146144 SECTION 1. AMENDATORY 21 O.S. 2021, Section 861, is

175172 Section 861. A. Every person who administers to any woman, or
176173 who prescribes for any woman, or advises or procures an y woman to
177174 take any medicine, drug or substance, or uses or employs any
178175 instrument, or other means wh atever, with intent thereby to procure
179176 the miscarriage of such woman an abortion, unless the same:
180177 1. The abortion is necessary to preserve her life due to a
181178 medical emergency as defined in subsection D of this section; or
182179 2. The pregnancy is the result of:
183180 a. rape or sexual assault that has been reported to law
184181 enforcement, or
185182 b. incest of a minor that has been reported to law
186183 enforcement,
187184 shall be guilty of a fe lony punishable by impriso nment in the State
188185 Penitentiary for not less than two (2) years nor more than five (5)
189186 years.
190187 B. 1. The use, prescription, administration, procuring, or
191188 selling of any type of contraception shall not be a violation of
192189 subsection A of this section if the contraception is administered
193190 before the time when a pregnancy coul d be determined through
194191 conventional medical testing .
195192 2. An act related to in vitro fertilization or otherwise
196193 related to the diagnosis or treatment of infertility or the
197194 preservation of fertility by a licensed healthcare provider acting

225221 lawfully and within the scope of his or her practice shall not be a
226222 violation of subsection A of this section.
227223 3. An act is not a violation of subsection A of this section if
228224 performed with the purpose to:
229225 a. save the life or preserve the health of the unborn
230226 child,
231227 b. remove a dead unborn child whose death was caused by
232228 miscarriage or spontaneous abortion, or
233229 c. remove an ectopic pregnancy.
234230 C. Any abortion performed or induced under an exception
235231 provided by subsection A of this section or performed or induced to
236232 remove an ectopic pregnancy shall be reported by the abortion
237233 provider to the State Department of Health in accordance with
238234 Section 18 of this act.
239235 D. As used in this section:
240236 1. “Medical emergency” means a condition that, in reasonable
241237 medical judgment:
242238 a. cannot be remedied by delivery of the child , and
243239 b. so complicates the medical c ondition of the preg nant
244240 woman as to necessitate the immediate abortion of her
245241 pregnancy to avert her death or for which a delay will
246242 create serious risk of substantial and irrever sible
247243 physical impairment of a major b odily function, not
248244 including psychological or emotional c onditions. A

276271 condition is not a medical e mergency if it is based o n
277272 a claim, diagnosis, or determination that the woman
278273 may engage in conduct which she intends to result in
279274 her death or in the subs tantial and irreversible
280275 physical impairment of a major bo dily function; and
281276 2. “Reasonable medical judgment ” means a medical judgment that
282277 would be made by a reasonably prud ent physician who is knowledgeable
283278 about the case and the treatment possibilities with respect to the
284279 medical conditions involved .
285280 SECTION 2. AMENDATORY 59 O.S. 2021, Section 509, is
286281 amended to read as follows:
287282 Section 509. The words “unprofessional conduct” as used in
288283 Sections 481 through 518.1 of this title are hereby declared to
289284 include, but shall not be limited to, the following:
290285 1. Procuring, aiding or abetting a criminal operation;
291286 2. The obtaining of any fee or offering to accept any fee,
292287 present or other form of remuneration whatsoever, on the assurance
293288 or promise that a manifestly incurable disease can or will be cured;
294289 3. Willfully betraying a professional secret to the detriment
295290 of the patient;
296291 4. Habitual intemperance or the habitual use of habit-forming

325319 5. Conviction or confession of, or plea of guilty, nolo
326320 contendere, no contest or Alford plea to a felony or any offense
327321 involving moral turpitude;
328322 6. All advertising of medical business in which statements are
329323 made which are grossly untrue or impro bable and calculated to
330324 mislead the public;
331325 7. Conviction or confession of, or plea of guilty, nolo
332326 contendere, no contest or Alford plea to a crime involving v iolation
333327 of:
334328 a. the antinarcotic or prohibition laws and regul ations
335329 of the federal government,
336330 b. the laws of this state,
337331 c. State Commissioner of Health rules, or
338332 d. a determination by a judge or jury;
339333 8. Dishonorable or immoral conduct which is likely to deceive,
340334 defraud, or harm the public;
341335 9. The commission of any act which is a violation of the
342336 criminal laws of any state when such act is connected with the
343337 physician’s practice of medicine. A complaint, indictment or
344338 confession of a criminal violati on shall not be necessary for the
345339 enforcement of this provisio n. Proof of the commission of th e act
346340 while in the practice of medicine or under the guise of the practice
347341 of medicine shall be unprofessional conduct;

375368 10. Failure to keep complete and accurat e records of purchase
376369 and disposal of controlled drugs or of n arcotic drugs;
377370 11. The writing of false or fictitious prescriptions for any
378371 drugs or narcotics declared by the laws of this state to be
379372 controlled or narcotic drugs;
380373 12. Prescribing or adminis tering a drug or treatment without
381374 sufficient examination and the establishment of a valid phys ician-
382375 patient relationship and not prescribing in a safe, medically
383376 accepted manner;
384377 13. The violation, or attempted violation, direct or indirect,
385378 of any of the provisions of the Oklahoma Allopathic Medical and
386379 Surgical Licensure and Supervision Act, eit her as a principal,
387380 accessory or accomplice;
388381 14. Aiding or abetting, directly or indirectly, the practice of
389382 medicine by any person not duly authorized under th e laws of this
390383 state;
391384 15. The inability to practice medicine with reasonable skill
392385 and safety to patients by reason of age, illness, drunkenness,
393386 excessive use of drugs, narcotics, chemicals, or any other type of
394387 material or as a result of any mental or p hysical condition. In
395388 enforcing this section the State Board of Medical Licensure and
396389 Supervision may, upon probable cause, request a physician to submit
397390 to a mental or physical examination by physicians designated by it.
398391 If the physician refuses to subm it to the examination, the Board

426418 shall issue an order requirin g the physician to show cause why the
427419 physician will not submit to the examination and shall schedule a
428420 hearing on the order within thirty (30) days after notice is served
429421 on the physician, excl usive of the day of service. The physician
430422 shall be notified by either personal service or by certified mail
431423 with return receipt requested. At the hearing, the physician and
432424 the physician’s attorney are entitled to present any testimony and
433425 other evidence to show why the physician should not be required to
434426 submit to the examination. After a compl ete hearing, the Board
435427 shall issue an order either requiring the physician to submit to the
436428 examination or withdrawing the request for examination. The medical
437429 license of a physician ordered to submit for examination may b e
438430 suspended until the results of the examination are received and
439431 reviewed by the Board;
440432 16. a. Prescribing, dispensing or administering of controlled
441433 substances or narcotic drugs in excess of t he amount
442434 considered good medical practice,
443435 b. Prescribing, dispensing or administering control led
444436 substances or narcotic drugs without medical need in
445437 accordance with pertinent licensing board standards,
446438 or
447439 c. Prescribing, dispensing or administering opio id drugs
448440 in excess of the maximum limits authorized in Section
449441 2-309I of Title 63 of the Oklaho ma Statutes;

477468 17. Engaging in physical conduct with a patient which is sexual
478469 in nature, or in any verbal behavior which is seductive or sexually
479470 demeaning to a patient;
480471 18. Failure to maintain an office record for each pa tient which
481472 accurately reflects t he evaluation, treatment, and medical necessity
482473 of treatment of the patient;
483474 19. Failure to provide necessary ongoing medical treatment when
484475 a doctor-patient relationship has been established, which
485476 relationship can be sev ered by either party providing a reasonable
486477 period of time is granted;
487478 20. a. Performance of an abortion as defined by Section 1 -730
488479 of Title 63 of the Oklahoma Statutes, except for an
489480 abortion necessary to prevent the death of the mother
490481 or to prevent substantial or irreversible physi cal
491482 impairment of the mother that substantially increases
492483 the risk of death. The performance of an abortion on
493484 the basis of the mental or emotional health of the
494485 mother shall be a violation of this paragraph,
495486 notwithstanding a claim or diagnosis that the woman
496487 may engage in conduct which she intends to result in
497488 her death, unless:
498489 (1) the abortion is necessary due to a medical
499490 emergency as defined in subparagraph d of this
500491 paragraph, or

528518 (2) the pregnancy is the result of:
529519 (a) rape or sexual assault that ha s been
530520 reported to law enforcement, or
531521 (b) incest of a minor that has been reported to
532522 law enforcement.
533523 b. The Board shall impose a penalty as provided in
534524 Section 509.1 of this title on a licensee who violates
535525 this paragraph. The penalty shall include, bu t not be
536526 limited to, suspension of the license for a period of
537527 not less than one (1) year .
538528 c. Any abortion performed or induced under an exception
539529 provided by subparagraph a of this paragraph or
540530 performed or induced to remove an ectopic pregnancy
541531 shall be reported by the physician to the State
542532 Department of Health in accordance with Section 18 of
543533 this act.
544534 d. As used in this paragraph:
545535 (1) “abortion” means the act of using, prescribing,
546536 administering, procuring, or selling of any
547537 instrument, medicine, drug, or any other
548538 substance, device, or means with the purpose to
549539 terminate the pregnancy of a wom an, with
550540 knowledge that the termination by any of those
551541 means will with reasonable likelihood cause the

643631 (3) “reasonable medical judgment ” means a medical
644632 judgment that would be made by a reasonably
645633 prudent physician who is knowledgeable about the
646634 case and the treatment possibilities with respect
647635 to the medical conditions involved ; or
648636 21. Failure to provide a p roper and safe medical facility
649637 setting and qualified assis tive personnel for a recognized medical
650638 act, including but not limited to an initial in -person patient
651639 examination, office surgery, diagnostic service or any other medical
652640 procedure or treatment. Adequate medical records to support

682669 SECTION 3. AMENDATORY 59 O.S. 2021, Section 637, is
683670 amended to read as follows:
684671 Section 637. A. The State Board of Osteopathic Examiners may
685672 refuse to admit a person to an examination or may refuse to issue or
686673 reinstate or may suspend or revoke any license issued or reinstated
687674 by the Board upon proof that the applicant or holder of such a
688675 license:
689676 1. Has obtained a license, license renewal or authorization to
690677 sit for an examination, as the c ase may be, through fraud,
691678 deception, misrepresentation or bribery; or has been granted a
692679 license, license renewal or authorization to sit for an examination
693680 based upon a material mistake of fact;
694681 2. Has engaged in the use or employment of dishonesty, fra ud,
695682 misrepresentation, fals e promise, false pretense, unethical conduct
696683 or unprofessional conduct, as may be determined by the Board, in the
697684 performance of the functio ns or duties of an osteopathic physician,
698685 including but not limited to the following:
699686 a. obtaining or attempting to obtain any fee, charge,
700687 tuition or other compensation by fraud, deception or
701688 misrepresentation; willfully and continually
702689 overcharging or overtreating patients; or charging for

731717 or for services which were not rendered,
732718 b. using intimidation, coercion or deception to obtain or
733719 retain a patient or discourage the use of a second
734720 opinion or consultation,
735721 c. willfully performing inappropriate or unnecessa ry
736722 treatment, diagnostic tests or osteopathic medical or
737723 surgical services,
738724 d. delegating professional responsibilities to a person
739725 who is not qualified by training, skill, competency,
740726 age, experience or licensure to perform them, noting
741727 that delegation may only occur within an appropr iate
742728 doctor-patient relationship, wherein a proper patient
743729 record is maintained including, but not limited to, at
744730 the minimum, a current history and physical,
745731 e. misrepresenting that any disease, ailment, or
746732 infirmity can be cured by a method, procedure,
747733 treatment, medicine or devic e,
748734 f. acting in a manner which results in final disciplinary
749735 action by any professional society or association or
750736 hospital or medical staff of such hospital in this or
751737 any other state, whether agreed to voluntarily or not,
752738 if the action was in any way rela ted to professional

889872 or regulation administered by the Board;
890873 8. Is incapable, for medical or psychiatr ic or any other good
891874 cause, of discharging the functions of an osteopathic physician in a
892875 manner consistent with the public ’s health, safety and welfare;
893876 9. Has been guilty of advertising by means of knowingly false
894877 or deceptive statements;
895878 10. Has been guilty of advertising, prac ticing, or attempting
896879 to practice under a name other than one ’s own;
897880 11. Has violated or refused to comply with a lawful order of
898881 the Board;
899882 12. Has been guilty of habitual drunkenness, or habitual
900883 addiction to the use of morphine, cocaine or other habit -forming
901884 drugs;
902885 13. Has been guilty of personal offensive behavior, which would
903886 include, but not be limited to, obscenity, lewdness, and

905888 14. a. Has performed an abortion as defined by Section 1-730
906889 of Title 63 of the Oklahoma Statutes, except for an

935917 or to prevent substantial or irreversible physical
936918 impairment of the mother th at substantially increases
937919 the risk of death. The performa nce of an abortion on
938920 the basis of the mental or emotional health of the
939921 mother shall be a violation of this paragraph,
940922 notwithstanding a claim or diagnosis that the woman
941923 may engage in conduct whi ch she intends to result in
942924 her death, unless:
943925 (1) the abortion is necessary due to a medical
944926 emergency as defined in subparagraph d of this
945927 paragraph, or
946928 (2) the pregnancy is the result of:
947929 (a) rape or sexual assault that has been
948930 reported to law enforcem ent, or
949931 (b) incest of a minor that has been reported to
950932 law enforcement.
951933 b. The Board shall impose a penalty as provided in this
952934 section and in Section 6 37.1 of this title on a
953935 licensee who violates this paragraph. The penalty
954936 shall include, but not be li mited to, suspension of
955937 the license for a period of not less than one (1)
956938 year.

996977 knowledge that the termination by any of those
997978 means will with reasonable likelihood cause the
998979 death of an unborn child. It does not include
999980 the use, prescription, administration, procuring,
1000981 or selling of any type of contraception if the
1001982 contraception is administered before the time
1002983 when a pregnancy could be determined through
1003984 conventional medical testing . It does not
1004985 include any act related to in vitro fertilization
1005986 or otherwise related to the diagnosis or
1006987 treatment of infertility or the preservation of
1007988 fertility by a licensed healthcare provider

10441024 (2) “medical emergency” means a condition that, in
10451025 reasonable medical judgment :
10461026 (a) cannot be remedied by delivery of the child,
10471027 and
10481028 (b) so complicates the medical c ondition of the
10491029 pregnant woman as to necessitate the
10501030 immediate abortion of her pregnancy to avert
10511031 her death or for which a delay will create
10521032 serious risk of substantial and irreversible
10531033 physical impairment of a major bodily
10541034 function, not including psycholo gical or
10551035 emotional conditions. A condition is not a
10561036 medical emergency if it is based on a claim,
10571037 diagnosis, or determination that the woman
10581038 may engage in conduct which she intends to

10921071 case and the treatment possibilities with respect
10931072 to the medical conditions involved ; or
10941073 15. Has been adjudicated to be insane, or incompetent, or
10951074 admitted to an institution for the treatment of psychiatric
10961075 disorders.
10971076 B. The State Board of Osteopathic Examiners shall neith er
10981077 refuse to renew, nor suspend, nor revoke any license, however, for
10991078 any of these causes, unless the person accused has been given at
11001079 least twenty (20) days’ notice in writing of the charge agains t him
11011080 or her and a public hearing by the Board; provided, t hree-fourths
11021081 (3/4) of a quorum present at a meeting may vote to suspend a license
11031082 in an emergency situation if the licensee affected is prov ided a
11041083 public hearing within thirty (30) days of the emer gency suspension.
11051084 C. The State Board of Osteopathic Examin ers shall have the
11061085 power to order or subpoena the attendance of witnesses, the
11071086 inspection of records and premises and the production of rele vant
11081087 books and papers for the investigation of matters th at may come
11091088 before them. The presiding officer of the Boar d shall have the

11391117 D. Any osteopathic physician in the State of Oklahoma this
11401118 state whose license to practice osteop athic medicine is revoked or
11411119 suspended under this section s hall have the right to seek judicial
11421120 review of a ruling of the Board pursuant to the Administrative
11431121 Procedures Act.
11441122 E. The Board may enact rules and r egulations pursuant to the
11451123 Administrative Procedures Act setting out additional acts of
11461124 unprofessional conduct, which acts shall be grounds for refusal to
11471125 issue or reinstate, or for action to condition, suspend or revoke a
11481126 license.
11491127 SECTION 4. AMENDATORY 63 O.S. 2021, Section 1-731.3, is
11501128 amended to read as follows:
11511129 Section 1-731.3. A. No person shall perform or induce an
11521130 abortion upon a pregnant woman without first detecting whether or
11531131 not her unborn child has a heartbeat. No person shall perform or
11541132 induce an abortion upon a pregnant woman after such time as her
11551133 unborn child has been determined to have a detectable heartbeat
11561134 except if, in reasonable medical judgment, she has a condition that
11571135 so complicates her medical condition that it necessitates the
11581136 abortion of her pregna ncy to avert her death or to avert s erious
11591137 risk of substantial and irreversible physical impairment of a major
11601138 bodily function, not including psychological or emotional

11941171 1. If the abortion is necessary due to a medical emerge ncy as
11951172 defined in subsection D of this section; or
11961173 2. If the pregnancy is the result of :
11971174 a. rape or sexual assault that has been reported to law
11981175 enforcement, or
11991176 b. incest of a minor that has been reported to law
12001177 enforcement.
12011178 C. Any abortion performed or induced under an exception
12021179 provided by subsection B of this section , performed or induced to
12031180 remove an ectopic pregnancy, or performed or induced in compliance
12041181 with subsection A of this section shall be reported by the abortion
12051182 provider to the State Department of Health in accordance with
12061183 Section 18 of this act.
12071184 D. As used in this section:
12081185 1. “Abortion” means the act of using, prescribing,
12091186 administering, procuring, or selling of any i nstrument, medicine,
12101187 drug, or any other substance, device, or means with the purpose to

12561232 activity or the steady or repetitive rhythmic contract contractions
12571233 of the heart within the gestational sac .;
12581234 3. “Medical emergency” means a condition that, in reasonable
12591235 medical judgment:
12601236 a. cannot be remedied by delivery of the child, and
12611237 b. so complicates the medical cond ition of the pregnant
12621238 woman as to necessitate the immediate abortion of her

14101383 B. 1. Notwithstanding any other provision of law, a person
14111384 shall not purposely perform, induce, or attempt to perform or induce
14121385 an abortion except to save the life of a pregnant woman in:
14131386 1. If the abortion is necessary due to a medical emergency as
14141387 defined in subsection A of this section ; or

14521424 3. 2. This section does not:
14531425 a. authorize the charging or conviction of a woman with
14541426 any criminal offense in the death of her own unborn

14561428 b. prohibit the sale, use, pr escription or administration
14571429 of a contraceptive measure, drug or chemical if the
14581430 contraceptive measure, drug or chemical is
14591431 administered before the time when a pregnancy could be
14601432 determined through conventi onal medical testing and if
14611433 the contraceptive measure, drug or chemical is sold,
14621434 used, prescribed or administered in accordance with
14631435 manufacturer instructions.
14641436 4. 3. It is an affirmative defense to prosecution under this
14651437 section if a licensed physician provi des medical treatment to a

15051476 1. The abortion is necessary to prevent the death of the
15061477 pregnant woman or to prevent impairment to her heal th due to a
15071478 medical emergency as defined in subsection I of this section; or
15081479 2. The pregnancy is the result of:
15091480 a. rape or sexual assault that has been reported to law
15101481 enforcement, or
15111482 b. incest of a minor that has been reported to law
15121483 enforcement.
15131484 B. An unborn child shall be presumed to be viable if more than
15141485 twenty-four (24) weeks have elap sed since the probable beginning of
15151486 the last menstrual period of the pregnant woman, based upon either
15161487 information provided by her or by an examination by h er attending

15461516 viability exists as to that particular unborn child, then he or she
15471517 shall certify in writing the precise medical criter ia upon which he
15481518 has determined that the particular unborn child is n ot viable before
15491519 an abortion may be performed or induced.
15501520 C. No abortion of a viable unborn child shall be performed or
15511521 induced except after written certification by the attending
15521522 physician that in his best medical judgment the abortion is
15531523 necessary to prevent the death of the pregnant woman or to prevent
15541524 an impairment to her health . The physician shall further certify in
15551525 writing the medical indications for such abortion and the probable
15561526 health consequences if the abortion is not performed or induced .
15571527 D. C. The physician who sh all perform or induce an abortion
15581528 upon a pregnant woman after such time as her unborn child has become
15591529 viable shall utilize the available method or technique of abort ion
15601530 most likely to preserve the life and health of the unborn chil d,
15611531 unless he or she shall first certify in writing that in his or her
15621532 best medical judgment such method or technique shall present a
15631533 significantly greater danger t o the life or health of the pregna nt
15641534 woman than another available method or technique.
15651535 E. D. An abortion of a viable unborn child performed solely
15661536 under the exception provided by paragraph 2 of subsection A of this
15671537 section shall be performed or induced only when there is in
15681538

15981567 E. During the performance or inducing of th e abortion, the
15991568 physician performing it, and subsequent to it, the physician
16001569 required by this section to be in attendance , if applicable under
16011570 subsections D and F of this section, shall take all reasonable steps
16021571 in keeping with good medical practice, consi stent with the procedure
16031572 used, to preserve the life and health of the child, in the same
16041573 manner as if the child had been born naturally or spontaneou sly.
16051574 F. The requirement of the attendance of a second physician may
16061575 be waived when in the best judgment of the attending physician a
16071576 shall not apply to an abortion performe d due to a medical emergency
16081577 exists and further delay would result in a serious thr eat to the
16091578 life or physical health of the pregnant woman under the exception
16101579 provided by paragraph 1 of sub section A of this section . Provided
16111580 that, under such emergen cy circumstances and waiver, the attending
16121581 physician shall have the duty to take all rea sonable steps to
16131582 preserve the life and health of the chil d before, during and after
16141583 the abortion procedure, unless such steps shall, in the best medical
16151584 judgment of the physician, present a significantly great er danger to
16161585 the life or health of the pregnant woman.
16171586 F. G. Any person violating subsection A of this section shall
16181587 be guilty of homicide.

16511619 Section 18 of this act.
16521620 I. As used in this section:
16531621 1. “Abortion” means the act of using, prescribing,
16541622 administering, procuring, or selling of any i nstrument, medicine,
16551623 drug, or any other substance, device, or means with the purpose to
16561624 terminate the pregnancy of a woman , with knowledge that the
16571625 termination by any of t hose means will with reasonable likelihood
16581626 cause the death of an unborn child. It does not include the use,
16591627 prescription, administration, procuri ng, or selling of any type of
16601628 contraception if the contraception is administered before the time
16611629 when a pregnancy could be determined through convent ional medical
16621630 testing. It does not include any act related to in vitro
16631631 fertilization or otherwise related to the diagnosis or treatment of
16641632 infertility or the preservation of fertility by a licensed
16651633 healthcare provider acting lawfully and within the scope of his or
16661634 her practice. An act is not an abortion if the act is performed
16671635 with the purpose to:
16681636 a. save the life or preserve the healt h of the unborn

17091676 condition is not a medical e mergency if it is based on
17101677 a claim, diagnosis, or determina tion that the woman
17111678 may engage in conduct which sh e intends to result in
17121679 her death or in the subs tantial and irreversible
17131680 physical impairment of a major bodily function; and
17141681 3. “Reasonable medical judgment” means a medical judgment that
17151682 would be made by a reasonably prudent physician who is knowledgeable
17161683 about the case and the treatment possibilities with respect to th e
17171684 medical conditions involved .

19131876 C. Subsection A of this section shall not apply :
19141877 1. If the abortion is necessary due to a medical emerge ncy as
19151878 defined in subsection D of this section; or

22062163 section, the physician must use a test that is:
22072164 1. Consistent with the physician’s good faith and reasonable
22082165 understanding of standard medical practice; and
22092166 2. Appropriate for the estimated gestational age of the unbo rn
22102167 child and the condition of the pregnant woman and her pregnancy.
22112168 D. A physician making a determination under subsection B of
22122169 this section shall record in the pregnant woman’s medical record:
22132170 1. The estimated gestational age of the unborn child;
22142171 2. The method used to estimate the gestational age; and
22152172 3. The test used for detecting a fetal heartbeat including the
22162173 date, time, and results of the test.
22172174 SECTION 12. AMENDATORY Section 4, Chapter 190, O.S.L.
22182175 2022 (63 O.S. Supp. 2022, Section 1 -745.34), is amended to read as

22202177 Section 1-745.34. A. Except as provided by Sections 5 and 6 of

22592215 that regulates or prohibits abortion including but not lim ited to
22602216 any provision that restricts or regulates an ab ortion by a
22612217 particular method or during a particular stage of pregnancy.
22622218 SECTION 13. AMENDATORY Section 5, Chapter 190, O.S.L.
22632219 2022 (63 O.S. Supp. 2022, Section 1 -745.35), is amended to read as

22652221 Section 1-745.35. A. Sections 3 and 4 of this act Sections 1-

22672223 believes an abortion is necessary due to a medical emergency exists

23572311 1. “Abortion” means the act of using, prescribing,
23582312 administering, procuring, or selling of any inst rument, medicine,
23592313 drug, or any other substance, device, or means with the purpose to
23602314 terminate the pregnancy of a woman, with knowledge that the
23612315 termination by any of those means will with reasonable likelihood
23622316 cause the death of an unborn child. It does not include the use,
23632317 prescription, administration, proc uring, or selling of Plan B,
23642318 morning-after pills, or any other type of contraception or emergency
23652319 contraception if the contraception is administered before the time
23662320 when a pregnancy could be determined through convent ional medical
23672321 testing. It does not include any act related to in vitro
23682322 fertilization or otherwise related to the diagnosis or treatment of
23692323 infertility or the preservation of fertility by a licensed
23702324 healthcare provider acting lawfully and within the scope of his or
23712325 her practice. An act is not an abortion if the act is performed
23722326 with the purpose to:
23732327 a. save the life or preserve the health of the unborn
23742328 child,
23752329 b. remove a dead unborn child whose death was caused by
23762330 miscarriage or spontaneous abortion , or
23772331 c. remove an ectopic pregnancy;

24102363 injury, including a life-endangering physical condition caused by or
24112364 arising from the pregnancy itself that, in reasonable medi cal

24132366 a. cannot be remedied by delivery of the child , and
24142367 b. so complicates the medical condition of the pregnant
24152368 woman as to necessitate the immediate abortion of her
24162369 pregnancy to avert her death or for which a delay will
24172370 create serious risk of su bstantial and irreversible
24182371 physical impairment of a major bodily function, not
24192372 including psychological or emotional conditions. A
24202373 condition is not a medical e mergency if it is based on
24212374 a claim, diagnosis, or det ermination that the woman
24222375 may engage in conduct which she intends to result in
24232376 her death or in the substantial and irreversi ble
24242377 physical impairment of a major bodily function ;
24252378 4. “Reasonable medical judgment ” means a medical judgment that
24262379 would be made by a reasonably prudent physician who is knowl edgeable
24272380 about the case and the treatment possibilities with respect to the
24282381 medical conditions involved;

25162467 Statutes, Section 1-745.1 et seq. of Title 63 of th e Oklahoma
25172468 Statutes, Section 1-745.31 et seq. of Title 63 of the Oklahoma
25182469 Statutes, or Section 1-745.51 of Title 63 of the Oklahoma Statutes
25192470 shall be reported by the abortion provider to the State Department
25202471 of Health on a form prescribed by the State Commissioner of Health.
25212472 The form shall not request the name of the woman who obtained the
25222473 abortion or any other potentia lly identifying information that could
25232474 lead to the identification of the woman.
25242475 B. The abortion provider shall state on the form the specific
25252476 exception under which the abortion was performed and shall provide a
25262477 detailed explanation of the justification for performing such
25272478 abortion including any relevant supporting documentation. The
25282479 completed form shall include all other infor mation as may be
25292480 required by the Commissioner.

25582508 this section into an annual statistical report which shall be
25592509 published on the Department’s Internet website and submitted to the
25602510 President Pro Tempore of th e Senate and the Speaker of the House of
25612511 Representatives each year.
25622512 D. The Commissioner shall promulgate rules to implement this
25632513 section. Such rules shall include, but not be limited to:
25642514 1. The manner of reporting;
25652515 2. Information to be reported ; and
25662516 3. Patient privacy protections that ensure the anonymity of
25672517 women who obtain an abortion under an exception provided by Section
25682518 861 of Title 21 of the Oklahoma Statutes, Section 731.4 of Title 63
25692519 of the Oklahoma Statutes, Section 1-745.31 et seq. of Title 63 of
25702520 the Oklahoma Statutes, or Section 1-745.51 of Title 63 of the
25712521 Oklahoma Statutes.
25722522 SECTION 19. REPEALER 63 O.S. 2021, Sections 1-733 and 1-
25732523 745.6, are hereby repealed.
25742524 SECTION 20. It being immediately necessary for the preservation
25752525 of the public peace, health or safety, an emergency is hereby
25762526 declared to exist, by reason whereo f this act shall take effect and
25772527 be in full force from and after its passage and approval.
