7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 70 O.S. 2021, Section 18-201.1, is
7777 amended to read as follows:
7878 Section 18-201.1. A. Beginning with the 2020 -21 school year,
7979 and each school year thereafter, the weighted me mbership of a school
8080 district for calculation of Foundation Aid purposes pursuant to
8181 paragraph 1 of subsection D of Section 18-200.1 of this title shall
8282 be the sum of the weighted pupil grade level calculation, the
8383 weighted pupil category calculation, the weighted district
8484 calculation, and the weighted teacher experience and degree
8585 calculation. The weighted membership of a school district for
8686 calculation of Salary Incentive Aid purposes pursuant to paragraph 3
8787 of subsection D of Section 18 -200.1 of this title shall be the sum

140140 category calculation, the wei ghted district calculation , and the
141141 weighted teacher experience and degree calculation.
142142 B. Beginning with the 2022-2023 school year, the we ighted
143143 calculations provided for in su bsection A of this section shall be
144144 based on the higher weighted average daily membership of the first
145145 nine (9) weeks of the current school year or the preceding school
146146 year of a school district, unless otherwise speci fied. The higher
147147 of the two (2) weigh ted average daily memberships shall be used
148148 consistently in all of the calcula tions; however, the weighted
149149 calculation for a statewide virtual charter school experiencing a
150150 significant decline in membership shall be ba sed on the first nine
151151 (9) weeks of the current school year for the statewide virtual
152152 charter school. For purposes o f this subsection, “significant
153153 decline in membership ” means equal to or greater than a fifteen
154154 percent (15%) decrease in average daily memb ership from the
155155 preceding school year to the average daily membership of the first
156156 nine (9) weeks of the current sch ool year. The average daily
157157 membership data used for all calculations in paragraphs 1, 2, 3 , and
158158 4 of this subsection shall be the same as used in the calculation of
159159 the State Aid Formula. The weighted calculations provided for in
160160 subsection A of this se ction shall be determined as follows:
161161 1. The weighted pupil grade level calculation shall be

231231 the provisions of Section 1 -114 of this title. The pupils eligible
232232 for the out-of-home placement pupil weight shall be stude nts who are
233233 not residents of the school district in which they are receiving
234234 education pursuant to the provisions of subsection D of Section 1-
235235 113 of this title. Such weight may be claimed by the district
236236 providing educational services to such student for the days that
237237 student is enrolled in that district. If claimed, the out -of-home

290290 pupil category weights for that student. Provided, if a student
291291 resides in a juvenile detention center tha t is restricted to less
292292 than twelve (12) beds, the out -of-home placement pupil weight for
293293 such students shall be calculated as f ollows: for a center with six
294294 (6) beds - 3.0; for a center with eight (8) bed s - 2.3; and for a
295295 center with ten (10) beds - 1.80.

375375 subsequent school years, the number to be multiplied by the weight

377377 shall be the lesser of (1) the sum of the numb er of students who
378378 scored in the top three percent (3%) on any national standardized
379379 test of intellectual ability pl us the number of students identified
380380 as gifted pursuant to subparagraphs a through d of pa ragraph 1 of
381381 Section 1210.301 of this title, or (2 ) the sum of the number of
382382 students who scored in the top three percent (3%) on any natio nal
383383 standardized test of in tellectual ability plus eight percent (8%) of
384384 the total average daily membership of the sc hool district for the
385385 first nine (9) weeks of the school year.

437437 3. The weighted district calculation shall be determined by
438438 determining the calculations for each scho ol district for both the
439439 small school district formula and the district sparsity - isolation
440440 formula, applying whichever is the greater of t he calculations of
441441 the two formulas and then applying the restrictions pursuant to
442442 subparagraph c of this paragraph.
443443 a. Small school district formula: 529 minus the average
444444 daily membership divided by 529 times .2 .3 times
445445 total average daily membership.
446446 The small school district formula calc ulation shall apply
447447 only to school districts whose highest average daily
448448 membership is less than 529 pupils. School districts which
449449 are consolidated or annexed after July 1, 2003, pursuant to
450450 the Oklahoma School Voluntary Consolidation and Annexation
451451 Act shall have the weighted district size calculation f or
452452 the three (3) school yea rs following the fiscal year in
453453 which such consolidation occurred calculated to be the sum
454454 of the individual consolidated districts computed as if the
455455 consolidation had not taken place. Thereafter, any such
456456 district which is con solidated pursuant to the O klahoma
457457 School Voluntary Consolidation and Annexation Act shall not
458458 qualify for the weighted district calculation unless the
459459 district can satisfy the specifications herein. Subj ect to

514514 b. District sparsity - isolation formula:
515515 The district sparsity - isolation formula calculatio n shall
516516 apply only to school districts:
517517 (1) whose total area in square miles i s greater than
518518 the average number of square miles for all school
519519 districts in this state; and
520520 (2) whose areal density is less than one -fourth (1/4)
521521 of the state average areal den sity. Areal
522522 density shall be determined by dividin g the
523523 school district’s average daily membership by the
524524 school district’s total area in square miles.
525525 The district sparsity - isolation formula calculation shall
526526 be calculated as follows:
527527 The school district student cost factor multiplied by
528528 the school district area factor. The res ulting
529529 product shall be multiplied by the school district ’s
530530 average daily membership. Subjec t to the provisions
531531 of subparagraph c of this p aragraph, the resulting
532532 number shall be counted as additional students for the
533533 purpose of calculating State Aid.
534534 The school district student cost factor shall be calculated

662662 The school district area cost factor shall be c alculated as
663663 follows:
664664 Subtract the state average district area from the
665665 district area, then divide the remainder by the state
666666 average district area;
667667 however, the district area cost factor shall not exceed o ne
668668 (1.0).
669669 The State Board of Education shall defin e geographical barriers
670670 whose location in a school district would inhibit the district fr om
671671 consolidation or annexat ion. The Board shall make available an
672672 application process, review applications, and for districts the
673673 Board deems necessary allow addition al square miles to be used for
674674 the purposes of calculations used for the weighted distric t sparsity
675675 - isolation formula. Provided, that the additional square miles
676676 allowed for geographical barriers shall not exceed thirty percent
677677 (30%) of the district ’s actual size.
678678 c. State Aid funds which a district is calculated to
679679 receive as a result of t he weighted district
680680 calculation shall be restricted as follows:
681681 If, after the weighted distric t calculation is
682682 applied, the district ’s projected per pupil
683683 revenue exceeds one hundred fifty percent (150%)
684684 of the projected state average per pupil revenue,
685685 then the district’s State Aid shall be reduced by

746746 The July calculation of the pro jected per pupil
747747 revenue shall be determined by div iding the district’s
748748 preceding year’s average daily membership (ADM) as
749749 weighted by the pupil g rade level, the pupil category,
750750 the district and the teacher experience degree index
751751 calculations for projecte d State Aid into the
752752 district’s projected total rev enues including
753753 projected funds for the State Aid Formula for the
754754 preceding year, net assessed valuation for the
755755 preceding calendar year times thirty -nine (39) mills,
756756 county revenues excluding the county f our-mills
757757 revenues for the second preceding year, o ther state
758758 appropriations for the preceding year , and the

830830 The district’s projected total revenues for each
831831 calculation shall exclude the following co llections
832832 for the second preceding year: federal revenue,
833833 insurance loss payments, reimbursements, recovery of
834834 overpayments and refunds, unused reserves, prior

963963 SECTION 2. This act shall become effective July 1, 2023.
964964 SECTION 3. It being immediately necessary for the preservation
965965 of the public peace, health or safety, an emergency is hereby
966966 declared to exist, by reason whereof this act shall take effect an d
967967 be in full force from and after its passage and a pproval.
968968 SECTION 4. The provisions of this act shall be contingent upon
969969 the enactment of the provisions of Senate Bill No. 822 of the 1st
970970 Session of the 59th Oklahoma Legislature and shal l not become
971971 operative as law otherwise .
