77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 6063 of Title 36, unless there
80	80	is created a duplication in numb ering, reads as follows:
81	81	A. 1. There is hereby created the Task Force on Rural Health
82	82	Care Reimbursement to examine the care provided by health care
83	83	providers in rural areas in this state and ensure that items and
84	84	services provided by health care providers are appropriately
85	85	reimbursed pursuant to Section 6053 et seq. of Title 36 of the
86	86	Oklahoma Statutes.
87	87	2. The task force shall examine whether d iscriminatory
88	88	practices are being engaged in by an insurer against a health care

140	140	provider. Discriminatory practices sh all include, but not be
141	141	limited to:
142	142	a. intentionally denying payment for health car e services
143	143	provided to an insured,
144	144	b. breaching fiduciary duty to honor written plan terms,
145	145	c. exposing insureds, health care providers, and
146	146	hospitals to balanced billing by reimburs ing a
147	147	provider at an amount lower than the in-network cost-
148	148	sharing amount,
149	149	d. providing lower rates for services provided, or
150	150	e. any other practices prohibited by law .
151	151	B. The task force shall be composed of the following and e ach
152	152	member shall serve at the pleasure of his or her appointing
153	153	authority:
154	154	1. One Certified Registered Nurse Anesthetist, one Nurse
155	155	Practitioner, and one Certified Nurse-Midwife, to be appointed by
156	156	the Governor;
157	157	2. One Doctor of Medicine, one Doctor of Osteopathic Medicine,
158	158	and one Doctor of Dental Surgery to be appointed by the President
159	159	Pro Tempore of the Senate;
160	160	3. Two members of the health insurance industry, and one
161	161	Occupational Health Advisor, to be appointed by the Speaker of the
162	162	House of Representatives ; and

214	214	4. The Insurance Commissioner or his o r her designee who shall
215	215	serve as chairman and an e x-officio member of the task force.
216	216	C. The Insurance Department shall provide support and personnel
217	217	needed by the task force.
218	218	D. The Task Force on Rural Health Care Reimbursem ent shall
219	219	publish its findings and recommendations in a report to be delivered
220	220	to the Governor, the President Pro Tempore of the Senate, the
221	221	Speaker of the House of Representatives , the Chairman of the House
222	222	Insurance Committee, and the Chairman of the Senat e Retirement and
223	223	Insurance Committee no later than December 1, 2024.
224	224	SECTION 2. This act shall become effective November 1, 2023.
