2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 59 O.S. 2021, Section 46.4, is
3057 amended to read as follows:

3258 Section 46.4. There is hereby re-created, to continue until
3359 July 1, 2023 2026, in accordance with the provisions of the Oklahoma
3460 Sunset Law, a board to be known as the “Board of Governors of the
3561 Licensed Architects, Landscape Architects and Registered Commercial
3662 Interior Designers of Oklahoma ”, hereinafter referred to as the
3763 Board. The Board shall be composed of eleven (11) members includi ng
3864 six persons who are duly licensed to practi ce architecture and are
3965 in good standing in this state, two persons who are duly licensed to

4093 practice landscape architecture and are in good standing in th is
4194 state, two persons who are registered commercial interior designers
4295 and who are active and in good standing and one lay member. Each
4396 member of the Board shall be a qualified elector of this state, and
4497 the architect, landscape architect and registered commercial
4598 interior designer members shall have had five (5) years’ licensing
4699 or registration experien ce as the professional position requires in

49100 this state. Re-creation of the Board shall not alter existing
50101 staggered terms. Board members, other than the lay member, shall be
51102 appointed for a period of five (5) years thereafter; provided, that
52103 nothing herein shall affect the tenure of office of anyone who is a
53104 member of the Board on May 31, 1957 . A member may be reappointed to
54105 succeed such membership . The licensed architect, landscape
55106 architect or the register ed commercial interior designer members may
56107 be appointed by the Governor from a list of nominees submitted by
57108 respective professional societies of this state . Membership in a
58109 professional society shal l not be a prerequisite to appointment to
59110 the Board. The lay member of the Board shall be appointed by the
60111 Governor to a term coterminous with that of the Governor . The lay
61112 member shall serve at the pleasure of the Governor . Provided, the
62113 lay member may continue to serve after the expiration of the term of
63114 the member until such time as a successor is a ppointed. Vacancies
64115 which may occur in the membership of the Board shall be filled by
65116 appointment by the Governor . Each person who has been appointed to

66144 fill a vacancy shall serve for the remainder of the ter m for which
67145 the member the person shall succee d was appointed and until a
68146 successor, in turn, has been appointed and shall have qualified .
69147 Each member of the Board, before entering upon the discharge of the
70148 duties of the member, shall make and file with t he Secretary of
71149 State a written oath or affirm ation for the faithful discharge of
72150 official duties. Each member of the Board and staff shall be
73151 reimbursed for travel expenses pursuant to the State Trav el
74152 Reimbursement Act.

76153 SECTION 2. This act shall become effective July 1, 2023.

78154 SECTION 3. It being immediately necessary for the preservation
79155 of the public peace, health or safety, an emergency is hereby
80156 declared to exist, by reason whereof this act shall take effect and
81157 be in full force from and after its passage and app roval.
