30	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32	60		SECTION 1. AMENDATORY 49 O.S. 2021, Secti on 12, is
33	61		amended to read as follows:

35	62		Section 12. A. The Secretary of State may deny, refuse to
36	63		renew, or revoke a commission as a notary public f or a:
37		-
38	64		1. Conviction of any felony;

40	65		2. Failure to meet the qualifications and application
41	66		requirements set forth in Sections 1 and 1.1 of Title 49 of the
42	67		Oklahoma Statutes this title; or

52	99		B. Upon receipt of a final judgment from a district court in
53	100		this state or its equivalent in a foreign jur isdiction against a
54	101		notary public in this st ate for performing a false or fraudulent
55	102		notarial act, the Secre tary of State shall revoke the appointment of
56	103		the notary public.

58	104		SECTION 2. AMENDATORY 49 O.S. 2021, Section 113, is
59	105		amended to read as follows:

61	106		Section 113. A. In taking an acknowledgment, the notarial
62	107		officer must determine, e ither from personal knowledge or from
63	108		satisfactory evidence, that the person appearing before the of ficer
64	109		and making the acknowledgment is the person wh ose true signature is
65	110		on the instrument.

67	111		B. In taking a verification upon oath or affirmation, the
68	112		notarial officer must determine, either from personal knowledge or
69	113		from satisfactory evidence, that the person appearing before the
70	114		officer and making the v erification is the person whose true
71	115		signature is on the statement verified.

73	116		C. In witnessing or attest ing a signature the notarial officer
74	117		must determine, either from personal knowledge or from satisfac tory

78	147		D. In certifying or attesting a copy of a document or other
79	148		item, the notarial officer must determine that the proffered copy is
80	149		a full, true, and accu rate transcription or reproduction of that
81	150		which was copied. In the case of official record s, only the
82	151		custodian of the official records may issue an offic ial certified
83	152		copy.

85	153		E. In making or noting a protest of a negotiable instrument the
86	154		notarial officer must determine the matters set forth in Section 3 -
87	155		509 of the Uniform Commercial Code.

89	156		F. A notarial officer has satisfactory evidence that a person
90	157		is the person whose true signature is on a document if that person

93	158		is personally known to the notarial of ficer, is identified upon the
94	159		oath or affirmation of a credible witness personally known to the
95	160		notarial officer or is identified on the basis of identifica tion
96	161		documents.

98	162		G. A notarial officer who performs a notarial act pur suant to
99	163		this section without first making in good faith the required
100	164		determination of the identity of the person appearin g before the
101	165		notary shall be guilty of a misdemeanor and upon conviction be
102	166		subject to a fine not to exceed One Thousand Dollars ($1,000. 00), to
103	167		imprisonment in the county jail not to exceed ten (10) days, or both
104	168		such fine and imprisonment.
