55103 B. The Council on Law Enforcement Education and Training
56104 (CLEET) shall establi sh criteria for approving firearms instructors
57105 and interactive online firearms safety and training cour ses
58106 available electronically via the Internet for purpos es of training
59107 and qualifying individuals for a handgun license pursuant to the
60108 provisions of the Oklahoma Self-Defense Act. Prior to submitting an
61109 application for CLEET approval as a firearms instru ctor, applicants
62110 shall attend a firearms instructor scho ol, meeting the following
63111 minimum requirements:

78146 2. The course shall be at least sixteen (16) hours in l ength;

81148 qualified to provide instruction on revolvers, semiautomatic

86151 All firearms instructors sha ll be required to meet the
87152 eligibility requirements for a handgun license as provided in
88153 Sections 1290.9, 1290.10, and 1290.11 of this title and the
89154 application shall be processed as provided for applicants in Section

93156 history records search and fingerprint search. A firearms
94157 instructor shall be required to pay a fee of One Hundred Dollars
95158 ($100.00) to the Council on Law Enforceme nt Education and Training
96159 (CLEET) each time the person makes app lication for CLEET approval as
97160 a firearms instructor pursuant to the provisions of the Oklahoma
98161 Self-Defense Act. The fee shall be retained by CLEET and shall be
99162 deposited into the Firearms I nstructors Revolving Fund. CLEET shall
100163 promulgate the rules, fo rms and procedures necessary to imp lement
101164 the approval of firearms instructors as authorized by the prov isions
102165 of this subsection. CLEET shall periodically rev iew each approved
103166 instructor during a training and qualification course to assure
104167 compliance with the rules and course contents. A ny violation of the
105168 rules may result in the revocation or suspension of CLEET and

106196 Oklahoma State Bureau of Investigation appr oval. Unless the
107197 approval has been revoked or suspended, a firearms instructor ’s
108198 CLEET approval shall be for a term of five (5) ye ars. Beginning on
109199 July 1, 2003, any firearms instructor who has been issued a four-
110200 year CLEET approval shall not be eligible for the five-year approval
111201 until the expiration of the approval previously issued. CLEET shall
112202 be responsible for notifying all a pproved firearms instructors of
113203 statutory and policy changes related to the Oklahoma Self-Defense
114204 Act. A firearms instructor shall not be required to submit his or
115205 her fingerprints for a fingerprint search when renewing a firearms
116206 instructor’s CLEET approval.

118207 C. 1. All firearms instructors approved by CLEET to train and
119208 qualify individuals for a handgun license shall be requi red to apply
120209 for registration with the Oklahoma State Bureau of Investigation
121210 after receiving CLEET approval. All firearms instruc tors teaching
122211 the approved course for a handgun license must display their
123212 registration certificate during each training and qualification
124213 course. Each approved firearms instructor shall complete a
125214 registration form prov ided by the Bureau and shall have t he option
126215 to pay a registration fee of either One Hundred Dollars ($1 00.00)
127216 for a five-year registration certificate or Two H undred Dollars
128217 ($200.00) for a ten-year registration certificate to the Bureau at
129218 the time of each application for registration, ex cept as provided in

131247 the Bureau shall be valid for a peri od of five (5) years or ten (10)
132248 years from the date of issuance. The Bureau shall issue a five -year
133249 or ten-year handgun license t o an approved firearms instructor at
134250 the time of issuance of a regist ration certificate and no additional

137251 fee shall be required or charged. The Bureau shall maintain a
138252 current listing of all registered firearms instructo rs in this
139253 state. Nothing in this paragraph shall be construed to eliminate
140254 the requirement for registr ation and training with CLEET as provided
141255 in subsection B of this section. Failure to r egister or be trained
142256 as required shall result in a revocation o r suspension of the
143257 instructor certificate by the Bureau.

145258 2. On or after July 1, 2003, the registered Registered
146259 instructors listed in subparagraphs a and b of this paragraph shall
147260 not be required to renew the firearms instructor registration
148261 certificate with the Ok lahoma State Bureau of I nvestigation at the
149262 expiration of the registration term, provided the instructor is not
150263 subject to any suspension or revocati on of the firearms instructor
151264 certificate. The firearms instructor registration with the Oklahoma
152265 State Bureau of Investigation sh all automatically renew together
153266 with the handgun license authorized in paragraph 1 of this
154267 subsection for an additional five -year term and no additional cos t
155268 or fee may be charged for the following individuals:

157269 a. an active duty law enforcement officer of this state
158270 or any of its political subdivisions or of the federal

159298 government who has a valid CLEET approval as a
160299 firearms instructor pursuant to the Oklahom a Self-
161300 Defense Act, and

163301 b. a retired law enforcement officer authorized to carry
164302 a firearm pursuant to Section 1289.8 of this title who
165303 has a valid CLEET approval as a firearms instructor
166304 pursuant to the Oklahoma Self -Defense Act.

168305 D. The Oklahoma State Bu reau of Investigation shall approve
169306 registration for a firearms instructor applicant who is in full
170307 compliance with CLEET rules regarding firearms instructors and the
171308 provisions of subsection B of this section, if completion of the
172309 federal fingerprint sear ch is the only reason for delay of
173310 registration of that firearms instructor applicant. Upon receip t of
174311 the federal fingerprint search information, if the Bureau receiv es
175312 information which precludes the person from having a handgun
176313 license, the Bureau shal l revoke both the registration and the
177314 handgun license previously issued to the firearms instructor .

181315 E. The required firearms safety and training course and the
182316 actual demonstration of competency and qualification required of the
183317 applicant shall be design ed and conducted in such a manner that the
184318 course can be reasonably complet ed by the applicant with in an eight-
185319 hour period. CLEET shall establish the course content an d
186320 promulgate rules, procedures and forms necessary to im plement the

188349 course, an applicant may be charged a fee which shal l be determined
189350 by the instructor or entity that is conducting the co urse. The
190351 maximum class size shall be determined by the instructor conducting
191352 the course; provided, however, practice shooting sessions shall not
192353 have more than ten participating student s at one time. CLEET may
193354 establish criteria for assistant instructor s and any other
194355 requirements deemed necessary to conduct a safe and effective
195356 training and qualification course. The course content shall include
196357 a safety inspection of the firearm to be used by the applicant in
197358 the training course; instruction on pistol handling, safety and
198359 storage; dynamics of ammunition and firing; methods or positions fo r
199360 firing a pistol; information about the criminal provisions of the
200361 Oklahoma law relating to firear ms; the requirements of the Oklahoma
201362 Self-Defense Act as it relates t o the applicant; self-defense and
202363 the use of appropriate force; a practice shooting sess ion; and a
203364 familiarization course. The firearms instructor shall refuse to
204365 train or qualify any pe rson when the pistol to be used or carried by
205366 the person is either de emed unsafe or unfit for firing or is a
206367 weapon not authorized by the Oklahoma Self -Defense Act. The course
207368 shall provide an opportunity for the applicant to quali fy himself or
208369 herself on either a derringer, a revolver, a semiautomatic with a
209370 pistol or any combination of a derringer, a revolver and a
210371 semiautomatic pistol,; provided, no pistol shall be capable of
211372 firing larger than .45 caliber ammunition. Any applicant who

212400 successfully trains and qualifies himself or herself with a
213401 semiautomatic pistol may shall be approved by the firearms
214402 instructor on the trai ning certificate for a semiautomatic pistol, a
215403 revolver and a derringer upon request of the applicant. Any person
216404 who qualifies on a derringer or revolver shall not be eligible for a
217405 semiautomatic rating until the person has demonstrated competence
218406 and qualifications on a semiautomatic pistol. Upon successful
219407 completion of the training and qualification course, a certificat e
220408 of training and a certificate of competency and qualification shall
221409 be issued to each applicant who successfully completes the cours e.
222410 The certificate of training and certificate of competency and

225411 qualification shall comply with the forms established by CLEET and
226412 shall be submitted with an application for a handgun license
227413 pursuant to the provisions of paragraph 2 of subsection A of S ection
228414 1290.12 of this title. T he certificate of training and certificate
229415 of competency and qualification issued to an ap plicant shall be
230416 valid for a period of three (3) years.

232417 F. There is hereby cr eated a revolving fund for the Council on
233418 Law Enforcement Education and Training (CLEET) , to be designated the
234419 “Firearms Instructors Revolving Fund ”. The fund shall be a
235420 continuing fund, not subject to fiscal year limitations, and shall
236421 consist of all funds received for approval of firearms instructors
237422 for purposes of the Oklahoma Self -Defense Act. All funds received
238423 shall be deposited to the fund. All monies accruing to the cr edit

239451 of said the fund are hereby appropriated and may be budgeted and
240452 expended by the Council on Law Enforcement Education and Trainin g,
241453 for implementation of the tra ining and qualification course
242454 contents, approval of firearms instructors and any other CLEET
243455 requirement pursuant to the provisions of the Oklahoma Self -Defense
244456 Act or as may otherwise be deemed appropriate by CLEET.
245457 Expenditures from said the fund shall be made upon warrants issued
246458 by the State Treasurer against claims filed as prescribed by law
247459 with the Director of the Office of Management and Enterprise
248460 Services for approval and payment.

250461 G. Firearms instructors shall ke ep on file for a period of not
251462 less than three (3) years a roster of each training class, the
252463 safety test score of each individual , the caliber and type of the
253464 weapon each individual used when qualify ing and whether or not each
254465 individual successfully comp leted the training course. Fire arms
255466 instructors shall be authorized to destroy all training documents
256467 and records upon expiration of the three-year time period.

301553 the training required for CLEET certification in this state; and

303554 8. Any person who is otherwise deemed qualified for a training
304555 exemption by CLEET.

306556 B. No person who is determined to be exempt from training or
307557 qualification may carry a concealed or unconcealed firearm pursuant
308558 to the authority of the Oklahoma Self -Defense Act until issued a

312560 card as provided for qualified persons in Section 12 90.8 of this

315562 C. Nothing contained in any provision of the Oklahoma Self -
316563 Defense Act shall be construed to alter, amend, or modify the
317564 authority of any active du ty law enforcement officer, or any person
318565 certified by the Council on Law Enforcement Ed ucation and Training
319566 to carry a pistol during the course of their employment, to carry
320567 any pistol in any manner authorized by law or authorized by the
321568 employing agency.
