2957 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:

3158 SECTION 1. NEW LAW A new section of law to be codified
3259 in the Oklahoma Statutes as Section 2-225 of Title 43A, unless there
3360 is created a duplication i n numbering, reads as follows:

3561 A. As used in this section, “emergency opioid antagonist ” means
3662 a drug including but not limited to naloxone that blocks the effects
3763 of opioids and that is approved by the United States Food and Drug
3864 Administration for the treatment of an opi oid overdose.

4065 B. Within thirty (30) days of the effective date of thi s act,
4166 the Commissioner of Mental Health and Substance Abus e Services shall

4294 designate a physician, licensed in this state and in good standing,
4395 to issue a statewide standing order for emergency opioid antagonists
4496 under the provisions of this section.

4897 C. Within thirty (30) days of being designated under subsection
4998 B of this section, the physician sh all issue a standing order that:

5199 1. Authorizes any licensed pharmacist, any other health care
52100 provider licensed or certified in this state , or any mental health
53101 or substance abuse provider licensed or certified in this state to
54102 distribute emergency opioid antagonists to any person or entity
55103 within this state upon request; and

57104 2. Allows for the possession, storage, distribution, and
58105 administration of emergency opioid antagonists by any individual or
59106 entity within this state.

61107 D. The standing order issu ed under this section shall remain in
62108 effect until the United States Food and Drug Administration
63109 classifies at least one emergency opioid antagonist as an over-the-
64110 counter (OTC) drug.

66111 SECTION 2. It being immediately necessary for the preservation
67112 of the public peace, health or safety, an emergency is hereby
68113 declared to exist, by re ason whereof this act shall take effect a nd
69114 be in full force from and after its passage and approval.
