57	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
58	51		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1051, is
59	52		amended to read as follows:
60	53		Section 1051. A. A lottery is any scheme for the disposal or
61	54		distribution of property by chance among persons wh o have paid, or
62	55		promised, or agreed to pay any valuable consideration for the chance
63	56		of obtaining such property, or a portion of it , or for any share of
64	57		or interest in such property, upon any agreement, understanding or
65	58		expectation that it is to be distrib uted or disposed of by a lot or
66	59		chance, whether called a lottery, a r affle, or a gift enterprise, or
	60	+	by whatever name the same may be known. “Valuable consideration ”
	61	+	shall be construed to mean money or goods of actual pecuniary value.

94		-	by whatever name the same may be known. “Valuable consideration ”
95		-	shall be construed to mean money or goods of actual pecuniary value.
96	88		Provided, it shall not be a violation of the lottery or g ambling
97	89		laws of this state for:
98	90		1. The Oklahoma Lottery Commission to conduct a lottery
99	91		pursuant to the provisions of the Oklahoma Education Lottery Act;
100	92		2. A bona fide resident merchant or merchants of a city or
101	93		town, acting in conjunction with the Cham ber of Commerce or
102	94		Commercial Club of this state thereof, to issue free of charge
103	95		numbered tickets on sales of merchandise, the corresponding stub of
104	96		one or more of which tickets to be drawn or chosen by lot by a
105	97		representative or representatives of the Ch amber of Commerce or of
106	98		the Commercial Club in the manner set forth on the tickets, the
107	99		numbered stub or stubs so drawn to entitle the holder of the
108	100		corresponding numbered issued ticket to a valuable prize donated by
109	101		the merchant;
110	102		3. A bona fide community chest welfare fund on a militar y post
111	103		or reservation to issue numbered tickets in conjunction with
112	104		voluntary contributions to the fund, the corresponding stub or stubs
113	105		of one or more of the tickets to be drawn by lot under the
114	106		supervision of a military co mmander, the stub or stubs so dr awn
115	107		entitling the ticket holder to a prize of some value. Pro vided,
116	108		however, that no person shall sell tickets or receive contributions
117	109		to the fund off the military reservation;
	110	+	4. a. A qualified organization to raise funds by issuing

145		-	4. a. A qualified organization to raise funds by issuing
146		-	numbered tickets in conjunction with voluntary
147	138		contributions to the qualified org anization, the
148	139		corresponding stub or stubs numbered ticket or tickets
149	140		of one or more of the tickets to be drawn by lot under
150	141		the supervision of an official of the qualified
151	142		organization, the stub or stubs corresponding numbered
152	143		ticket or tickets so drawn entitling the ticket holder
153	144		to a prize. As used in this paragraph, “qualified
154	145		organization” means:
155	146		(1) a church,
156	147		(2) a public or private school accredited by the
157	148		State Department of Education or registered by
158	149		the State Board of Education for purposes of
159	150		participating in federal programs,
160	151		(3) a student group or organization affiliated with a
161	152		public or private school qualified pur suant to
162	153		division (2) of this subparag raph,
163	154		(4) a parent-teacher association or organization
164	155		affiliated with a public or private sch ool
165	156		qualified pursuant to division (2) of this
166	157		subparagraph,
167	158		(5) fire departments,
168	159		(6) police departments,
	160	+	(7) organizations that are exempt from taxation
	161	+	pursuant to the provisions of subsectio n (c) of

196		-	(7) organizations that are exempt from taxation
197		-	pursuant to the provisions of subsectio n (c) of
198	188		Section 501 of the United States Internal Revenue
199	189		Code, as amended, 26 U.S.C., Section 501(c) et
200	190		seq., or
201	191		(8) an “organization” as such term is defined in
202	192		paragraph 20 of Sectio n 402 of Title 3A of the
203	193		Oklahoma Statutes.
204	194		b. Any raffle conducted by a qualified organization shall
205	195		be conducted by employees or members of the qualified
206	196		organization without compensation to any member or
207	197		employees of a company as sociated with or an affi liate
208	198		of the qualified organization, w hether paid or unpaid;
209	199		provided, such persons shall not be provided with
210	200		additional compensati on, incentives, or bonuses based
211	201		on the number of tickets sold. The qualified
212	202		organization shall not hire or contract with any
213	203		person or business association, co rporation,
214	204		partnership, limited partnership or limited liability
215	205		company to conduct a raffle, to sell raffle ticke ts or
216	206		to solicit contributions in connection with a raffle
217	207		on behalf of the organization;
218	208		5. The Oklahoma Department of Wildlife Conservation to conduct
219	209		controlled, draw, lo ttery or raffle hunts; or
	210	+	6. Savings promotion raffle accoun ts or programs pursu ant to
	211	+	Section 1 of this act 908 of Title 6 of th e Oklahoma Statutes.

249	238		B. If the Oklahoma Education Lotte ry Act ceases to have the
250	239		force and effect of law pursuant to Section 735 of Title 3A of the
251	240		Oklahoma Statutes, the provisions of p aragraph 3 of subsection A of
252	241		this section shall cease to ha ve the force and effect of law.
253	242		SECTION 2. This act shall become effective November 1, 2023.
