31117 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

33118 SECTION 1. AMENDATORY 11 O.S. 2021, Section 33 -204, is
34119 amended to read as follows:

36120 Section 33-204. A. The governing body of any municipality
37121 owning a lake, inside or outside of the corporate limits, or owning
38122 lands, inside or outside of the corporate limits, which adjoin and
39123 abut upon a lake or large body of water capable o f being used by a
40124 motor-propelled boat may own, construct, maintain, operate, and
41125 equip a marina, docks, and boathouses, and boats for amusement,
42126 parks, and recreational purposes. The governing body may also lease
43127 or rent to any person lots or spaces and provide permits for the
44128 construction or use of privately owned marinas, boathouses, or docks
45129 or other recreational purposes on such property for amu sement,
46130 parks, and recreational purposes pursuant to such terms as the

49131 governing body deems proper. Said The governing body may fix and
50132 collect fares, rents, tolls, or other revenues fo r the use of said

51159 such facilities, lots and spaces, and the issuance o f permits. The
52160 right of a municipality to own, construct, maintain, operate and
53161 equip said docks, boathouses, and boats marinas, and to rent or
54162 lease such facilities, spaces, and lots and the issuance of permits
55163 for the construction or use of such private ly owned marinas, docks,
56164 or boathouses for amusement, parks, and recreational purposes is
57165 hereby declared to be a public right and use. Rent and lease of
58166 such facilities, lots, and spaces shall be at fair market value.
59167 Except in cases of rentals and leas es authorized herein, said such
60168 right and facilities shall constitute a public benefit. The
61169 municipal governing body may do all things necessary and proper in
62170 its discretion pursuant to the authority granted to i t by the
63171 Constitution and laws of this stat e to further the ability of the
64172 municipality to provide for the amusement, parks, and recreational
65173 services authorized by the provisions of this section.

67174 B. Lakes and lands which adjoin and abut upon a lake owned or
68175 leased by a municipality or by a public trust of which a
69176 municipality is a beneficiary, which are dedicated for a public
70177 purpose, may also be used or leased, for fair market value, for
71178 amusement, parks, or recreation without abandoning or declaring suc h
72179 public property as surplus or unsuitable, provided the governing
73180 body of the municipality determines use of such property for
74181 amusement, parks, or recreation is a compatible contemporaneous use

75208 that is subordinate to the primary public purpose for which the lake
76209 or land was purchased or leased.

78210 C. A municipality or public trust may contract with any person,
79211 entity, or any county, state, or federal age ncy to manage and
80212 operate lakes and lands which adjoin and abut upon a lake dedicated
81213 for a public purpose or for amusement, parks, or recreation
82214 contemporaneous with a public purpose as described in this section.

84215 D. Lakes or lands which adjoin and abut upon a lake that are
85216 leased or used as provided for in this section shall not be deemed
86217 to have been declared surplus, abandoned, or unsuitable by su ch
87218 lease or use.

89-SECTION 2. This act shall become effective November 1, 2024.

294+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
295+SECTION 3. NEW LAW A n ew section of law to be codified
296+in the Oklahoma Statutes as Section 90.26 of Title 25, unless there
297+is created a duplication in numbering, reads as follows:
298+A. The standard time in Oklahoma shall be known as Central
299+Daylight Time (CDT).
300+B. This section shall not be construe d to affect the standard
301+time established by United States law governing the moveme nts of
302+common carriers engaged in interstate commerce or the t ime for

329+performance of an act by an officer or department of the United
330+States, as established by a statute, la wful order, rule, or
331+regulation of the United States or an agency thereof.
332+C. As authorized by the Uniform Time Act of 1966, as amended,
333+and notwithstanding any other provisions of law to the contrary by
334+the United States government rel ating to adoption of daylight saving
335+time by all of the states, this state elects to adopt such time and
336+elects to continue in force the terms of subsection A of th is
337+section relating to the year-round daylight standard time in
338+Oklahoma.
339+D. The adopting of daylight saving time as provided for in this
340+section may be changed by future legislative action.
341+SECTION 4. This act shall take effect only if t he United States
342+Congress amends federal law that permits states to enter upon and
343+permanently observe daylight saving time.
