3967 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

4168 SECTION 1. NEW LAW A new section of law to be codified
4269 in the Oklahoma Statutes as Section 2-401.1 of Title 43A, unless
4370 there is created a duplication i n numbering, reads as follo ws:

4598 A. As used in this section, “emergency opioid antagonist” means
4699 a drug including but not limited to naloxone that blocks the effects

49100 of opioids and that is approved by the United Sta tes Food and Drug
50101 Administration for the treat ment of an opioid overdose .

52102 B. Subject to allocation of federal funding for the purchase of
53103 emergency opioid antagonists, the Department of Mental Health and
54104 Substance Abuse Services shall provide emergency opioid antagonists
55105 to the Department of Corrections and to county jails for the purpose
56106 of implementing Section 2 of this act.
57-
58107 C. The Department of Mental Health and Substance Abuse Services
59108 shall prepare and provide an opioid overd ose education program to
60109 the Department of Corrections and to county jails for the purpose of
61110 implementing Section 2 of this act. The education program shall:

63111 1. Conform to guidelines of the Substance Abuse and Mental
64112 Health Services Administration for opioid overdose education ;
65-
66113 2. Explain the causes of an opioid overdose;
67-
68114 3. Instruct when and how to administer in accordance with
69115 medical best practices:

71116 a. life-saving rescue techniques , and
72-
73117 b. an emergency opioid antagonist;

75118 4. Explain how to contact appropriate emergency medi cal
76119 services; and

78120 5. Provide information on how to access emergency opioid

81149 SECTION 2. AMENDATORY 57 O.S. 2021, Section 4.1, is
82150 amended to read as follo ws:

84151 Section 4.1. A. In addition to other medical and health car e
85152 services required by a jail facility as may be provided by rule by
86153 the State Department of Health, the person responsible for
87154 administration for a jail shall administer medi cations according to
88155 the following:

92156 1. Prescription medications shall be provide d to the prisoner
93157 as directed by a physician o r designated medical authority. The
94158 prisoner shall be observed to ensure the prisoner takes the
95159 medication. The physician or designated medical authority shall be
96160 particularly aware through his or her trainin g of the impact of
97161 opiate or methadone withdra wal symptoms that may occur in regard to
98162 the mental and physical health of the prisoner. The physician or
99163 medical authority shal l prescribe and administer appropriate
100164 medications to the prisoner pursuant to Se ction 5-204 of Title 43A
101165 of the Oklahoma Statu tes as the medical authority deems appropriate
102166 to address those symptoms. Neither prescription nor over -the-
103167 counter medications shall be kept by a prisoner in a cell with the
104168 exception of prescribed nitroglyce rin tablets and prescription
105169 inhalers. Over-the-counter medications shall not be administered
106170 without a physician’s approval unless using prepackaged med ications;

108198 2. Medical reception information shall be recorded on a printed
109199 screening form approved by the physician or designated medical
110200 authority which shall include inquiry into:

112201 a. current illnesses and health problems including
113202 medications taken and a ny special health req uirements,
114-
115203 b. behavioral observation, including state of
116204 consciousness and mental status,
117-
118205 c. body deformities and trauma markin gs such as bruises,
119206 lesions, jaundice, and ease of body movement,
120-
121207 d. condition of skin and visible body orif ices, including
122208 infestations, and
123-
124209 e. disposition or referral of prisoners to qualified
125210 medical personnel on an emergency basis; and
126-
127211 3. For purposes of this section, “physician or other licensed
128212 medical personnel” means a psychiatrist, medical doctor, oste opathic
129213 physician, physician’s assistant, registered nurse, licensed
130214 practical nurse, emergency medica l technician at the paramedical
131215 level or clinical nurse specialist.

135216 B. 1. Subject to the provision of emergency opioid antagonists
136217 by the Department of Mental Hea lth and Substance Abuse Services
137218 under Section 1 of this act:

139219 a. the Department of Corrections, upon the discharge of
140220 an inmate from an institution within the Department
141221 who has been diagnosed with an opioid use disorder,

142249 regardless of whether tha t inmate has received
143250 treatment for the disorder, shall provide the inmate ,
144251 as the inmate leaves the institution, with two doses
145252 of an emergency opioid antagonist, and

147253 b. a county jail:

149254 (1) upon the discharge of any person who is confined
150255 in the jail pursuant to a sentence who has been
151256 diagnosed with an opioid use disorder , regardless
152257 of whether that person has received treatment for
153258 the disorder, or
154-
155259 (2) upon the discharge of any person who is confined
156260 in the jail for an offense related to possession
157261 of an opioid drug other than:
158-
159262 (a) a person who is confined in the jail
160263 pursuant to a sentence, or
161-
162264 (b) a person who is being transferred to th e
163265 custody of the Department of Co rrections,
164-
165266 shall provide the person, as the person leaves the
166267 jail, with two doses of an emergency opioid
167268 antagonist.

169269 2. Notwithstanding the provision of emergency opioid
170270 antagonists by the Department of Mental Health and Substance Ab use
171271 Services as provided by Section 1 of this act, the Department of
172272 Corrections and county jails may stock and provide emergency opioid

174301 institution or jail as described in paragraph 1 of this subse ction.

178302 3. Before the Department of Corrections or a county jail
179303 provides an emergency opioid antagonist to a n inmate or person as
180304 described in paragraph 1 or 2 of this subsection, the Department of
181305 Corrections or the jail shall ensure that the in mate or person is
182306 provided with the opioid overdose education program provided by the
183307 Department of Mental Health and Substance Abuse Services under
184308 Section 1 of this act.

186309 4. Nothing in this subsection is intended to a brogate or
187310 supersede any existing authority of the Department of Corrections or
188311 a county jail to administer an emergency opioid antagonist to a
189312 person experiencing an opioid overdose.

191313 SECTION 3. This act shall become effective November 1, 2023.
