AS INTRODUCED 
 
An Act relating to insurance; defining terms; 
requiring coverage for retrieval in certain 
circumstances; specifying terms of coverage; 
providing for codification; and provi ding an 
effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 6060.8b of Title 36, unless 
there is created a duplication in numb ering, reads as follows: 
A.  For the purposes of this section: 
1.  “Health benefit plan” means any plan or arrangement as 
defined in subsection C of Secti on 6060.4 of Title 36 of the 
Oklahoma Statutes; 
2.  “Iatrogenic infertility ” means an impairment of fertility by 
surgery, radiation, chem otherapy, or other medical t reatment for the 
diagnosis of cancer; and

3.  “Retrieval” means ovulation induction and pro cedure to 
obtain the eggs or sperm.  The term “retrieval” shall not include 
subsequent storage, disposition, fertilization, and transplantation. 
B.  Any health benefit plan , including the Oklahoma Employees 
Insurance Plan, that is offered, issued, or renew ed in this state on 
or after the effective date of th is act shall provide coverage for 
the retrieval of eggs or s perm in a covered person who will receive 
a medically necessary treatment including but not limited to 
surgery, chemotherapy, and radiation, th at has been medically 
determined to cause iatrogenic infertility. 
C.  The coverage provided by this section shall be subject to 
the same annual deductibles, copayments, or coinsu rance limits as 
established for all covered benefits under the health benefit plan. 
SECTION 2.  This act shall be come effective January 1, 202 4.
