38	37		An Act relating to professions and occupatio ns;
39	38		amending 59 O.S. 2021, Section 475.3, which relates
40	39		to the State Board of Licensure for Professional
41	40		Engineers and Land Surveyors; extending sunset date;
42	41		providing an effective date; and declaring an

48	47		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	48		SECTION 1. AMENDATORY 59 O.S. 2021, Section 475.3, is
50	49		amended to read as follo ws:
51	50		Section 475.3. A. The State Board of Lic ensure for
52	51		Professional Engineers and Land Surveyors is hereby re -created, to
53	52		continue until July 1, 2023 2026, in accordance with the provisions
54	53		of the Oklahoma Sunset Law, whose duty it shall be to administer the
55	54		provisions of Section 475.1 et seq. of th is title. The Board shall
56	55		consist of four professional engineers and two professional land
57	56		surveyors, at least one of who m is not a professional engi neer, all
58	57		of whom shall be appointed by the Governor, with t he advice and
59	58		consent of the Senate. The Gove rnor shall also appoint one lay
60	59		member. The professional engineers and professional land surveyors
	60	+	shall be appointed by the Governor and shall have the qualifications
	61	+	required by Section 475.4 of this title.

87		-	shall be appointed by the Governor and shall have the qualifications
88		-	required by Section 475. 4 of this title.
89	89		B. Each member of the Board shall file with t he Secretary of
90	90		State a written oath or affirmation for the faithful discharge of
91	91		official duties.
92	92		C. Appointments to the Board shall be in such mann er and for
93	93		such period of time so that no two terms, with th e exception of the
94	94		lay member, shall expire in the same year. On the expiration of the
95	95		term of any member, except the lay member, the Governor shall in the
96	96		manner herein provided appoint for a te rm of six (6) years a
97	97		professional engineer or professional land surveyor having the
98	98		qualifications requir ed in Section 475.4 of this title. The lay
99	99		member of the Board shall be appointed by the Governor to a term
100	100		coterminous with that of the Governor. T he lay member shall serve
101	101		at the pleasure of the Governor. Provided, the lay member may
102	102		continue to serve after the expiration of the member ’s term until
103	103		such time as a successor is appointed. Members may be reappointed
104	104		to succeed themselves. Each membe r may hold office until the
105	105		expiration of the term for which appointed or until a successor has
106	106		been duly appointed and has qualified. In the event of a vacancy on
107	107		the Board due to resignation, death or for any cause resulting in an
108	108		unexpired term, if not filled within three (3) months, the Board may
109	109		appoint a provisional member to serve in the interim until the
110	110		Governor acts.
	111	+	SECTION 2. This act shall become effective July 1, 2023.

137		-	SECTION 2. This act shall become effective July 1, 2023.
138	139		SECTION 3. It being immediately necessary for the preservation
139	140		of the public peace, health or safety , an emergency is hereby
140	141		declared to exist, by reason whereof this act shall take eff ect and
141	142		be in full force from and after its passage and approval.
