3059 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3260 SECTION 1. AMENDATORY 49 O.S. 2021, Secti on 12, is
3361 amended to read as follows:

3562 Section 12. A. The Secretary of State may deny, refuse to
3663 renew, or revoke a commission as a notary public f or a:

54101 notary public in this st ate for performing a false or fraudulent
55102 notarial act, the Secre tary of State shall revoke the appointment of

58104 SECTION 2. AMENDATORY 49 O.S. 2021, Section 113, is
59105 amended to read as follows:

61106 Section 113. A. In taking an acknowledgment, the notarial
62107 officer must determine, e ither from personal knowledge or from
63108 satisfactory evidence, that the person appearing before the of ficer
64109 and making the acknowledgment is the person wh ose true signature is
65110 on the instrument.

67111 B. In taking a verification upon oath or affirmation, the
68112 notarial officer must determine, either from personal knowledge or
69113 from satisfactory evidence, that the person appearing before the
70114 officer and making the v erification is the person whose true
71115 signature is on the statement verified.

73116 C. In witnessing or attest ing a signature the notarial officer

78147 D. In certifying or attesting a copy of a document or other
79148 item, the notarial officer must determine that the proffered copy is
80149 a full, true, and accu rate transcription or reproduction of that
81150 which was copied. In the case of official record s, only the
82151 custodian of the official records may issue an offic ial certified
83152 copy.

85153 E. In making or noting a protest of a negotiable instrument the
86154 notarial officer must determine the matters set forth in Section 3 -
87155 509 of the Uniform Commercial Code.

89156 F. A notarial officer has satisfactory evidence that a person
90157 is the person whose true signature is on a document if that person

93158 is personally known to the notarial of ficer, is identified upon the
94159 oath or affirmation of a credible witness personally known to the
95160 notarial officer or is identified on the basis of identifica tion
96161 documents.

98162 G. A notarial officer who performs a notarial act pur suant to
99163 this section without first making in good faith the required
100164 determination of the identity of the person appearin g before the
101165 notary shall be guilty of a misdemeanor and upon conviction be
102166 subject to a fine not to exceed One Thousand Dollars ($1,000. 00), to
103167 imprisonment in the county jail not to exceed ten (10) days, or both
104168 such fine and imprisonment.

106-SECTION 3. This act shall become effective November 1, 202 4.
