79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
80	80	SECTION 1. AMENDATORY 10 O.S. 2021, Section 404, is
81	81	amended to read as follows:
82	82	Section 404. A. 1. The Director of the Department of Human
83	83	Services, in consultation wit h the Oklahoma Commission on Children
84	84	and Youth, shall appoint advisory committees of represen tatives of
85	85	child care facilities and others to recommend minimum requirements
86	86	and desirable standards for promulgation by the Department Director.
87	87	2. Committee members shall be appointed for a three-year term,
88	88	with a two-consecutive-term limit. The commi ttees shall include

438	438	3. The Department shall create a Child Care Facility Peer
439	439	Review Board whose purpose shall be to participate in the
440	440	Department’s grievance process. A majority of the Board shall be
441	441	representatives of child care facilities. T he Department Director
442	442	shall promulgate rules specifying the duties of the Child Care
443	443	Facility Peer Review Board in the grievance process.
444	444	4. The advisory committee shall designate two people to serve
445	445	on the Department’s Stars Administrati ve Review Panel. At least one
446	446	designee shall be the owner or operator of a licensed child care
447	447	center.
448	448	B. Child care facilities shall not allow children to be left
449	449	alone in the care of any person under eighteen (18) years of age
450	450	without supervision or si xteen (16) years of age with supervision as
451	451	delineated by the Department’s rules promulgated by the Director .
452	452	Child care centers and family child care homes sha ll not:
453	453	1. Use soft or loose bedding, including, but not limited to,
454	454	blankets, in sleeping equipment or in sle eping areas used only for
455	455	infants;
456	456	2. Allow toys or educational devices in sleeping equipment or
457	457	in a sleeping area used only for infants; or
458	458	3. Place a child in sleeping equipment or in a sleeping area
459	459	which has not been previously approved for use as s uch by the
460	460	Department Director.

512	512	C. The Department Director shall promulgate rules establishin g
513	513	minimum requirements and desirable standards as m ay be deemed
514	514	necessary or advisable to carry out the provisions of the Oklahoma
515	515	Child Care Facilities Licensing Act.
516	516	D. Such rules shall no t be promulgated until after consultation
517	517	with the State Departme nt of Health, the State Department of
518	518	Education, the Oklahoma State Bureau of Investigation, the State
519	519	Fire Marshal, the Oklahoma Commission on Children and Youth , the
520	520	Oklahoma Department of Mental Health and Substance Abuse Services
521	521	and any other agency d eemed necessary by the Department Director.
522	522	Not less than sixty (60) days ’ notice, by regular mail, shall be
523	523	given to all current licensees before any changes ar e made in such
524	524	rules.
525	525	E. In order to improve the standards of child care, the
526	526	Department shall advise and cooperate with licensees, the governin g
527	527	bodies and staff of licensed child care facilities and assist the
528	528	staff through advice of progressive methods and procedures, and
529	529	suggestions for the improvement of services.
530	530	F. The Department may parti cipate in federal programs for child
531	531	care services, and enter into agreements or plans on behalf of the
532	532	state for that purpose, in accordance with federal laws an d
533	533	regulations.
534	534	G. If the Director establishes a ratio of toilets to children
535	535	for child care facilities, that ratio shall not be less than one

588	588	age and under shall not be counted for the purpose of such ratio.
589	589	H. Unless required by federal law or regulation, the Director
590	590	shall not require child care facilities to have any particul ar toys
591	591	or play equipment. Toys or play equipment provided by child care
592	592	facilities shall be age appro priate and shall be determined by
593	593	directors of child care facilities and master teachers. Nothing in
594	594	this subsection shall prevent the Director from pro mulgating rules
595	595	pertaining to safety requirements for toys or play equipment.
596	596	SECTION 2. This act shall become effective November 1, 2023.
