31	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

33	60		SECTION 1. AMENDATORY 51 O.S. 2021, Section 24A.7, as
34	61		amended by Section 2, Chapter 307, O.S.L. 2 022 (51 O.S. Supp. 2022,
35	62		Section 24A.7), is amended to read as follows:

37	63		Section 24A.7. A. At the sole discretion of the public body, a
38	64		public body may keep personnel records confidential:

40	65		1. Which relate to internal personnel inv estigations including
41	66		examination and selection material for employment, hiring,
42	67		appointment, promotion, demotion, discipline or resignation; or

44	95		2. Where disclosure would constitute a clearly unwarranted
45	96		invasion of personal privacy such as employee eval uations, payroll
46	97		deductions, employment applications submitted by persons not hired

49	98		by the public body and transcripts from insti tutions of higher
50	99		education maintained in the personnel files of certified public
51	100		school employees; provided, however, that no thing in this subsection
52	101		shall be construed to exempt from disclosure the degree obtained and
53	102		the curriculum on the transcripts of certified public school
54	103		employees.

56	104		B. If a public body determines to keep a requested record
57	105		confidential pursuant to subsection A of this section, th e public
58	106		body shall notify the requestor of such de cision. A person denied
59	107		access to records may file an action pursuant to subsection B of
60	108		Section 24A.17 of this titl e. Upon hearing, the court may order the
61	109		release of the records if the court finds that the public interest
62	110		in the records outweighs the privacy interest and shall order any
63	111		redactions necessary to protect innocent parties including but not
64	112		limited to personal identifying information. The court may award a
65	113		requesting party court costs and reasonable attorney fees if it
66	114		finds that the denial of access to the records by the public body
67	115		was unreasonable.

69	116		C. All personnel records not specifically falling wit hin the
70	117		exceptions provided in subse ction A or D E of this section shall be

74	147		1. An employment application of a person who becomes a pub lic
75	148		official;

77	149		2. The gross receip ts of public funds;

79	150		3. The dates of employ ment, title or position; and

81	151		4. Any final disciplinary action resulting in loss of pay,
82	152		suspension, demotion of position or termination.

84	153		C. D. Except as may otherwise be made co nfidential by statute,
85	154		an employee of a public body shall have a right of acces s to his own
86	155		personnel file.

88	156		D. E. The home addresses, home telephone numbers, Social
89	157		Security numbers, private email addresses, and private mobile phone
90	158		numbers of current and former public employees shall not be open to

93	159		public inspection or disclosure; provided, howeve r, that nothing in
94	160		this subsection shall be construed to exempt from disclosure public
95	161		records created using a pri vate email address or private mobile
96	162		phone.

98	163		E. F. Except as otherwise required by Section 6-101.16 of Title
99	164		70 of the Oklahoma Statutes, public bodies shall keep confidential
100	165		all records created pursuant to the Oklahoma Teacher and L eader
101	166		Effectiveness Evaluation System (TLE) which identify a current or
102	167		former public employee and contain any evaluation, obs ervation or
103	168		other TLE record of such employee.
