or obscene
	67	+	material in public p lace; prohibiting certain actions
	68	+	in public place; creating felony offense for
	69	+	intentional display of lewd acts or obscene material
	70	+	to minor; authorizing certain cause of action;
	71	+	providing for codification; and providing an
	72	+	effective date.

45	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
46	78		SECTION 1. NEW LAW A new section of law to be codified
47	79		in the Oklahoma Statutes as Section 1024.6 of Title 21, unless there
48	80		is created a duplication i n numbering, reads as follows:
49	81		A. For the purposes of this act:
50	82		1. “Lewd acts” means any sexual behavior imitating sex or
51	83		sexual acts, groping, indecent exposure of genita lia or sexual
52	84		paraphernalia, display of replicas of genitalia, sexually touching
53	85		oneself or someone else, or convincing or forcing som eone else to
54		-	sexually touch or observe sexual behavior ;

55	87		2. “Obscene material” shall have the meaning as provided in
56		-	subsection B of Section 1024.1 of Title 21 of the Oklahoma Statutes;

58		-	3. “Public place” means any area or space that the gen eral
59		-	public may freely access and may participate or take part in any
60		-	event without payment for admission .

88	140		B. No political subdivision of this state shall allow or permit
89	141		a public display of lewd acts or obscene material in a public place
90	142		including but not limited to parades, shows, concerts, plays, or any
91	143		other activity where a minor could witness such lewd acts or obscene
92	144		material. No individual shall be allowed to show lewd acts or
93	145		obscene material in a public place where any other individual could
94	146		witness such lewd acts or obs cene material.
95	147		C. Any individual intentionally displaying lewd acts or obscene
96	148		material in front of a minor shall be guilty of a felony. Any
97	149		person may have a cause of action against such individual w ho
98	150		intentionally commits such acts in any manner in which a min or was
99	151		exposed to the lewd act or obscene material, or an individual was
100	152		unwillingly exposed to the lewd act or obscene material.
101	153		SECTION 2. This act shall become effective November 1, 2023.
