75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law to be codified
77	77	in the Oklahoma Statutes as Section 6060.8b of Title 36, unless
78	78	there is created a duplication in numb ering, reads as follows:
79	79	A. For the purposes of this section:
80	80	1. “Health benefit plan” means any plan or arrangement as
81	81	defined in subsection C of Secti on 6060.4 of Title 36 of the
82	82	Oklahoma Statutes;
83	83	2. “Iatrogenic infertility ” means an impairment of fertility by
84	84	surgery, radiation, chem otherapy, or other medical t reatment for the
85	85	diagnosis of cancer; and

137	137	3. “Retrieval” means ovulation induction and pro cedure to
138	138	obtain the eggs or sperm. The term “retrieval” shall not include
139	139	subsequent storage, disposition, fertilization, and transplantation.
140	140	B. Any health benefit plan , including the Oklahoma Employees
141	141	Insurance Plan, that is offered, issued, or renew ed in this state on
142	142	or after the effective date of th is act shall provide coverage for
143	143	the retrieval of eggs or s perm in a covered person who will receive
144	144	a medically necessary treatment including but not limited to
145	145	surgery, chemotherapy, and radiation, th at has been medically
146	146	determined to cause iatrogenic infertility.
147	147	C. The coverage provided by this section shall be subject to
148	148	the same annual deductibles, copayments, or coinsu rance limits as
149	149	established for all covered benefits under the health benefit plan.
150	150	SECTION 2. This act shall be come effective January 1, 202 4.
