77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -317, as
79	79	last amended by Section 1, Chapter 184, O.S.L. 2022 (63 O.S. Supp.
80	80	2022, Section 1-317), is amended to read as follows:
81	81	Section 1-317. A. A death certificate for each dea th which
82	82	occurs in this state shall be filed with the State Department of
83	83	Health, within three (3) days after such death.
84	84	B. The funeral director shall personally sign the death
85	85	certificate and shall be respo nsible for filing the death
86	86	certificate. If the funeral director is not available, the person
87	87	acting as such who first assumes custody of a dead body in
88	88	accordance with Sectio n 1158 of Title 21 of the Oklahoma Statutes

141	141	data shall be obtained from the next of kin or the best qualified
142	142	person or source available. The certificate shall be completed as
143	143	to personal data and delivered to the attending physician or the
144	144	medical examiner responsib le for completing the medical
145	145	certification portion of the certificate of death within twenty -four
146	146	(24) hours after the death. No later than July 1, 2012, the
147	147	personal data, and no later than July 1, 2017, the medical
148	148	certificate portion, shall be entered into the prescribed electronic
149	149	system provided by the State Registrar of Vital Statistics and the
150	150	information submitted to the State Registrar of Vital Statistics.
151	151	The resultant certificate produced by the electronic system shall be
152	152	provided to the physi cian or medical examiner for medical
153	153	certification within twenty-four (24) hours after the death.
154	154	C. The medical certification shall be completed and signed
155	155	within forty-eight (48) hours fourteen (14) calendar days after
156	156	death by the physician, physician assistant, or advanced practice
157	157	registered nurse in charge of the patient ’s care for the illness or
158	158	condition which resulted in death, except when inquiry as to the
159	159	cause of death is required by Section 938 of this title. No later
160	160	than July 1, 2017, the m edical certification portion of certificate
161	161	data shall be entered into the prescribed electronic system provided
162	162	by the State Registrar of Vital Statistics and the information
163	163	submitted to the State Registrar of Vital Statistics.

215	215	D. In the event that the physician, physician assistant, or
216	216	advanced practice registered nurse in ch arge of the patient’s care
217	217	for the illness or condition which resulted in death is not in
218	218	attendance at the time of death, the medical certification shall be
219	219	completed and signed wi thin forty-eight (48) hours fourteen (14)
220	220	calendar days after death by the physician, physician assista nt, or
221	221	advanced practice registered nurse in attendance at the time of
222	222	death, except:
223	223	1. When the patient is under hospice care at the time of death,
224	224	the medical certification may be signed by the hospic e’s medical
225	225	director; and
226	226	2. When inquiry as to the cause of death is required by Section
227	227	938 of this title.
228	228	Provided, that such certification, if signed by other than the
229	229	attending physician, physician a ssistant, or advanced practice
230	230	registered nurse, sh all note on the face the name of the attending
231	231	physician, physician assistant, or advanced practice registered
232	232	nurse and that the information shown is only as reported.
233	233	E. A certifier completing cause of death on a certificate of
234	234	death who knows that a le thal drug, overdose or other means of
235	235	assisting suicide within the meaning of Sections 3141.2 through
236	236	3141.4 of this title ca used or contributed to the death shall list
237	237	that means among the chain of events under cause of death or list it
238	238	in the box that describes how the inju ry occurred. If such means is

291	291	describes how the injury occurred, the certifier shall indicate
292	292	“suicide” as the manner of death.
293	293	F. The authority of a physician assistant t o carry out the
294	294	functions described in this section shall be governed by the
295	295	practice agreement as provided by Section 519.6 of Title 59 of the
296	296	Oklahoma Statutes.
297	297	G. Noncompliance with the requirements fo r timely completion
298	298	and signing of a medical certification as provided in this section
299	299	may be grounds for disciplinary action by the licensing board of the
300	300	physician, physician assistant, or Advanced Practice Registered
301	301	Nurse.
302	302	SECTION 2. This act shall become effective November 1, 2023.
