75	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76		SECTION 1. AMENDATORY 70 O.S. 2021, Section 18-201.1, is
77	77		amended to read as follows:
78	78		Section 18-201.1. A. Beginning with the 2020 -21 school year,
79	79		and each school year thereafter, the weighted me mbership of a school
80	80		district for calculation of Foundation Aid purposes pursuant to
81	81		paragraph 1 of subsection D of Section 18-200.1 of this title shall
82	82		be the sum of the weighted pupil grade level calculation, the
83	83		weighted pupil category calculation, the weighted district
84	84		calculation, and the weighted teacher experience and degree
85	85		calculation. The weighted membership of a school district for
86	86		calculation of Salary Incentive Aid purposes pursuant to paragraph 3
87	87		of subsection D of Section 18 -200.1 of this title shall be the sum

140	140		category calculation, the wei ghted district calculation , and the
141	141		weighted teacher experience and degree calculation.
142	142		B. Beginning with the 2022-2023 school year, the we ighted
143	143		calculations provided for in su bsection A of this section shall be
144	144		based on the higher weighted average daily membership of the first
145	145		nine (9) weeks of the current school year or the preceding school
146	146		year of a school district, unless otherwise speci fied. The higher
147	147		of the two (2) weigh ted average daily memberships shall be used
148	148		consistently in all of the calcula tions; however, the weighted
149	149		calculation for a statewide virtual charter school experiencing a
150	150		significant decline in membership shall be ba sed on the first nine
151	151		(9) weeks of the current school year for the statewide virtual
152	152		charter school. For purposes o f this subsection, “significant
153	153		decline in membership ” means equal to or greater than a fifteen
154	154		percent (15%) decrease in average daily memb ership from the
155	155		preceding school year to the average daily membership of the first
156	156		nine (9) weeks of the current sch ool year. The average daily
157	157		membership data used for all calculations in paragraphs 1, 2, 3 , and
158	158		4 of this subsection shall be the same as used in the calculation of
159	159		the State Aid Formula. The weighted calculations provided for in
160	160		subsection A of this se ction shall be determined as follows:
161	161		1. The weighted pupil grade level calculation shall be
162	162		determined by taking the highest average daily membership and

226	226		Multiply the membership of each subparagraph of this paragraph
227	227		by the weight assigned to such subparagraph of this paragraph and
228	228		add the totals together to determine the weighted pupil grade level
229	229		calculation for a school dist rict. Determination of the pupils
230	230		eligible for the early childhood program weight shall be pursuant to
231	231		the provisions of Section 1 -114 of this title. The pupils eligible
232	232		for the out-of-home placement pupil weight shall be stude nts who are
233	233		not residents of the school district in which they are receiving
234	234		education pursuant to the provisions of subsection D of Section 1-
235	235		113 of this title. Such weight may be claimed by the district
236	236		providing educational services to such student for the days that
237	237		student is enrolled in that district. If claimed, the out -of-home

290	290		pupil category weights for that student. Provided, if a student
291	291		resides in a juvenile detention center tha t is restricted to less
292	292		than twelve (12) beds, the out -of-home placement pupil weight for
293	293		such students shall be calculated as f ollows: for a center with six
294	294		(6) beds - 3.0; for a center with eight (8) bed s - 2.3; and for a
295	295		center with ten (10) beds - 1.80.
296	296		2. The weighted pupil ca tegory calculation shall be determined
297	297		by assigning a weight to the pupil category as follows:

371	371		approved in the school year with the highest aver age daily
372	372		membership in each category by the weight assigned to such category
373	373		and add the totals together to determine the weighted pupil ca tegory
374	374		calculation for a school distri ct. For the 1997-98 school year and
375	375		subsequent school years, the number to be multiplied by the weight
376	376		assigned to the gifted category in subparagraph g of this paragr aph
377	377		shall be the lesser of (1) the sum of the numb er of students who
378	378		scored in the top three percent (3%) on any national standardized
379	379		test of intellectual ability pl us the number of students identified
380	380		as gifted pursuant to subparagraphs a through d of pa ragraph 1 of
381	381		Section 1210.301 of this title, or (2 ) the sum of the number of
382	382		students who scored in the top three percent (3%) on any natio nal
383	383		standardized test of in tellectual ability plus eight percent (8%) of
384	384		the total average daily membership of the sc hool district for the
385	385		first nine (9) weeks of the school year.

437	437		3. The weighted district calculation shall be determined by
438	438		determining the calculations for each scho ol district for both the
439	439		small school district formula and the district sparsity - isolation
440	440		formula, applying whichever is the greater of t he calculations of
441	441		the two formulas and then applying the restrictions pursuant to
442	442		subparagraph c of this paragraph.
443	443		a. Small school district formula: 529 minus the average
444	444		daily membership divided by 529 times .2 .3 times
445	445		total average daily membership.
446	446		The small school district formula calc ulation shall apply
447	447		only to school districts whose highest average daily
448	448		membership is less than 529 pupils. School districts which
449	449		are consolidated or annexed after July 1, 2003, pursuant to
450	450		the Oklahoma School Voluntary Consolidation and Annexation
451	451		Act shall have the weighted district size calculation f or
452	452		the three (3) school yea rs following the fiscal year in
453	453		which such consolidation occurred calculated to be the sum
454	454		of the individual consolidated districts computed as if the
455	455		consolidation had not taken place. Thereafter, any such
456	456		district which is con solidated pursuant to the O klahoma
457	457		School Voluntary Consolidation and Annexation Act shall not
458	458		qualify for the weighted district calculation unless the
459	459		district can satisfy the specifications herein. Subj ect to
460	460		the provisions of subparagraph c of this par agraph, the

514	514		b. District sparsity - isolation formula:
515	515		The district sparsity - isolation formula calculatio n shall
516	516		apply only to school districts:
517	517		(1) whose total area in square miles i s greater than
518	518		the average number of square miles for all school
519	519		districts in this state; and
520	520		(2) whose areal density is less than one -fourth (1/4)
521	521		of the state average areal den sity. Areal
522	522		density shall be determined by dividin g the
523	523		school district’s average daily membership by the
524	524		school district’s total area in square miles.
525	525		The district sparsity - isolation formula calculation shall
526	526		be calculated as follows:
527	527		The school district student cost factor multiplied by
528	528		the school district area factor. The res ulting
529	529		product shall be multiplied by the school district ’s
530	530		average daily membership. Subjec t to the provisions
531	531		of subparagraph c of this p aragraph, the resulting
532	532		number shall be counted as additional students for the
533	533		purpose of calculating State Aid.
534	534		The school district student cost factor shall be calculated

662	662		The school district area cost factor shall be c alculated as
663	663		follows:
664	664		Subtract the state average district area from the
665	665		district area, then divide the remainder by the state
666	666		average district area;
667	667		however, the district area cost factor shall not exceed o ne
668	668		(1.0).
669	669		The State Board of Education shall defin e geographical barriers
670	670		whose location in a school district would inhibit the district fr om
671	671		consolidation or annexat ion. The Board shall make available an
672	672		application process, review applications, and for districts the
673	673		Board deems necessary allow addition al square miles to be used for
674	674		the purposes of calculations used for the weighted distric t sparsity
675	675		- isolation formula. Provided, that the additional square miles
676	676		allowed for geographical barriers shall not exceed thirty percent
677	677		(30%) of the district ’s actual size.
678	678		c. State Aid funds which a district is calculated to
679	679		receive as a result of t he weighted district
680	680		calculation shall be restricted as follows:
681	681		If, after the weighted distric t calculation is
682	682		applied, the district ’s projected per pupil
683	683		revenue exceeds one hundred fifty percent (150%)
684	684		of the projected state average per pupil revenue,
685	685		then the district’s State Aid shall be reduced by

747	747		revenue shall be determined by div iding the district’s
748	748		preceding year’s average daily membership (ADM) as
749	749		weighted by the pupil g rade level, the pupil category,
750	750		the district and the teacher experience degree index
751	751		calculations for projecte d State Aid into the
752	752		district’s projected total rev enues including
753	753		projected funds for the State Aid Formula for the
754	754		preceding year, net assessed valuation for the
755	755		preceding calendar year times thirty -nine (39) mills,
756	756		county revenues excluding the county f our-mills
757	757		revenues for the second preceding year, o ther state
758	758		appropriations for the preceding year , and the
759	759		collections for the preceding year of state

822	822		calculation of the current year State Aid Fo rmula, net
823	823		assessed valuation for the current calendar year times
824	824		thirty-nine (39) mills, county revenues excluding the
825	825		county four-mills revenue for the preceding year,
826	826		other state appropriations for the preceding year , and
827	827		the collections for the precedi ng year of state
828	828		apportionment, motor vehicle revenue, gross production
829	829		tax, and R.E.A. tax.
830	830		The district’s projected total revenues for each
831	831		calculation shall exclude the following co llections
832	832		for the second preceding year: federal revenue,
833	833		insurance loss payments, reimbursements, recovery of
834	834		overpayments and refunds, unused reserves, prior

890	890		index. The State Department of Educati on shall determine an index

892	892		district’s teacher personnel reports of the preceding year and
893	893		utilizing the index as follows:

963	963		SECTION 2. This act shall become effective July 1, 2023.
964	964		SECTION 3. It being immediately necessary for the preservation
965	965		of the public peace, health or safety, an emergency is hereby
966	966		declared to exist, by reason whereof this act shall take effect an d
967	967		be in full force from and after its passage and a pproval.
968	968		SECTION 4. The provisions of this act shall be contingent upon
969	969		the enactment of the provisions of Senate Bill No. 822 of the 1st
970	970		Session of the 59th Oklahoma Legislature and shal l not become
971	971		operative as law otherwise .
