33	60		BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:

35	61		SECTION 1. AMENDATORY 64 O.S. 2021, Section 1093, is
36	62		amended to read as follows:

38	63		Section 1093. A. The Commissioners of the Land Office are
39	64		hereby authorized to make and promulgate appropriate rules and
40	65		regulations for the purpose of carrying into effect the provisions
41	66		of this act Sections 1090 through 1095 of this title . Any

42	93		rulemaking by the Commissioners of the Land Office shall be in
43	94		accordance with the provisions of the Administrative Procedures Act.

45	95		B. Prior to the action of the Commissioners of the Land Office
46	96		to promulgate rules pursuant to the Administrative Procedures Act,
47		-

49	97		the Commissioners shall hold an additional hearing on the proposed
50	98		rulemaking action in accordance with the provisions of Section 303
51	99		of Title 75 of the Oklahoma Statutes. Not less than thirty (30)
52	100		days prior to the scheduled hearing date, the Commissioners shall
53	101		mail a copy of the hearing notice directly to all current lessees
54	102		leasing land or minerals from the Commissioners at the time the
55	103		rulemaking action is proposed. Notice shall be mailed via United
56	104		States mail to the last known address of each current lessee shown
57	105		in the records of the Commissioners or email if successfully
58	106		delivered to a current and valid email address for th e lessee that
59	107		is kept on file by the Commissioners. Any finding of noncompliance
60	108		with this subsection shall not invalidate the o therwise proper
61	109		promulgation of rules by the Commissioners.

63	110		C. In regard to any existing rule of the Office, t he
64	111		Commissioners of the Land Office shall publish any interpretations
65	112		of those rules in “The Oklahoma Register ” within thirty (30)
66	113		calendar days. The Commissioners shall also mail direct notice of
67	114		publication of the interpretation to all persons currently leasing
68	115		land or minerals from the Commissioners of the Land Office at the
69	116		time the interpretation is adopted. Notice shall be mailed via

73	146		is kept on file by the Commissioners. The Commissioners shall make
74	147		the interpretation available for public inspection at the office of
75	148		the Commissioners and on its website.

77	149		D. No interpretation of existing rules by the Commissioners of
78	150		the Land Office shall be binding on any person affected by the
79	151		interpretation unless the publication and notice requirements of
80	152		subsection C of this section have been met.

82	153		SECTION 2. This act shall become effective July 1, 2024.

84	154		SECTION 3. It being immediately necessary for the preservation
85	155		of the public peace, health or safety, an emergency is hereby
86	156		declared to exist, by reason whereof this act shall take effect and
87	157		be in full force from and after it s passage and approval.
