3360 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:

3561 SECTION 1. AMENDATORY 64 O.S. 2021, Section 1093, is
3662 amended to read as follows:

3863 Section 1093. A. The Commissioners of the Land Office are
3964 hereby authorized to make and promulgate appropriate rules and
4065 regulations for the purpose of carrying into effect the provisions
4166 of this act Sections 1090 through 1095 of this title . Any

4293 rulemaking by the Commissioners of the Land Office shall be in
4394 accordance with the provisions of the Administrative Procedures Act.

4595 B. Prior to the action of the Commissioners of the Land Office
4696 to promulgate rules pursuant to the Administrative Procedures Act,

4997 the Commissioners shall hold an additional hearing on the proposed
5098 rulemaking action in accordance with the provisions of Section 303
5199 of Title 75 of the Oklahoma Statutes. Not less than thirty (30)
52100 days prior to the scheduled hearing date, the Commissioners shall
53101 mail a copy of the hearing notice directly to all current lessees
54102 leasing land or minerals from the Commissioners at the time the
55103 rulemaking action is proposed. Notice shall be mailed via United
56104 States mail to the last known address of each current lessee shown
57105 in the records of the Commissioners or email if successfully
58106 delivered to a current and valid email address for th e lessee that
59107 is kept on file by the Commissioners. Any finding of noncompliance
60108 with this subsection shall not invalidate the o therwise proper
61109 promulgation of rules by the Commissioners.

63110 C. In regard to any existing rule of the Office, t he
64111 Commissioners of the Land Office shall publish any interpretations
65112 of those rules in “The Oklahoma Register ” within thirty (30)
66113 calendar days. The Commissioners shall also mail direct notice of
67114 publication of the interpretation to all persons currently leasing
68115 land or minerals from the Commissioners of the Land Office at the
69116 time the interpretation is adopted. Notice shall be mailed via

70143 United States mail to the last known address of each current lessee
71144 shown in the records of the Commissioners or email if successfully
72145 delivered to a current and valid email address for the lessee that
73146 is kept on file by the Commissioners. The Commissioners shall make
74147 the interpretation available for public inspection at the office of
75148 the Commissioners and on its website.

77149 D. No interpretation of existing rules by the Commissioners of
78150 the Land Office shall be binding on any person affected by the
79151 interpretation unless the publication and notice requirements of
80152 subsection C of this section have been met.

82153 SECTION 2. This act shall become effective July 1, 2024.

84154 SECTION 3. It being immediately necessary for the preservation
85155 of the public peace, health or safety, an emergency is hereby
86156 declared to exist, by reason whereof this act shall take effect and
87157 be in full force from and after it s passage and approval.
