7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -317, as
7979 last amended by Section 1, Chapter 184, O.S.L. 2022 (63 O.S. Supp.
8080 2022, Section 1-317), is amended to read as follows:
8181 Section 1-317. A. A death certificate for each dea th which
8282 occurs in this state shall be filed with the State Department of
8383 Health, within three (3) days after such death.
8484 B. The funeral director shall personally sign the death
8585 certificate and shall be respo nsible for filing the death
8686 certificate. If the funeral director is not available, the person
8787 acting as such who first assumes custody of a dead body in
8888 accordance with Sectio n 1158 of Title 21 of the Oklahoma Statutes

140140 shall personally sign and file the d eath certificate. The personal
141141 data shall be obtained from the next of kin or the best qualified
142142 person or source available. The certificate shall be completed as
143143 to personal data and delivered to the attending physician or the
144144 medical examiner responsib le for completing the medical
145145 certification portion of the certificate of death within twenty -four
146146 (24) hours after the death. No later than July 1, 2012, the
147147 personal data, and no later than July 1, 2017, the medical
148148 certificate portion, shall be entered into the prescribed electronic
149149 system provided by the State Registrar of Vital Statistics and the
150150 information submitted to the State Registrar of Vital Statistics.
151151 The resultant certificate produced by the electronic system shall be
152152 provided to the physi cian or medical examiner for medical
153153 certification within twenty-four (24) hours after the death.
154154 C. The medical certification shall be completed and signed
155155 within forty-eight (48) hours fourteen (14) calendar days after
156156 death by the physician, physician assistant, or advanced practice
157157 registered nurse in charge of the patient ’s care for the illness or
158158 condition which resulted in death, except when inquiry as to the
159159 cause of death is required by Section 938 of this title. No later
160160 than July 1, 2017, the m edical certification portion of certificate
161161 data shall be entered into the prescribed electronic system provided
162162 by the State Registrar of Vital Statistics and the information
163163 submitted to the State Registrar of Vital Statistics.

215215 D. In the event that the physician, physician assistant, or
216216 advanced practice registered nurse in ch arge of the patient’s care
217217 for the illness or condition which resulted in death is not in
218218 attendance at the time of death, the medical certification shall be
219219 completed and signed wi thin forty-eight (48) hours fourteen (14)
220220 calendar days after death by the physician, physician assista nt, or
221221 advanced practice registered nurse in attendance at the time of
222222 death, except:
223223 1. When the patient is under hospice care at the time of death,
224224 the medical certification may be signed by the hospic e’s medical
225225 director; and
226226 2. When inquiry as to the cause of death is required by Section
227227 938 of this title.
228228 Provided, that such certification, if signed by other than the
229229 attending physician, physician a ssistant, or advanced practice
230230 registered nurse, sh all note on the face the name of the attending
231231 physician, physician assistant, or advanced practice registered
232232 nurse and that the information shown is only as reported.
233233 E. A certifier completing cause of death on a certificate of
234234 death who knows that a le thal drug, overdose or other means of
235235 assisting suicide within the meaning of Sections 3141.2 through
236236 3141.4 of this title ca used or contributed to the death shall list
237237 that means among the chain of events under cause of death or list it
238238 in the box that describes how the inju ry occurred. If such means is

290290 in the chain of events under cause of death or in the box that
291291 describes how the injury occurred, the certifier shall indicate
292292 “suicide” as the manner of death.
293293 F. The authority of a physician assistant t o carry out the
294294 functions described in this section shall be governed by the
295295 practice agreement as provided by Section 519.6 of Title 59 of the
296296 Oklahoma Statutes.
297297 G. Noncompliance with the requirements fo r timely completion
298298 and signing of a medical certification as provided in this section
299299 may be grounds for disciplinary action by the licensing board of the
300300 physician, physician assistant, or Advanced Practice Registered
301301 Nurse.
302302 SECTION 2. This act shall become effective November 1, 2023.
