3837 An Act relating to professions and occupatio ns;
3938 amending 59 O.S. 2021, Section 475.3, which relates
4039 to the State Board of Licensure for Professional

4847 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4948 SECTION 1. AMENDATORY 59 O.S. 2021, Section 475.3, is
5049 amended to read as follo ws:
5150 Section 475.3. A. The State Board of Lic ensure for
5251 Professional Engineers and Land Surveyors is hereby re -created, to
5352 continue until July 1, 2023 2026, in accordance with the provisions
5453 of the Oklahoma Sunset Law, whose duty it shall be to administer the
5554 provisions of Section 475.1 et seq. of th is title. The Board shall
5655 consist of four professional engineers and two professional land
5756 surveyors, at least one of who m is not a professional engi neer, all
5857 of whom shall be appointed by the Governor, with t he advice and
5958 consent of the Senate. The Gove rnor shall also appoint one lay
6059 member. The professional engineers and professional land surveyors
60+shall be appointed by the Governor and shall have the qualifications
61+required by Section 475.4 of this title.

87-shall be appointed by the Governor and shall have the qualifications
88-required by Section 475. 4 of this title.
8989 B. Each member of the Board shall file with t he Secretary of
9090 State a written oath or affirmation for the faithful discharge of
9191 official duties.
9292 C. Appointments to the Board shall be in such mann er and for
9393 such period of time so that no two terms, with th e exception of the
9494 lay member, shall expire in the same year. On the expiration of the
9595 term of any member, except the lay member, the Governor shall in the
9696 manner herein provided appoint for a te rm of six (6) years a
9797 professional engineer or professional land surveyor having the
9898 qualifications requir ed in Section 475.4 of this title. The lay
9999 member of the Board shall be appointed by the Governor to a term
100100 coterminous with that of the Governor. T he lay member shall serve
101101 at the pleasure of the Governor. Provided, the lay member may
102102 continue to serve after the expiration of the member ’s term until
103103 such time as a successor is appointed. Members may be reappointed
104104 to succeed themselves. Each membe r may hold office until the
105105 expiration of the term for which appointed or until a successor has
106106 been duly appointed and has qualified. In the event of a vacancy on
107107 the Board due to resignation, death or for any cause resulting in an
108108 unexpired term, if not filled within three (3) months, the Board may
109109 appoint a provisional member to serve in the interim until the
110110 Governor acts.
111+SECTION 2. This act shall become effective July 1, 2023.

137-SECTION 2. This act shall become effective July 1, 2023.
138139 SECTION 3. It being immediately necessary for the preservation
139140 of the public peace, health or safety , an emergency is hereby
140141 declared to exist, by reason whereof this act shall take eff ect and
141142 be in full force from and after its passage and approval.
