7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
8080 SECTION 1. AMENDATORY 10 O.S. 2021, Section 404, is
8181 amended to read as follows:
8282 Section 404. A. 1. The Director of the Department of Human
8383 Services, in consultation wit h the Oklahoma Commission on Children
8484 and Youth, shall appoint advisory committees of represen tatives of
8585 child care facilities and others to recommend minimum requirements
8686 and desirable standards for promulgation by the Department Director.
8787 2. Committee members shall be appointed for a three-year term,
8888 with a two-consecutive-term limit. The commi ttees shall include

142142 a. the Residential Children ’s Services subcommittee shall

144144 (1) a representative of a statewide organizati on
145145 representing children in care arrangements

148148 providing residential services to youth in state
149149 custody,
150150 (3) a recipient or former recipient of youth services
151151 for children in state cus tody,
152152 (4) a representative of a statewide organizat ion
153153 promoting adoption services,
154154 (5) a parent or guardian providing foster care to a
155155 child or children in state custody,
156156 (6) a representative from a nonpublic, long -term

438438 3. The Department shall create a Child Care Facility Peer
439439 Review Board whose purpose shall be to participate in the
440440 Department’s grievance process. A majority of the Board shall be
441441 representatives of child care facilities. T he Department Director
442442 shall promulgate rules specifying the duties of the Child Care
443443 Facility Peer Review Board in the grievance process.
444444 4. The advisory committee shall designate two people to serve
445445 on the Department’s Stars Administrati ve Review Panel. At least one
446446 designee shall be the owner or operator of a licensed child care
447447 center.
448448 B. Child care facilities shall not allow children to be left
449449 alone in the care of any person under eighteen (18) years of age
450450 without supervision or si xteen (16) years of age with supervision as
451451 delineated by the Department’s rules promulgated by the Director .
452452 Child care centers and family child care homes sha ll not:
453453 1. Use soft or loose bedding, including, but not limited to,
454454 blankets, in sleeping equipment or in sle eping areas used only for
455455 infants;
456456 2. Allow toys or educational devices in sleeping equipment or
457457 in a sleeping area used only for infants; or
458458 3. Place a child in sleeping equipment or in a sleeping area
459459 which has not been previously approved for use as s uch by the
460460 Department Director.

512512 C. The Department Director shall promulgate rules establishin g
513513 minimum requirements and desirable standards as m ay be deemed
514514 necessary or advisable to carry out the provisions of the Oklahoma
515515 Child Care Facilities Licensing Act.
516516 D. Such rules shall no t be promulgated until after consultation
517517 with the State Departme nt of Health, the State Department of
518518 Education, the Oklahoma State Bureau of Investigation, the State
519519 Fire Marshal, the Oklahoma Commission on Children and Youth , the
520520 Oklahoma Department of Mental Health and Substance Abuse Services
521521 and any other agency d eemed necessary by the Department Director.
522522 Not less than sixty (60) days ’ notice, by regular mail, shall be
523523 given to all current licensees before any changes ar e made in such
524524 rules.
525525 E. In order to improve the standards of child care, the
526526 Department shall advise and cooperate with licensees, the governin g
527527 bodies and staff of licensed child care facilities and assist the
528528 staff through advice of progressive methods and procedures, and
529529 suggestions for the improvement of services.
530530 F. The Department may parti cipate in federal programs for child
531531 care services, and enter into agreements or plans on behalf of the
532532 state for that purpose, in accordance with federal laws an d
533533 regulations.
534534 G. If the Director establishes a ratio of toilets to children
535535 for child care facilities, that ratio shall not be less than one

587587 toilet for every twenty-five children, and children two (2) years of
588588 age and under shall not be counted for the purpose of such ratio.
589589 H. Unless required by federal law or regulation, the Director
590590 shall not require child care facilities to have any particul ar toys
591591 or play equipment. Toys or play equipment provided by child care
592592 facilities shall be age appro priate and shall be determined by
593593 directors of child care facilities and master teachers. Nothing in
594594 this subsection shall prevent the Director from pro mulgating rules
595595 pertaining to safety requirements for toys or play equipment.
596596 SECTION 2. This act shall become effective November 1, 2023.
