31	58		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1290.14, is
32	59		amended to read as follows:

36	61		SAFETY AND TRAINING COURSE

38	62		A. Each applicant for a license to carry a concealed or
39	63		unconcealed handgun pursuant to the Oklahoma Self-Defense Act must
40	64		successfully complete a firearms safety and training course in this
41	65		state conducted by a register ed and approved firearms instructor as
42	66		provided by the provisions of this section or from an interactive

45	96		Enforcement Education and Training. The applicant must further
46	97		demonstrate competence an d qualification with an authorized pistol

49	98		of the type or types that the applicant desire s to carry as a
50	99		concealed or unconcealed handgun pursuant to the provisions of the
51	100		Oklahoma Self-Defense Act, except certain persons may be exempt from
52	101		such training requirement as provided by the provisions of Section
53	102		1290.15 of this title.

55	103		B. The Council on Law Enforcement Education and Training
56	104		(CLEET) shall establi sh criteria for approving firearms instructors
57	105		and interactive online firearms safety and training cour ses
58	106		available electronically via the Internet for purpos es of training
59	107		and qualifying individuals for a handgun license pursuant to the
60	108		provisions of the Oklahoma Self-Defense Act. Prior to submitting an
61	109		application for CLEET approval as a firearms instru ctor, applicants
62	110		shall attend a firearms instructor scho ol, meeting the following
63	111		minimum requirements:
64		-
65	112		1. Firearms instructor training conducted by on e of the
66	113		following entities:
67		-
68	114		a. Council on Law Enforcement Education and Training,
69		-
70	115		b. National Rifle Association,
71		-
72	116		c. Oklahoma Rifle Association,

74	117		d. federal law enforcement agencies, or

78	146		2. The course shall be at least sixteen (16) hours in l ength;

80	147		3. Upon completion of the course, the applicant shall be
81	148		qualified to provide instruction on revolvers, semiautomatic
82	149		pistols, or both; and

84	150		4. Receive a course completion certificate.

86	151		All firearms instructors sha ll be required to meet the
87	152		eligibility requirements for a handgun license as provided in
88	153		Sections 1290.9, 1290.10, and 1290.11 of this title and the
89	154		application shall be processed as provided for applicants in Section
90	155		1290.12 of this title, including the s tate and national criminal

93	156		history records search and fingerprint search. A firearms
94	157		instructor shall be required to pay a fee of One Hundred Dollars
95	158		($100.00) to the Council on Law Enforceme nt Education and Training
96	159		(CLEET) each time the person makes app lication for CLEET approval as
97	160		a firearms instructor pursuant to the provisions of the Oklahoma
98	161		Self-Defense Act. The fee shall be retained by CLEET and shall be
99	162		deposited into the Firearms I nstructors Revolving Fund. CLEET shall
100	163		promulgate the rules, fo rms and procedures necessary to imp lement
101	164		the approval of firearms instructors as authorized by the prov isions
102	165		of this subsection. CLEET shall periodically rev iew each approved
103	166		instructor during a training and qualification course to assure
104	167		compliance with the rules and course contents. A ny violation of the
105	168		rules may result in the revocation or suspension of CLEET and

106	196		Oklahoma State Bureau of Investigation appr oval. Unless the
107	197		approval has been revoked or suspended, a firearms instructor ’s
108	198		CLEET approval shall be for a term of five (5) ye ars. Beginning on
109	199		July 1, 2003, any firearms instructor who has been issued a four-
110	200		year CLEET approval shall not be eligible for the five-year approval
111	201		until the expiration of the approval previously issued. CLEET shall
112	202		be responsible for notifying all a pproved firearms instructors of
113	203		statutory and policy changes related to the Oklahoma Self-Defense
114	204		Act. A firearms instructor shall not be required to submit his or
115	205		her fingerprints for a fingerprint search when renewing a firearms
116	206		instructor’s CLEET approval.

118	207		C. 1. All firearms instructors approved by CLEET to train and
119	208		qualify individuals for a handgun license shall be requi red to apply
120	209		for registration with the Oklahoma State Bureau of Investigation
121	210		after receiving CLEET approval. All firearms instruc tors teaching
122	211		the approved course for a handgun license must display their
123	212		registration certificate during each training and qualification
124	213		course. Each approved firearms instructor shall complete a
125	214		registration form prov ided by the Bureau and shall have t he option
126	215		to pay a registration fee of either One Hundred Dollars ($1 00.00)
127	216		for a five-year registration certificate or Two H undred Dollars
128	217		($200.00) for a ten-year registration certificate to the Bureau at
129	218		the time of each application for registration, ex cept as provided in
130	219		paragraph 2 of this subsection. Registration cer tificates issued by

131	247		the Bureau shall be valid for a peri od of five (5) years or ten (10)
132	248		years from the date of issuance. The Bureau shall issue a five -year
133	249		or ten-year handgun license t o an approved firearms instructor at
134	250		the time of issuance of a regist ration certificate and no additional

137	251		fee shall be required or charged. The Bureau shall maintain a
138	252		current listing of all registered firearms instructo rs in this
139	253		state. Nothing in this paragraph shall be construed to eliminate
140	254		the requirement for registr ation and training with CLEET as provided
141	255		in subsection B of this section. Failure to r egister or be trained
142	256		as required shall result in a revocation o r suspension of the
143	257		instructor certificate by the Bureau.

145	258		2. On or after July 1, 2003, the registered Registered
146	259		instructors listed in subparagraphs a and b of this paragraph shall
147	260		not be required to renew the firearms instructor registration
148	261		certificate with the Ok lahoma State Bureau of I nvestigation at the
149	262		expiration of the registration term, provided the instructor is not
150	263		subject to any suspension or revocati on of the firearms instructor
151	264		certificate. The firearms instructor registration with the Oklahoma
152	265		State Bureau of Investigation sh all automatically renew together
153	266		with the handgun license authorized in paragraph 1 of this
154	267		subsection for an additional five -year term and no additional cos t
155	268		or fee may be charged for the following individuals:

157	269		a. an active duty law enforcement officer of this state
158	270		or any of its political subdivisions or of the federal

160	299		firearms instructor pursuant to the Oklahom a Self-
161	300		Defense Act, and

163	301		b. a retired law enforcement officer authorized to carry
164	302		a firearm pursuant to Section 1289.8 of this title who
165	303		has a valid CLEET approval as a firearms instructor
166	304		pursuant to the Oklahoma Self -Defense Act.

168	305		D. The Oklahoma State Bu reau of Investigation shall approve
169	306		registration for a firearms instructor applicant who is in full
170	307		compliance with CLEET rules regarding firearms instructors and the
171	308		provisions of subsection B of this section, if completion of the
172	309		federal fingerprint sear ch is the only reason for delay of
173	310		registration of that firearms instructor applicant. Upon receip t of
174	311		the federal fingerprint search information, if the Bureau receiv es
175	312		information which precludes the person from having a handgun
176	313		license, the Bureau shal l revoke both the registration and the
177	314		handgun license previously issued to the firearms instructor .

181	315		E. The required firearms safety and training course and the
182	316		actual demonstration of competency and qualification required of the
183	317		applicant shall be design ed and conducted in such a manner that the
184	318		course can be reasonably complet ed by the applicant with in an eight-
185	319		hour period. CLEET shall establish the course content an d
186	320		promulgate rules, procedures and forms necessary to im plement the
187	321		provisions of this s ubsection. For the training and qualification

188	349		course, an applicant may be charged a fee which shal l be determined
189	350		by the instructor or entity that is conducting the co urse. The
190	351		maximum class size shall be determined by the instructor conducting
191	352		the course; provided, however, practice shooting sessions shall not
192	353		have more than ten participating student s at one time. CLEET may
193	354		establish criteria for assistant instructor s and any other
194	355		requirements deemed necessary to conduct a safe and effective
195	356		training and qualification course. The course content shall include
196	357		a safety inspection of the firearm to be used by the applicant in
197	358		the training course; instruction on pistol handling, safety and
198	359		storage; dynamics of ammunition and firing; methods or positions fo r
199	360		firing a pistol; information about the criminal provisions of the
200	361		Oklahoma law relating to firear ms; the requirements of the Oklahoma
201	362		Self-Defense Act as it relates t o the applicant; self-defense and
202	363		the use of appropriate force; a practice shooting sess ion; and a
203	364		familiarization course. The firearms instructor shall refuse to
204	365		train or qualify any pe rson when the pistol to be used or carried by
205	366		the person is either de emed unsafe or unfit for firing or is a
206	367		weapon not authorized by the Oklahoma Self -Defense Act. The course
207	368		shall provide an opportunity for the applicant to quali fy himself or
208	369		herself on either a derringer, a revolver, a semiautomatic with a
209	370		pistol or any combination of a derringer, a revolver and a
210	371		semiautomatic pistol,; provided, no pistol shall be capable of
211	372		firing larger than .45 caliber ammunition. Any applicant who

212	400		successfully trains and qualifies himself or herself with a
213	401		semiautomatic pistol may shall be approved by the firearms
214	402		instructor on the trai ning certificate for a semiautomatic pistol, a
215	403		revolver and a derringer upon request of the applicant. Any person
216	404		who qualifies on a derringer or revolver shall not be eligible for a
217	405		semiautomatic rating until the person has demonstrated competence
218	406		and qualifications on a semiautomatic pistol. Upon successful
219	407		completion of the training and qualification course, a certificat e
220	408		of training and a certificate of competency and qualification shall
221	409		be issued to each applicant who successfully completes the cours e.
222	410		The certificate of training and certificate of competency and

225	411		qualification shall comply with the forms established by CLEET and
226	412		shall be submitted with an application for a handgun license
227	413		pursuant to the provisions of paragraph 2 of subsection A of S ection
228	414		1290.12 of this title. T he certificate of training and certificate
229	415		of competency and qualification issued to an ap plicant shall be
230	416		valid for a period of three (3) years.

232	417		F. There is hereby cr eated a revolving fund for the Council on
233	418		Law Enforcement Education and Training (CLEET) , to be designated the
234	419		“Firearms Instructors Revolving Fund ”. The fund shall be a
235	420		continuing fund, not subject to fiscal year limitations, and shall
236	421		consist of all funds received for approval of firearms instructors
237	422		for purposes of the Oklahoma Self -Defense Act. All funds received
238	423		shall be deposited to the fund. All monies accruing to the cr edit

240	452		expended by the Council on Law Enforcement Education and Trainin g,
241	453		for implementation of the tra ining and qualification course
242	454		contents, approval of firearms instructors and any other CLEET
243	455		requirement pursuant to the provisions of the Oklahoma Self -Defense
244	456		Act or as may otherwise be deemed appropriate by CLEET.
245	457		Expenditures from said the fund shall be made upon warrants issued
246	458		by the State Treasurer against claims filed as prescribed by law
247	459		with the Director of the Office of Management and Enterprise
248	460		Services for approval and payment.

250	461		G. Firearms instructors shall ke ep on file for a period of not
251	462		less than three (3) years a roster of each training class, the
252	463		safety test score of each individual , the caliber and type of the
253	464		weapon each individual used when qualify ing and whether or not each
254	465		individual successfully comp leted the training course. Fire arms
255	466		instructors shall be authorized to destroy all training documents
256	467		and records upon expiration of the three-year time period.

288	515		regular military reser ve duty who is a legal resident of this state
289	516		and who is trained and qualified in the use of handguns;

291	517		6. A person honorably discharged from active military duty,
292	518		National Guard duty or military reserves within twenty (20) years
293	519		preceding the date of the application for a handgun license pursuant
294	520		to the provisions of the Oklahoma Self-Defense Act, who is a legal
295	521		resident of this state , and who has been trained and qualified in
296	522		the use of handguns;

298	523		7. A person retired as a peace officer in good standing fr om a
299	524		law enforcement agency located in another state, who is a legal

306	556		B. No person who is determined to be exempt from training or
307	557		qualification may carry a concealed or unconcealed firearm pursuant
308	558		to the authority of the Oklahoma Self -Defense Act until issued a

311	559		valid handgun license or posses ses a valid military identification
312	560		card as provided for qualified persons in Section 12 90.8 of this
313	561		title.

315	562		C. Nothing contained in any provision of the Oklahoma Self -
316	563		Defense Act shall be construed to alter, amend, or modify the
317	564		authority of any active du ty law enforcement officer, or any person
318	565		certified by the Council on Law Enforcement Ed ucation and Training
319	566		to carry a pistol during the course of their employment, to carry
320	567		any pistol in any manner authorized by law or authorized by the
321	568		employing agency.
