7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 6063 of Title 36, unless there
8080 is created a duplication in numb ering, reads as follows:
8181 A. 1. There is hereby created the Task Force on Rural Health
8282 Care Reimbursement to examine the care provided by health care
8383 providers in rural areas in this state and ensure that items and
8484 services provided by health care providers are appropriately
8585 reimbursed pursuant to Section 6053 et seq. of Title 36 of the
8686 Oklahoma Statutes.
8787 2. The task force shall examine whether d iscriminatory
8888 practices are being engaged in by an insurer against a health care

140140 provider. Discriminatory practices sh all include, but not be
141141 limited to:
142142 a. intentionally denying payment for health car e services
143143 provided to an insured,
144144 b. breaching fiduciary duty to honor written plan terms,
145145 c. exposing insureds, health care providers, and
146146 hospitals to balanced billing by reimburs ing a
147147 provider at an amount lower than the in-network cost-
148148 sharing amount,
149149 d. providing lower rates for services provided, or
150150 e. any other practices prohibited by law .
151151 B. The task force shall be composed of the following and e ach
152152 member shall serve at the pleasure of his or her appointing
153153 authority:
154154 1. One Certified Registered Nurse Anesthetist, one Nurse
155155 Practitioner, and one Certified Nurse-Midwife, to be appointed by
156156 the Governor;
157157 2. One Doctor of Medicine, one Doctor of Osteopathic Medicine,
158158 and one Doctor of Dental Surgery to be appointed by the President
159159 Pro Tempore of the Senate;
160160 3. Two members of the health insurance industry, and one
161161 Occupational Health Advisor, to be appointed by the Speaker of the

214214 4. The Insurance Commissioner or his o r her designee who shall
215215 serve as chairman and an e x-officio member of the task force.
216216 C. The Insurance Department shall provide support and personnel
217217 needed by the task force.
218218 D. The Task Force on Rural Health Care Reimbursem ent shall
219219 publish its findings and recommendations in a report to be delivered
220220 to the Governor, the President Pro Tempore of the Senate, the
221221 Speaker of the House of Representatives , the Chairman of the House
222222 Insurance Committee, and the Chairman of the Senat e Retirement and
223223 Insurance Committee no later than December 1, 2024.
224224 SECTION 2. This act shall become effective November 1, 2023.
